Appellant representative testified and addressed the issue of safety and questioned the staff findings. Presented pictures of the neighborhood and showed by number of hands of people who are opposed to the project. Appellant testified and voiced his concern. Ten people testified against the project. Others submitted speaker cards, but did not speak, to show support of the appeal. Applicant representative spoke and showed pictures of the subject property. Applicant and his spouse testified. Council District representative spoke in opposition of the project. Both appellant and applicant rebutted and answered questions of the Commission. Architect of the applicant clarified some questions of the Commission on the requested height. Staff responded to statements made during the public hearing and answered questions of the Commission. Lengthy discussion ensued on the issues surrounding the height of the fence. The Chair closed public hearing. Commission deliberated. 12 SOUTH VALLEY AREA PLANNING COMMISSION February 23, 2006 Motion: Grant the appeal in part, modify Condition No. 6 to reduce the height of the fence to 7.5 feet, adopt the staff findings and approve the mitigated negative declaration.
