A report of any action taken will be presented prior to adjournment of the regular meeting. A. CONFERENCE WITH LEGAL COUNSEL – EXISTING LITIGATION: Pursuant to Subdivision (d)(1) of Section 54956.9 City of Rocklin v. Town of Loomis; Citizens for Responsible Growth v. Town of Loomis TUESDAY September 13, 2022 7:00 P.M. The Town Council meeting will be held at the Loomis Depot Building and is open to public attendance. A Resolution of the Town Council of the Town of Loomis APPROVE RESOLUTION Ratifying the Proclamation of a State of Emergency by Governor Gavin Newsom (March 4, 2020) as applicable in the Town and Authorizing teleconference meetings of legislative bodies of the Town pursuant to the Ralph M. Brown Act PUBLIC HEARING 13. A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOOMIS UPDATING AND APPROVING BUILDING DEPARTMENT FEES, EFFECTIVE NOVEMBER 14,2022 A recent survey has found that Loomis’s building permit cost is the second lowest in the State, only ahead of Siskiyou County. The cost of building permits and inspections should be borne by the property owner, but the Town of Loomis’s fee structure has not been updated in many years. When such fees don’t cover the full cost of the activity, the difference is borne by the Town’s taxpayers in general RECOMMENDATION Adopt resolution. PUBLIC COMMENT 14. A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOOMIS UPDATING THE PLANNING DEPARTMENT FEE SCHEDULE, EFFECTIVE NOVEMBER 14, 2022 In 2009, the Town contracted with Sinclair and Associates to update our planning department fees. They calculated those fees on a cost recovery basis, which means that all costs relating to a specific activity (or Town Services) should be paid by the applicant. These fees have not been increased since they were adopted. The problem here is that the cost of these activities now exceeds the fees collected. This puts a burden on the general fund, and essentially, the taxpayers of the Town. RECOMMENDATION Adopt resolution PUBLIC COMMENT BUSINESS 15. PLACER COUNTY LOCAL AGENCY FORMATION COMMISSION (LAFCO) PRESENTATION. The Town Council recently requested a “LAFCO 101” informational presentation from Placer County LAFCO. Executive Director Michelle McIntyre will be at tonight’s meeting to provide that presentation. Placer Local Agency Formation Commission, or Placer LAFCO, is a state mandated independent regulatory body whose role is to encourage the orderly formation of local governmental agencies, preserve agricultural and open space resources, and discourage urban sprawl through the review of city and special district boundary changes and the extension of the services they provide. Specifically, Placer LAFCO has jurisdiction within Placer County over proposed special district and city annexations and detachments, district formations and dissolutions, consolidations and mergers, city incorporations and disincorporations and the formation of subsidiary districts. 9/8/2022 8:48 AM P:\Clerk\1 Agendas\2022\15 September 13, 2022\0 Agenda Sept 13, 2022 TC.doc 3 RECOMMENDED ACTION Receive presentation from Placer County Local Agency Formation Commission (LAFCO) Executive Director Michelle McIntyre on what LAFCO is and does. SACOG PRESENTATION SACOG informational briefing on their Blueprint project (formerly known as the Metropolitan Plan / Sustainable Communities Strategy) RECOMMENDED ACTION: Receive and file PUBLIC COMMENT 17. LOOMIS LIBRARY AND COMMUNITY CENTER’S ANNUAL REPORT California state law requires that the library board of trustees or administrative head give an annual report to Council. This report includes information relating to the condition of the library for the fiscal year ending on June 30th. RECOMMENDED ACTION: Receive and file. The applicant must make the request for a time extension prior to the beginning of the meeting.) 5. Commission/Council asks questions of the applicant (and staff) 6. Public comment – maximum 3 minutes per speaker, one opportunity to speak each 7.
