Continued from 06/22/06, Appeal Status: Not further appealable 12/14/06, and 04/26/07 PUBLIC HEARING APPEAL, from the Director’s decision, pursuant to Los Angeles Municipal Code Section 12.26-K, that the Department of Building and Safety did not err or abuse discretion in the issuance of Order to Comply No. 1101 on October 5, 2005 for a retaining wall in excess of 6 feet in height. Commissioner Murley, therefore, moved to receive and file the withdrawal letter dated April 11, 2007 submitted by the applicant’s representative. Motion was seconded by Commissioner Romero and voted in favor by Commissioners Cochran and Epstein. 4. ZA-2006-6641-ZAD-1A CEQA: ENV 2006-6642-CE Council District: 4 Plan Sherman Oaks-Studio City-Toluca Location: 7411 Woodrow Wilson Drive Lake-Cahuenga Pass Expiration Date: 05/23/07 Appeal Status: Not further appealable to City Council PUBLIC HEARING AN APPEAL from certain conditions of the Zoning Administrator’s approval, pursuant to Los Angeles Municipal Code Section 12.24-X,7, of a Zoning Administrator’s Determination to permit the construction, use and maintenance of an over in height fence in the front, side and rear yard setbacks of a single-family dwelling in the RE15-1-H Zone. The appeal requests are: 1) a modification of the language of Condition No. 7 to allow an 8-foot solid wooden fence; and 2) the deletion of Condition Nos. 8, 9, and 10 concerning landscaping and fence height. Applicant’s representative testified for the Project and stated a mutual agreement Has been reached with the adjacent neighbors. He showed photos and a map of the proponed Project and the surrounding properties. He also discussed the modified Conditions of Approval contained in his letter dated May 3, 2007. One speaker testified to make sure the side yard fence remains at six feet. Council District representative testified in support of the Project/appeal. The President closed the public hearing. The Commissión deliberated. Motion: Grant the appeal; sustain the action of the Zoning Administrador; Modified Conditions 7 and 8; adopt the findings and adopt ENV-2006- \ 6642-CE. PUBLIC COMMENT PERIOD The Area Planning Commission shall provide an opportunity in open meetings for the public to address it, on items of interest to the public that are within the subject matter jurisdiction of the Area Planning Commission. (This requirement is in addition to any other hearing required or imposed by law.) Persons making requests are encouraged to do so in writing and should submit 10 copies to the Area Planning Commission for its consideration. Persons wishing to speak must submit a speaker’s request form prior to the commencement of the public comment period. Individual testimony within the public comment period shall be limited to five (5) minutes per person and up to ten (10) minutes per subject.
