The meeting was called to order at 4:45 p.m. by Commissioner President Gail Willis with Commissioners Anderson, Orozco and Stern. Commissioner Bates was not in attendance. Also present were, Michelle Singh, City Planner; Ernesto Velasquez, City Attorney and Renee Glasco, Commissioner Executive Assistant. ___________________________________ ITEM NO. 1 DEPARTMENTAL REPORT Michelle Singh, City Planner, reported that the Department held and open house for the South and Southeast Community Plan at the Bret Harte Middle School. A second meeting will be held at Los Angeles Trade Tech School for public hearing. ___________________________________ ITEM NO. 2 COMMISSION BUSINESS A. Advance Calendar: There were no changes to the advance calendar by the commission. B. Commission Requests: There were no requests asked by the commission. ___________________________________ ITEM NO. 3 NEIGHBORHOOD COUNCIL There was no one present from the Neighborhood Councils present. ___________________________________ Meeting Minutes December 6, 2016 South Los Angeles Area Planning Commission ITEM NO. 4 APCS-2016-1560-VZC-VCU-CCUP Council District: 8 – Harris-Dawson CEQA: ENV-2016-1561-CE Plan Area South Los Angeles PROJECT SITE: 1691 West Adams Boulevard MOTION Commissioner Anderson put forth the actions below in conjunction with the approval of the following project: A demolition of an automotive fueling station with a 1,862-square-foot building and 8 vehicle fueling stations and the construction of a 2,500-square-foot building with 10 vehicle fueling stations with the continued use of an existing 30-foot high pole sign. 1. Determine base on the independent judgment of the decision maker that pursuant to Section 21084 of the California Public Resources Code and on the whole of the administrative record, the Project is exempt from CEQA pursuant to CEQA Guideline 15303 (New Construction of Small Structure), 15331 (Historic Resource), and 15332 (In- Fill Development) and there is no substantial evidence demonstrating that an exception to a categorical exemption pursuant to CEQA Guidelines, Section 15300.2 applies. 2. Approve and Recommend that the City Council Adopt the Vesting Zone Change to change the zone from C1-1VL-HPOZ to (T)[Q]C2-1VL-HPOZ. 3. Deny the Vesting Conditional Use permit pursuant to Section 12.24.T. 4. Grant a Conditional Use in part to allow deviations from the commercial corner and Deny continued use of an existing 30-foot high pole sign. 5. Regulations to permit a reduction in landscape requirements to 0 feet in lieu of 5 feet along Adams Boulevard, pursuant to Section 12.24.W.4 and approve a store operating 24-hours a day, 6. Approve the Certificate of Compatibility for the demolition and replacement of a non-contributing structure in the Adams-Normandie HPOZ. 7. Adopt the Conditions of Approval as modified. 8. Adopt the attached amended Findings. In all instances, however, equal time is allowed for presentation of pros and cons of matters to be acted upon. All requests to address the Commission on public hearing items must be submitted prior to the Commission’s consideration on the item. EVERY PERSON WISHING TO ADDRESS THE COMMISSION MUST COMPLETE A SPEAKER’S REQUEST FORM AT THE MEETING AND SUBMIT IT TO THE COMMISSION EXECUTIVE ASSISTANT. Day of hearing submissions (10 copies must be provided) are limited to 2 pages plus accompanying photographs, posters, and PowerPoint presentations of 5 minutes or less. Submissions that do not comply with these rules will be stamped “File Copy. Non-Complying Submission.” Non-complying submissions will be placed into the official case file, but they will not be delivered to or considered by the APC, and will not be included in the official administrative record for the item at issue. To ensure that the Commission has ample opportunity to review written materials, members of the public who wish to submit written materials on agenda items should submit them to the Commission office, 200 North Spring Street, Room 532, Los Angeles, CA 90012, at least 10 days prior to the meeting at which the item is to be heard in order to meet the mailing deadline. Note: Materials received after the mailing deadline will be placed in the official case file. The Commission may RECONSIDER and alter its action taken on items listed herein at any time during this meeting or during the next regular meeting, in accordance with the Commission Policies and Procedures and provided that the Commission retains jurisdiction over the case. Pursuant to Section 21084 of the California Public Resources Code, and Article 19, Sections 15303 (New Construction of Small Structures), 15331 (Historic Resource), and 15332 (In-Fill Development) of the CEQA Guidelines; and Article III, Section 2 (Replacement or Reconstruction), Class 2 (Replacement of Commercial Structure) of the City CEQA Guidelines, a Categorical Exemption has been issued for the project; 2. Pursuant to Section 12.32 of the Los Angeles Municipal Code (LAMC), a Vesting Zone Change from C1-1VL-HPOZ to (T)[Q]C2-1VL-HPOZ for the re-establishment of an automotive fueling station; 3. Pursuant to LAMC Section 12.24.T a Vesting Conditional Use to allow deviations from Commercial Corner Development regulations including a store operating 24 hours a day, a reduction in landscape requirements, and the continued use of an existing 30-foot high pole sign; and 4. Pursuant to LAMC Section 12.20.3.L, a Certificate of Compatibility, for demolition and replacement of a non-contributing structure 5. PUBLIC COMMENT PERIOD The Area Planning Commission shall provide an opportunity in open meetings for the public to address on items of interest to the public that are within the subject matter jurisdiction of the Area Planning Commission. (This requirement is in addition to any other hearing required or imposed by law.) Persons making requests are encouraged to do so in writing and should submit 10 copies to the Area Planning Commission for its consideration. Persons wishing to speak must submit a speaker’s request form prior to the commencement of the public comment period. Individual testimony within the public comment period shall be limited to five (5) minutes per person and up to ten (10) minutes per subject at the discretion of the Commission President.
