The meeting was called to order by Commission President Matt Epstein at 4:49 p.m. Commissioners present: Steve Cochran, Gordon Murley, Barbara Romero Commissioner absent: George Andros 1. Continued from 06/22/06 and Appeal Status: Not further appealable 12/14/06 PUBLIC HEARING APPEAL, from the Director’s decision, pursuant to Los Angeles Municipal Code Section 12.26-K, that the Department of Building and Safety did not err or abuse discretion in the issuance of Order to Comply No. 1101 on October 5, 2005 for a retaining wall in excess of 6 feet in height. APPLICANT: Steve Berman Gideon Jacov, Representative APPELLANT: Steve Berman Gideon Jacov, Representative STAFF RECOMMENDED DENIAL OF APPEAL Patricia Brown (213) 978-1306 Applicant’s representative discussed in detail their withdrawal letter dated April 11, 2007. Commissioner Murley moved to deny the appeal as recommended by staff. However, applicant’s representative contested that an action by the Commission is not required as they are withdrawing the application. Lengthy discussion ensued regarding the interpretation of the withdrawal letter. At this point, the Commission President recommended continuation of the matter to the next meeting, May 10, 2007. Chief Zoning Administrator will clarify and submit in writing the proper procedures for the withdrawal of applications. 4. PUBLIC COMMENT PERIOD The Area Planning Commission shall provide an opportunity in open meetings for the public to address it, on items of interest to the public that are within the subject matter jurisdiction of the Area Planning Commission. (This requirement is in addition to any other hearing required or imposed by law.) Persons making requests are encouraged to do so in writing and should submit 10 copies to the Area Planning Commission for its consideration. Persons wishing to speak must submit a speaker’s request form prior to the commencement of the public comment period. Individual testimony within the public comment period shall be limited to five (5) minutes per person and up to ten (10) minutes per subject.
