In all instances, however, equal time is allowed for presentation of pros and cons of matters to be acted upon. All requests to address the Commission on public hearing items must be submitted prior to the Commission’s consideration of the item. EVERY PERSON WISHING TO ADDRESS THE COMMISSION MUST COMPLETE A SPEAKER’S REQUEST FORM AND SUBMIT IT TO THE COMMISSION EXECUTIVE ASSISTANT STAFF. To ensure that the Commission has ample opportunity to review written materials, all concerned parties who wish to submit written materials on agendized items should submit them to the Commission Office, 200 North Spring Street, Room 532, Los Angeles, 90012, prior to the meeting at which the item is to be heard in order to meet the mailing deadline. The time in which a party may seek judicial review of this determination is governed by California Code of Civil Procedure Section 1094.6. Under that provision, a petitioner may seek judicial review of any decision of the City pursuant to California Code of Civil Procedure Section 1094.5, only if the petition for writ of mandate pursuant to that section is filed no later than the 90th day following the date on which the City’s decision became final. PUBLIC COMMENT PERIOD The Commission shall provide an opportunity in open meetings for the public to address it, for a cumulative total of up to thirty (30) minutes, on items of interest to the public that are within the subject matter jurisdiction of the Commission. (This requirement is in addition to any other hearing required or imposed by law.) PERSONS WISHING TO SPEAK MUST SUBMIT A SPEAKER’S REQUEST FORM. Appeal Status: Appealable to Council Plan: Sunland-Tujunga-Lakeview Terrace- Shadow Hills-East La Tuna Canyon Expiration Date: 01-22-04 Public Hearing completed November 21, 2003. Pursuant to Section 12.24 U 19 (d) of the Municipal Code, a CONDITIONAL USE PLAN APPROVAL, to permit the construction of a water treatment ammoniation station, which will convert the disinfection of the water supply distributed by Green Verdugo Pumping Station from chlorine to chloramines in order to reduce concentrations of total trihalomethanes and ensure compliance with recently established standards by the California Department of Health Services; and Pursuant to Section 12.27 of the Municipal Code, a ZONE VARIANCE, from Section 12.21 A 4 (d) of the Code, to permit 0 parking spaces in lieu of the minimum 3 spaces required. The proposed project is for the construction, use and maintenance of a 22-foot by 60-foot reinforced concrete building, one-story, 24-feet in height, to house electrical and analytical equipment, metering pumps, two 3,200-gallon aqua ammonia storage tanks and a restroom, with appurtenant facilities including underground pipelines and substructures within the reservoir property associated with the station operation. The facility will be unmanned and will utilize 2 existing parking spaces at the adjacent chlorination station building. An accessory retaining wall varying from 5 to 18 feet in height will also be constructed. The 105 acre site includes a chlorination station, covered reservoir, Department of Water and Power system facility, and a Fire Department heliport. STAFF RECOMMENDS APPROVAL SUBJECT TO CONDITIONS. Public hearing completed December 19, 2003. ZONE CHANGE, from RA-1 (Suburban Zone) and (T)(Q) R3-1 (Multiple Dwelling Zone) to (T)(Q)R3-1 (Multiple Dwelling Zone), and SITE PLAN REVIEW FINDINGS, pursuant to Section 16.05 of the Municipal Code, for projects which result in an increase of 50 or more dwellings. The proposed project is for the construction, use and maintenance of 56 apartment units, having a maximum height of 36 feet and 2 stories, with a total of 126 garage parking spaces, on a 44,485 square foot lot. Pursuant to Section 12.32 B of the Municipal Code; a. ZONE CHANGE from R1-1 to RD1.5-1, for the portion of the project site encompassing the area starting from the northerly property line to a southward depth of 307.99 feet and for a width of 103.13 feet, (Northern portion of lot 224 (ARB. 15), Tract No. 1000); and CITY PLANNING COMMISSION 4 JANUARY 22, 2004 b. ZONE CHANGE from R1-1 and R3-1 to R3-1, for the portion of the project site encompassing the area starting at the southerly property line to a northward depth of 170-feet and a width of 103.13 feet (Southern portion of lot 224 (ARB. 15), Tract No. 1000); and Pursuant to Section 12.24 U 4 of the Municipal Code, a CONDITIONAL USE for child care facilities in the requested RD1.5 Zone; Applicant has withdrawn this request.; and Pursuant to Section 12.27 of the Municipal Code, a Variance from Section 12.21 C 5 (h) to allow vehicular access from a more restrictive to a less restrictive zone; and Pursuant to Section 12.28 of the Municipal Code, a Zoning Administrator's Adjustment from the following: a. The proposed project is the construction, use and maintenance of 52 affordable apartment units, having a maximum height of 53 feet, 6 inches and containing 2 to 4 stories, and a child care facility to accommodate up to 50 children, ages infant to 5 years, operating between the hours of 6:00 a.m. to 6:00 p.m., Monday through Friday, with a total of 52 subterranean parking spaces (5 for child care and 52 for tenants of the building).
