ADJOURNMENT APPEAL RIGHTS AND FILING PROCEDURES Any interested person adversely affected with an act, decision, or determination of the Planning Commission may appeal such act, decision, or determination by filing written notice thereof with the Community and Economic Development Director, or with the Clerk of the City of Los Banos (in the case of an appeal of a Planning Commission decision), not later than 5:00 p.m. ten (10) days after the day on which the act, decision, or determination being appealed was made. If such date falls on a weekend or City holiday, then the deadline shall be extended until 5:00 p.m. the next business day. The first day of the appeal period is the day following the action. A filing fee set by resolution of the City Council shall accompany the notice of appeal (Los Banos Municipal Code Section 9-3.2330). If the subdivider or other affected property owner is dissatisfied with any action of the Commission with respect to the tentative map or the nature and extent of improvements recommended, he or she may, within fifteen (15) days after such action, appeal to the Council for a public hearing thereon. The Council shall hear the appeal, upon notice to the subdivider and the Commission, unless the subdivider consents to a continuance at its next succeeding regular meeting. At the hearing the Council shall hear such testimony as the subdivider or Commission, or their respective witnesses or other competent persons, may present (Los Banos Municipal Code Section 9-2.807). Appeals from the action of the Commission by the applicant or any affected property owner shall be made to the Council in writing within five (5) days after the date of such action of the Board. The Council shall render its decision on any appeal within thirty (30) days after the filing thereof. If the Council fails to act within the prescribed thirty (30) days, the action of the Commission shall be deemed final unless such time period is extended by the mutual consent of the subdivider and the Council (Los Banos Municipal Code Section 9-2.1008). The notice of appeal shall state the act, decision, or determination which is being appealed, the identity of the appellant and his or her interest in the matter, and shall set forth in concise statement the reasons which, in the opinion of the appellant, render the decision made unjustified or inappropriate.
