APCSV-2008-4285-SPE-SPP-CUW Council District: 4 CEQA: ENV-2006-7525-MND-REC 2 Location: 3151 North Cahuenga Boulevard Expiration Date: 01/31/11 Plan: Sherman Oaks-Studio City Appeal Status: Further appealable to Toluca Lake-Cahuenga Pass City Council PUBLIC HEARING COMPLETED OCTOBER 23, 2009 Proposed Project: Installation, use, and maintenance of an unmanned Wireless Telecommunication Facility (WTF) and appurtenant screening material, maximum height of 63 feet on the rooftop and building façade of an existing office/retail building. The proposed installation includes one new ten foot (10’) RF transparent screen wall and set of antennas on the rooftop and two (2) sets of antennas mounted on the façade of the building, for a total of ten eleven (11) panel antennas in three sectors and six outdoor equipment cabinets, new antennas to be co-located with other existing telecommunication facilities. All antenna sectors and equipment cabinets will be screened and painted to match the existing building façade; equipment cabinets would be located in the basement of the building. The property involved is an approximately 15,412 square foot site classified in the C2-1VL (Commercial) Zone and also South Valley Area Planning Commission 3 January 27, 2011 located within the boundaries of the Ventura-Cahuenga Boulevard Specific Plan and the Outer Corridor of the Mulholland Scenic Parkway Specific Plan. [Note: The project was approved by the Mulholland Design Review Board on November 18, 2010.] A public hearing was previously held on October 23, 2009 for the above referenced project. Changes to the previously noticed project on which the South Valley Area Planning Commission will conduct a limited public hearing are shown struck out and underlined above. Requested Actions 1. Pursuant to Section 11.5.7 F 1 (f) of the Municipal Code, a Specific Plan Exception to permit the location of a wireless telecommunication facility within the boundaries of the Mulholland Scenic Parkway Specific Plan (Ordinance No. 167,943); 2. Pursuant to Section 12.24 W.49 of the Municipal Code, a Conditional Use to allow wireless telecommunication facilities, including radio and television transmitters citywide, other than wireless antennas and associated equipment cabinets on the rooftops of buildings in the C and M Zones, including geographic specific plan areas, which conform to the provisions of Section 12.21 A.21. of the Code; and 3. Pursuant to Section 11.5.7 C of the Municipal Code, a Project Permit Compliance with the Ventura–Cahuenga Boulevard Corridor. 4. Pursuant to Section 21082.1(c)(3) of the California Public Resources Code, Adopt the Mitigated Negative Declaration (MND) as reconsidered for the above referenced project; APPLICANT: AT&T Representative: M. Scott Green, Eukon Group/Black & Veatch Corp. Recommended Actions: 1. Approve a Specific Plan Exception to permit the location of a wireless telecommunication facility within the boundaries of the Mulholland Scenic Parkway Specific Plan (Ordinance No. 167,943); 2. Approve a Conditional Use to allow wireless telecommunication facilities, including radio and television transmitters citywide, other than wireless antennas and associated equipment cabinets on the rooftops of buildings in the C and M Zones, including geographic specific plan areas, which conform to the provisions of Section 12.21 A.21. of the Code; and 3. Approve a Project Permit Compliance with the Ventura–Cahuenga Boulevard for the proposed project. 4. Adopt Mitigated Negative Declaration No. ENV-2006-7525-MND-REC2 and associated Findings. 5. Adopt the attached Findings. 6. Advise the applicant that pursuant to State Fish and Game Code Section 711.4, a Fish and Game Fee and / or Certificate of Fee Exemption is now required to be submitted to the County Clerk prior to or concurrent with the Environmental Notice of Determination (NOD) filing. PUBLIC COMMENT PERIOD The Area Planning Commission shall provide an opportunity in open meetings for the public to address it, on items of interest to the public that are within the subject matter jurisdiction of the Area Planning Commission. (This requirement is in addition to any other hearing required or imposed by law.) Persons making requests are encouraged to do so in writing and should submit 10 copies to the Area Planning Commission for its consideration. Persons wishing to speak must submit a speaker’s request form prior to the commencement of the public comment period. Individual testimony within the public comment period shall be limited to up to five (5) minutes per person and up to ten (10) minutes per subject.
