The meeting was called to order by Commissioner J. Richard Leyner at 4:30 p.m. Commissioners present: Commissioners Gonzalez, Harootoonian, Padilla and Leyner Commissioner absent: Commissioner Vo-Ramirez 1. DEPARTMENTAL REPORT Nothing to report at this time. 2. COMMISSION BUSINESS A. Advanced Calendar- There will be an Area Planning Commission Retreat on June 19,2014. B. Commission Requests- No requests at this time. C. APCNV-2013-3600-ZC CEQA: ENV-2013-3601-MND Council District: 7 Expiration Date: 6/5/14 Plan: Mission Hills-Panorama City- North Hills Appeal Status: Appealable by the applicant to the City Council if disapproved in whole or in part. PUBLIC HEARING HELD ON MARCH 18, 2014 Location: 8935 Orion Avenue Proposed Project: The proposed project is a 33-unit, 3-story, 45 feet in height apartment building, with 52 parking spaces on an existing 19,963 square-foot site in a proposed R3-1 Zone. The project includes a 35% density bonus to provide 29 market rate units, 3 units for Very Low Income households and one manager's unit. The project also includes a zone change request from RA-1 to R3-1 to allow the multi-family development. Two existing single family residences will be demolished . Requested Action: 1) Pursuant to L.A.M.C. Section 12.32-F, a zone change request from the RA-1 Zone to R3-1 on a 19,963 square-foot site for a 33-unit, 3-story, 45 feet in height apartment building, with 52 parking spaces, including a 35% density bonus to provide 29 market rate units, 3 units for Very Low Income households and one manager's unit. 2) Pursuant to Section 21082.1(c)(3) of the California Public resources Code, adopt the Mitigated Negative Declaration (MND) for the above referenced project. APPLICANT: John R. Donaldson, JV Orion LLC Representative: Ken Stockton, Ken Stockton Architects Recommended Action: 1) Disapprove the Zone Change request from RA-1 to R3-1. 2) Approve and recommend that the City Council adopt the Zone Change from RA-1 to (T)(Q)R3-1. 3) Adopt the findings. 4) Adopt the Mitigated Negative Declaration No. ENV-2013-3601-MND. 5) Advise the applicant that, pursuant to California State Public Resources Code Section 21081.6, the City shall monitor or require evidence that mitigation conditions are implemented and maintained throughout the life of the project and the City may require any necessary fees to cover the cost of such monitoring . 6) Advise the applicant that pursuant to State Fish and Game Code Section 711.4, Fish and Game Fee is now required to be submitted to the County Clerk prior to or concurrent with the Environmental Notice of Determination (NOD) Filing. The applicant's representative spoke. The Commission asked questions. One speaker who is a Community Liaison for non-profit organization of North Valley spoke against the project and expressed her concern of the proximity of the project to the freeway for environment and the safety of the kids . The Commission asked the applicant's representative questions. The Commission made a motion . MOTION : To Disapprove the Zone Change request from RA-1 to R3-1. Approve and recommend that the City Council adopt the Zone Change from RA-1 to (T)(Q)R3-1 ., Adopt the conditions and findings with amendment to read Condition No. 3 of the Entitlement Conditions & Condition No. 3 of the Conditions of Approval both state that the FAR is 3:1. Adopt the Mitigated Negative Declaration No. ENV-2013-3601-MND. Advise the applicant that, pursuant to California State Public Resources Code Section 21081 .6, the City shall monitor or require evidence that mitigation conditions are implemented and maintained throughout the life of the project and the City may require any necessary fees to cover the cost of such monitoring . Pursuant to the Commission’s general operating procedures, the Commission at times must necessarily limit the speaking times of those presenting testimony on either side of an issue that is designated as a public hearing item. In all instances, however, equal time is allowed for presentation of pros and cons of matters to be acted upon. PUBLIC COMMENT PERIOD The Area Planning Commission shall provide an opportunity in open meetings for the public to address it, on items of interest to the public that are within the subject matter jurisdiction of the Area Planning Commission. (This requirement is in addition to any other hearing required or imposed by law.) Persons making requests are encouraged to do so in writing and should submit 10 copies to the Area Planning Commission for its consideration. Persons wishing to speak must submit a speaker’s request form prior to the commencement of the public comment period. Individual testimony within the public comment period shall be limited to five (5) minutes per person and up to ten (10) minutes per subject.
