Williams, Commission Executive Assistant II POLICY FOR DESIGNATED PUBLIC HEARING ITEM No. Pursuant to the Commission=s general operating procedures, the Commission at times must necessarily limit the speaking times of those presenting testimony on either side of an issue that is designated as a public hearing item. In all instances, however, equal time is allowed for presentation of pros and cons of matters to be acted upon. All requests to address the Commission on public hearing items must be submitted prior to the Commission=s consideration of the item. EVERY PERSON WISHING TO ADDRESS THE COMMISSION MUST COMPLETE A SPEAKER=S REQUEST FORM AND SUBMIT IT TO THE COMMISSION EXECUTIVE ASSISTANT STAFF. To ensure that the Commission has ample opportunity to review written materials, all concerned parties who wish to submit written materials on agendized items should submit them to the Commission Office, 200 North Spring Street, Room 272, Los Angeles, 90012, 10 days prior to the meeting at which the item is to be heard in order to meet the mailing deadline. ARAPAHOE STREET, 1315 W. 20TH STREET PROJECT DESCRIPTION: The demolition of an existing 750 square-foot fast-food restaurant, a 18,340 square-foot and 17,022 square-foot industrial buildings, and the construction of an approximately 16,600 square-foot, single-story drug store with 24-hour operations, daily, the sale of a full line of alcoholic beverages for off-site consumption, and a total of 77 parking spaces in a surface parking lot. Applicant: CVS Caremark Representative: Margaret Taylor, Apex LA REQUESTED ACTION: 1. Pursuant to Section 12.32-F of the Los Angeles Municipal Code (LAMC), a Zone Change from P-1 to CM-1. 2. Pursuant to Section 12.27 of the LAMC, a Variance to permit a 65 foot-in-height pole sign in lieu of the maximum 45 feet in-height allowed in the C2-1 and P-1 Zones. 3. Pursuant to Section 12.24-W,1 of the LAMC, a Conditional Use to permit the sale of a full line of alcoholic beverages for off-site consumption in conjunction with the proposed drug store. 4. Pursuant to Section 12.24-W,27 of the LAMC, a Conditional Use to permit 24-hour operation, daily, in lieu of hours of operation otherwise limited to 7 a.m. to 11 p.m., and deviations from Section 12.22-A,23(a) for a Commercial Corner Development as follows: a. Less than fifty (50) percent transparent windows within the exterior walls and doors that front adjacent streets. b. A 65 feet in-height pole sign. Pursuant to Section 21082.1(c)(3) of the California Public Resources Code, adopt the Mitigated Negative Declaration No. ENV-2015-429-MND for the above referenced project. 6. Pursuant to Section 21081.6 of the California Public Resources Code, adopt the Mitigation Monitoring Plan for the above referenced project. RECOMMENDED ACTION: 1. Disapprove the Zone Change as requested from P-1 to CM-1. 2. Approve and recommend that the City Council approve a Zone Change from CM-1, P-1, and (Q)CM-1 to (T)(Q)CM-1, and from (Q)P-1VL to (T)(Q)C2-1VL, subject to the Conditions. 3. Dismiss without prejudice a Zone Variance to permit a 65-foot high pole sign in lieu of the maximum 45 feet height allowed in the CM-1 and P-1 Zones, as it was filed erroneously. 4. Approve a Conditional Use to permit 24-hour operation, daily, in lieu of hours of operation otherwise limited to 7 a.m. to 11 p.m. within a Commercial Corner Development, subject to the Conditions. 6. Approve a Conditional Use to permit less than fifty (50) percent transparency of windows within the exterior walls and doors that front adjacent streets within a Commercial Corner Development, subject to the Conditions. 7. PUBLIC COMMENT PERIOD The Commission shall provide an opportunity in open meetings for the public to address it, for a cumulative total of up to thirty (30) minutes, on items of interest to the public that are within the subject matter jurisdiction of the Commission.
