Pursuant to the Commission=s general operating procedures, the Commission at times must necessarily limit the speaking times of those presenting testimony on either side of an issue that is designated as a public hearing item. In all instances, however, equal time is allowed for presentation of pros and cons of matters to be acted upon. All requests to address the Commission on public hearing items must be submitted prior to the Commission=s consideration of the item. EVERY PERSON WISHING TO ADDRESS THE COMMISSION MUST COMPLETE A SPEAKER=S REQUEST FORM AND SUBMIT IT TO THE COMMISSION STAFF. Written submissions are governed by Rule 10 of the Los Angeles City Planning Commission Rules and Operating Procedures, a copy of which is posted online at http://cityplanning.lacity.org/Forms Procedures/CpcPolicy.pdf. PENDLETON STREET 9143 - 9189 DE GARMO AVENUE Proposed Project: The expansion of Community Recycling and Resource Recovery, Inc.’s solid waste transfer station and recycling facility operations, on a 12.29-acre site, and physical site improvements, identified as Alternative 3: Enclosure Alternative (Preferred Project) in the Project’s Revised Final Environmental Impact Report, consisting of: a 190,950 square-foot, one-story warehouse structure to fully enclose the existing back yard organics processing operations; a 62,550 square-foot, one-story warehouse structure to fully enclose the existing front yard tipping floor and municipal solid waste transfer station; and the modification of an existing 7,800 square-foot canopy structure to partially enclose the existing front yard, baled recycling material storage area. The maximum height of the proposed structures would be 65 feet. The project would provide 197 on-site parking spaces, exceeding the requirement of the Los Angeles Municipal Code (LAMC) for 139 parking spaces. The expansion of Community Recycling and Resource Recovery, Inc.’s solid waste transfer station and recycling facility operations, on a 12.29-acre site, and physical site improvements, consisting of: a CITY PLANNING COMMISSION 3 JULY 24, 2014  107,000 square-foot, one-story structure, varying in height from 48 feet to 67 feet, 5 inches, to partially enclose existing back yard organics processing operations, as required by a Los Angeles County Superior Court Stipulated Final Judgment; two (2) roof canopy structures open on three sides; and the installation of a 25-foot-high, metal panel fence around the perimeter of the site. The structure would partially enclose the current supermarket produce trim and cull receiving operation, processed organics stockpile, and the wood receiving, processing and ground materials stockpile. The project would maintain the existing 40 on-site parking spaces (75 spaces are required by the LAMC). (Under a separate permitting process with the City’s Local Enforcement Agency (Department of Building and Safety) and the State of California Department of Resources Recycling and Recovery (CalRecycle), the applicant seeks to revise the existing Solid Waste Facility Permit by increasing the tonnage of material received from the permitted 1,700 tons per day (an additional 2,900 tons per day are currently unpermitted but allowed under an Interim Operating Agreement, for a current total of 4,600 tons per day) to 6,700 tons of permitted material received per day for both the solid waste transfer station and the recycling facility.) Requested Actions: 1. Pursuant to Section 21082.1(c)(3) of the California Public Resources Code, certification of the Revised Final Environmental Impact Report No. ENV-2006-6373-EIR, and adoption of the proposed Mitigation Monitoring and Reporting Program and the required findings. 2. Pursuant to Section 12.24 U.22(c) of the LAMC, a Conditional Use Permit for the operation of a Recycling Materials Processing Facility in the M3 Zone which is not in compliance with 4 of the 16 conditions set forth in Section 12.21 A.18(f) of the LAMC, specifically: (1) located at least 1,000 feet from an M1 zone; (3) Recyclable Materials collected and processed on the site shall be limited to paper, cardboard, glass, metal, plastic and other items that are deemed appropriate by the Department of Building and Safety, Bureau of Sanitation and the Fire Department; (9) provide adequate parking, as required in Section 12.19 A.4(b)(4) of the LAMC; and (14) the facility shall be surrounded by a 6-foot-high, concrete block wall and a 5-foot landscaped buffer, approved by the City Planning Department, adjoining all street frontages. 3. Pursuant to Section 12.27 of the LAMC, a Zone Variance to permit 40 parking spaces in lieu of the required 75 parking spaces. 4. Pursuant to Section 16.05 of the LAMC, Site Plan Review approval for a project having more than 50,000 square feet of non-residential floor area. Applicant: Community Recycling and Resource Recovery, Inc. Representative: Fred Gaines Recommended Actions: 1. Disapprove the requested entitlements for the As-Filed proposed Project. 2. Approve a Conditional Use for the Preferred Project to permit a Recycling Materials Processing Facility in the M3 Zone when the facility is not in compliance with 3 of the 16 conditions set forth in Section 12.21 A 18 (e) of the LAMC, specifically Nos.: (1) located at least 1,000 feet from an M1 zone; (3) Recyclable Materials collected and processed on the site shall be limited to paper, cardboard, glass, metal, plastic and other items that are deemed appropriate by the Department of Building and Safety, Bureau of Sanitation and the Fire Department; and (14) the facility shall be surrounded by a 6-foot high, concrete block wall and a 5-foot landscaped buffer, approved by the City Planning Department, adjoining all street frontages, subject to the attached conditions of approval. 3. Disapprove as unnecessary a Zone Variance to permit 40 parking spaces in lieu of the required 75 parking spaces; as the Preferred Project will meet LAMC-required on-site parking requirements. 4. Approve Site Plan Review for the Preferred Project having more than 50,000 square feet of non- residential floor area, subject to the Conditions of Approval. Certify Revised Final Environmental Impact Report No. ENV-2006-6373-EIR as the environmental clearance for the project, and Adopt the proposed Mitigation Monitoring and Reporting Program and the required findings. 6. Advise the applicant that, pursuant to California State Public Resources Code Section 21081.6, the City shall monitor or require evidence that mitigation conditions are implemented and maintained throughout the life of the project and the City may require any necessary fees to cover the cost of such monitoring.
