POLICY FOR DESIGNATED PUBLIC HEARING ITEM NOS. 5, 8, AND 9;
Pursuant to the Commission’s general operating procedures, the Commission at times must
necessarily limit the speaking times of those presenting testimony on either side of
an issue that is designated as a public hearing item. All requests to address the Commission on
public hearing items must be submitted prior to the Commission’s consideration of the item.
TIME SEGMENTS noted * herein are approximate. Some items may be delayed due to length of
discussion of previous items.
To ensure that the Commission has ample opportunity to review written materials, members
of the public who wish to submit written materials on agendized items should submit them
to the Commission Office, 200 North Spring Street, Room 532, Los Angeles, CA 90012, at
least 10 days prior to the meeting at which the item is to be heard in order to meet the
mailing deadline.
The Commission may RECONSIDER and alter its action taken on items listed herein at any time
during this meeting or during the next regular meeting, in accordance with the Commission Policies
and Procedures and provided that the Commission retains jurisdiction over the case..

The time in which a party may seek judicial review of this determination is governed by the California
Code of Civil Procedure Section 1094.6. Under that provision, a petitioner may seek judicial review
of any decision of the City, pursuant to California Code of Civil Procedure Section 1094.5, only if the
petition for writ of mandate pursuant to that section is filed no later than the 90th day following the
date on which the City’s decision became final.

EXCEPTIONS, pursuant to Section 11.5.7.F of the Municipal Code, from the following
provisions of the Ventura-Cahuenga Boulevard Corridor Specific Plan (Ordinance Nos.
166,560, 171,240, & 174,052):
a. Section 7.D.1.c to allow a 5 foot, 6 inch rear yard landscaped buffer for the
proposed parking lot in lieu of the 10 foot landscaped buffer otherwise
required on a surface parking lot adjacent to a residentially zoned lot;
b. Section 7.E.1.c.1 to allow building height of 54 feet in lieu of the maximum 45
feet permitted by the specific plan for the Encino subarea;
c. Section 16 to allow the requested alley vacation to be heard by the Advisory
Agency in a consolidated public hearing with other matters which are before
the Advisory Agency in the Vesting Tentative Tract No. 61164 application, in
lieu of the hearing being conducted by the City Planning Commission or City
Council.
PROJECT PERMIT COMPLIANCE, pursuant to Section 11.5.7.C of the Municipal Code,
with the Ventura/Cahuenga Boulevard Corridor Specific Plan including:
a. Section 6.B.1.b to permit an additional floor area ratio of 0.25:1 above the
permitted 1.25:1 for a mixed use project;
b. Section 7.F.4 to permit shared parking between the existing office building
uses and the proposed retail and residential guest parking.
CONDITIONAL USE, pursuant to Section 12.24 W 1 of the Municipal Code, to permit the
off-site sale of beer and wine in conjunction with a pharmacy, specialty market or similar
type of use and the on-site consumption of a full line of alcoholic beverages in conjunction
with a restaurant.
SITE PLAN REVIEW findings for projects, pursuant to Section 16.05 of the Municipal
Code, which result in an increase of 50 or more dwelling units and a net increase of 1,000
or more average daily trips.
Proposed Project: A mixed use project, having a total floor area of 172,900 square feet
and a floor area ratio of approximately 1.47:1, encompassing an existing 6 story, 86,450
square foot office building which will remain and a new 86,450 mixed use building
composed of 51 condominium/rental units above approximately 20,598 square feet of
ground level retail. The retail portion of the project includes a 14,220 square foot pharmacy,
specialty market or similar type of use with alcoholic beverage sales for off-site
consumption, a 5,268 square foot restaurant selling a full line of alcoholic beverages for

on-site consumption, and a 1,110 square foot retail, office and/or fast food restaurant space.
The new mixed use development will be four stories, 54 feet in height, with 3 levels
of residential units above the ground floor commercial uses. Parking will include existing
surface spaces and the construction of a two-level subterranean garage. The applicant
proposes shared parking to provide a total of 434 parking spaces in-lieu of the required
minimum 472 spaces. Of these 434 provided parking spaces, 332 will be shared parking
spaces between the office, retail and residential guest parking; 102 spaces will be dedicated
to the exclusive use of the residential occupants. Project includes the requested vacation
of an existing 20-foot wide alley, approximately 76 feet in length, which is located adjacent
to the northwest corner of the property.

10. PUBLIC COMMENT PERIOD
The Area Planning Commission shall provide an opportunity in open meetings for the
public to address it, on items of interest to the public that are within the subject matter
jurisdiction of the Area Planning Commission. (This requirement is in addition to any
other hearing required or imposed by law.) Persons making requests are
encouraged to do so in writing and should submit 10 copies to the Area Planning
Commission for its consideration.
Persons wishing to speak must submit a speaker’s request form prior to the
commencement of the public comment period.
Individual testimony within the public comment period shall be limited to five (5) minutes
per person and up to ten (10) minutes per subject.
