Pursuant to the Commission’s general operating procedures, the Commission at times must necessarily limit the speaking times of those presenting testimony on either side of an issue that is designated as a public hearing item. All requests to address the Commission on public hearing items must be submitted prior to the Commission’s consideration on the item. TIME SEGMENTS noted * herein are approximate. APCNV-2012-3551-ZC-CU CEQA: ENV-2012-3550-MND Council District: 12 Corrected Expiration Date: 06/18/13 Plan: Northridge Appeal Status: Further appealable to City Council by applicant if Zone Change is disapproved CONTINUED FROM MAY 2, 2013 PUBLIC HEARING HELD ON APRIL 5, 2003 Location: 9000- 9034 North Reseda Boulevard Proposed Project: The demolition of two (2) existing two-story commercial buildings, and the construction of two (2) new single-story commercial buildings with retail and drive-through restaurant uses, totaling 7,800 sq-ft in floor area and measuring a maximum of 32-ft in height. The project also includes the second-floor demolition and a facade remodel of a third existing two-story 5,000 sq-ft commercial building. A total of 100 surface parking spaces will be provided on the 1.63-acre site. Requested Action: 1. Pursuant to Section 21082.1(c)(3) of the California Public Resources Code, Adopt the Mitigated Negative Declaration (ENV-2012-3550-MND) for the above referenced project; 2. Pursuant to Section 12.32 of the Municipal Code, a Zone Change from C2-1VL (Commercial Zone) and P-1VL (Parking Zone), to (T)(Q)C2-1VL (Commercial Zone); and North Valley Area -2- May 16, 2013 Planning Commission 3. Pursuant to Section 12.24.W.17 of the Municipal Code, a Conditional Use for the operation of two drive-through fast-food establishments in the C Zone located on a lot adjacent to a residential zone and use. APPLICANT: Rich Development Enterprises, LLC Representative: Tab Johnson Recommended Action: 1. Adopt the Mitigated Negative Declaration, ENV-2012-3550-MND. 2. Approve and recommend that the City Council approve the Zone Change from C2-1VL and P-1VL to (T)(Q)C2-1VL for the subject property, with the Conditions of Approval. 3. Approve a Conditional Use for the operation of two drive-through fast-food establishments in the C Zone located on a lot adjacent to a residential zone and use. 4. Adopt the Findings. 5. Advise the applicant that, pursuant to California State Public Resources Code Section 21081.6, the City shall monitor or require evidence that mitigation conditions are implemented and maintained throughout the life of the project and the City may require any necessary fees to cover the cost of such monitoring. Persons making requests are encouraged to do so in writing and should submit 10 copies to the area planning commission for its consideration. Individual testimony within the public comment period shall be limited to five (5) minutes per person and up to ten (10) minutes per subject.
