Pursuant to the Commission=s general operating procedures, the Commission at times must necessarily limit the speaking times of those presenting testimony on either side of an issue that is designated as a public hearing item. In all instances, however, equal time is allowed for presentation of pros and cons of matters to be acted upon. All requests to address the Commission on public hearing items must be submitted prior to the Commission=s consideration of the item. EVERY PERSON WISHING TO ADDRESS THE COMMISSION MUST COMPLETE A SPEAKER=S REQUEST FORM AND SUBMIT IT TO THE COMMISSION STAFF. The Commission has adopted rules regarding written submissions to ensure that it has reasonable and appropriate opportunity to review your materials. The mailing and email addresses, deadlines, page limits, and required numbers of copies for your advance submissions may be found at www.planning.lacity.org under “Forms and Instructions”. Day of hearing submissions (15 copies must be provided) are limited to 2 pages plus accompanying photographs, posters, and PowerPoint presentations of 5 minutes or less. Non-complying materials will NOT be distributed to the Commission. The Commission may ADJOURN FOR LUNCH at approximately 12:00 Noon. Any cases not acted upon during the morning session will be considered after lunch. TIME SEGMENTS noted * herein are approximate. Some items may be delayed due to length of discussion of previous items. The Commission may RECONSIDER and alter its action taken on items listed herein at any time during this meeting or during the next regular meeting, in accordance with the Commission Policies and Procedures and provided that the Commission retains jurisdiction over the case. In the case of a Commission meeting cancellation, all items shall be continued to the next regular meeting date or beyond, as long as the continuance is within the legal time limits of the case or cases. PUBLIC COMMENT PERIOD The Commission shall provide an opportunity in open meetings for the public to address it, for a cumulative total of up to thirty (30) minutes, on items of interest to the public that are within the subject matter jurisdiction of the Commission. (This requirement is in addition to any other hearing required or imposed by law.) PERSONS WISHING TO SPEAK MUST SUBMIT A SPEAKER=S REQUEST FORM. ALL REQUESTS TO ADDRESS THE COMMISSION ON NON-PUBLIC HEARING ITEMS AND ITEMS OF INTEREST TO THE PUBLIC THAT ARE WITHIN THE JURISDICTION OF THE COMMISSION MUST BE SUBMITTED PRIOR TO THE COMMENCEMENT OF THE PUBLIC COMMENT PERIOD. CPC-2010-3300-CU-ZAA-DRB-SPP Council District: 11 – Rosendahl CEQA: ENV-2010-2647-MND Expiration Date: 6-28-12 Plan Area: Brentwood-Pacific Palisades Appeal Status: Appealable to City Council PUBLIC HEARING – Completed on November 4, 2011 Location: 16100 W. MULHOLLAND DRIVE Legally described as lot A & B/A, PM 1938/PM4816 Proposed Project: Removal of 15,914 square feet of modular buildings used for a pre-school and construction of an athletic field, including sports courts, playgrounds, a 15-foot high, 2,000 square foot physical education building, related ancillary uses, and 26 surface parking spaces (collectively, the “Athletic Facilities”), on a 122,687 square foot parcel to for exclusive use of an existing private school (The Mirman School for Gifted Children) established by Case No. ZA-1992-858-CUZ. Existing pole lights, internal roadway and parking area will continue to be utilized. The field would be used for recreational purposes, physical education classes and extracurricular games. Proposed hours of operation are Monday through Friday 7:30 A.M. to 6 P.M., with minimum use on Saturday and Sundays including a maximum of 3 days per month between 9 A.M. to 6 P.M. There will be no loudspeakers or public address systems installed or operated on any open portion of the premises. Grading will result in a total of 640 cubic yards of export. No physical or operational changes are proposed for the existing entitled private school having a maximum enrollment of 330 students from grades K to 8th. The total parcel size is 237,846 square feet. Requested Actions: 1. Pursuant to Section 21082.1(c)(3) of the California Public Resources Code, Adopt the Mitigated Negative Declaration (ENV-2010-2647-MND) for the above referenced project. 2. Pursuant to Section 12.24 U.24 of the Municipal Code, a Conditional Use to permit the continued operation of a private elementary school with the addition of an athletic field, including sports courts, playgrounds, physical education building, and 26 surface parking spaces, in the RE40 Zone. Note: Previous conditions of approval under ZA 1992-0858-CUZ were reviewed, incorporated, and updated where necessary. 3. Pursuant to Section 12.21 C.1 (g) of the Municipal Code, an Adjustment to allow an eight-foot high fence in the required front yard, in lieu of three and one-half feet maximum otherwise permitted pursuant to Section 12.22 C.20 (f) 2 and an 8-foot high chain link fence in the required side yards, in lieu of six feet maximum otherwise permitted pursuant to Section 12.22 C.20 (f) 3. 4. Pursuant to Section 11 of the Mulholland Scenic Parkway Specific Plan and pursuant to Section 11.5.7C of the Municipal Code, a Design Review and Project Permit Compliance for the development of athletic facilities and construction of a 2,000 square feet physical education building. Applicant: David Royal, Mirman School Representative: Kevin K. McDonnell, Esq. Recommended Actions: 1. Approve the Conditional Use to establish an athletic field in connection with a private middle school in the RE40-1-H Zone, subject to the attached conditions of approval; 2. Approve the requested Adjustment to permit an eight-foot high fence within the front yard, in lieu of three and one-half feet maximum otherwise permitted and an 8-foot high fence in the westerly side CITY PLANNING COMMISSION 3 JUNE 28, 2012 yard in-lieu of the maximum 6-foot height otherwise permitted (As modified by the applicant). (The10-foot high fence in rear yard, receive and file, withdrawn by the applicant); 3. Approve the Design Review and Project Permit Compliance for the development of new athletic facilities and construction of a 2,000 square-foot building; 4. Adopt Attached Findings; 5. Adopt the Mitigated Negative Declaration as provided under case number ENV-2010-2647-MND pursuant to the California Environmental Quality Act. 6. Advise the applicant that pursuant to State Fish and Game Code Section 711.4, a Fish and Game Fee and/or Certificate of Fee Exemption may be required to be submitted to the County Clerk prior to or concurrent with the Environmental Notice of Determination (“NOD”) filing.
