CITY OF LOS BANOS CITY COUNCIL MEETING MINUTES SEPTEMBER 2, 2015 ACTION MINUTES – These minutes are prepared to depict action taken for agenda items presented to the City Council. CALL TO ORDER: Mayor Villalta called the City Council Meeting to order at the hour of 7:01 PM. PLEDGE OF ALLEGIANCE: Police Commander Reyna led the pledge of allegiance. ROLL CALL – MEMBERS OF THE CITY COUNCIL PRESENT: Council Members Tom Faria, Deborah Lewis, Scott Silveira, Elizabeth Stonegrove, Mayor Michael Villalta; Absent: None. STAFF MEMBERS PRESENT: City Attorney Vaughn, City Clerk/Human Resources Director Mallonee, Police Commander Reyna, City Manager Carrigan, Finance Director Williams, City Treasurer/Accountant I Brazil, Fire Chief Marrison, Senior Planner Elms, Public Works Director/City Engineer Fachin and Information Technology Director Spalding. CONSIDERATION OF APPROVAL OF AGENDA: Motion by Faria, seconded by Lewis to approve the City Council Meeting agenda as submitted. The motion carried by the affirmative action of all City Council Members present. PRESENTATION – CERTIFICATE OF APPRECIATION TO MARCO BOFFA. Mayor Villalta presented the certificate to Marco Boffa for his many good deeds throughout our community and stated how he admires his willingness to help others. PRESENTATION – PROCLAMATION RECOGNIZING JAMES SAVAGE. Mayor Villalta presented the proclamation to James Savage for his extraordinary achievement in placing first place in his age division in the 35th Annual Alcatraz “Escape from the Rock” Duathlon and commended him for his hard work and dedication. PUBLIC FORUM: MEMBERS OF THE PUBLIC MAY ADDRESS THE CITY COUNCIL MEMBERS ON ANY ITEM OF PUBLIC INTEREST THAT IS WITHIN THE JURISDICTION OF THE CITY; INCLUDES AGENDA AND NON-AGENDA ITEMS. NO ACTION WILL BE TAKEN ON NON-AGENDA ITEMS. SPEAKERS ARE LIMITED TO A FIVE (5) MINUTE PRESENTATION. DETAILED GUIDELINES ARE POSTED ON THE COUNCIL CHAMBER INFORMATIONAL TABLE. BERTHA FARIA, Los Banos Chamber of Commerce, spoke regarding the new Chamber members they have welcomed and the upcoming ribbon cutting and mixers for September, the Aqua Center Ground Breaking this month, the Downtown Fall Street Faire, how they are getting ready for Tomato Festival on October 3, 2015, Christmas Parade theme this year is Sesame Street; ED AMARAL, spoke regarding the Knights of Columbus Soccer Challenge being held on September 12, 2015 at Olivera Soccer Park and congratulated Marco Boffa on his recognition; ERIK LIM0N, Republic Services and resident of Los Banos, spoke regarding the Annual Fall Clean Up being held on September 26, 2015, how trash pickup will be delayed a day next week because of the Labor Day Holiday, spoke regarding the Annual Movie Night on September 12, 2015 at the end of the Fire Department’s event; TIM MARRISON, Los Banos Fire Department, spoke regarding the September 12, 2015 Fire Department Event to promote volunteerism for many groups, with a focus on the Cancer Awareness Campaign and the $15 shirts available as a fundraiser; CASSANDRA HELMRICK, Los Banos resident and VFW representative, spoke regarding the Veterans Parade being held on November 7, 2015 and encouraged all veterans to participate and invite those that you know; CHRISTINA, Valley Crisis Center, spoke regarding the month of October being Domestic Violence Awareness Month and the events going on this month. No one else came forward to speak and the public forum was closed. CONSIDERATION OF APPROVAL OF CONSENT AGENDA. Motion by Silveira, seconded by Stonegrove to approve the consent agenda as follows: Check Register for #155060 – #155299 in the Amount of $969,645.13; City Council Resolution No. 5691– Urging the State of California to Provide New Sustainable Funding for State and Local Transportation Infrastructure; City Council Resolution No. 5692 – Accepting the Santa Rita Avenue Water Extension Project as Complete and Authorizing the Filing of a Notice of Completion with the Merced County Recorder; City Council Resolution No. 5693 – Accepting the M Street Water Extension Project as Complete and Authorizing the Filing of a Notice of Completion with the Merced County Recorder. The motion carried by the affirmative action of all City Council Member present. PUBLIC HEARING – TO RECEIVE PUBLIC COMMENT AND CONSIDERATION OF AN ORDINANCE AMENDING TITLE 8 BUILDING REGULATIONS OF THE CITY OF LOS BANOS MUNICIPAL CODE, TO PROVIDE AN EXPEDITED, STREAMLINED SOLAR PERMITTING PROCESS THAT COMPLIES WITH THE SOLAR RIGHTS ACT AND ASSEMBLY BILL 2188 (SECOND READING & ADOPTION); ORDINANCE NO. 1133 – AMENDING TITLE 8 OF THE LOS BANOS MUNICIPAL CODE BY ADDING CHAPTER 6 TO PROVIDE AN EXPEDITED, STREAMLINED PERMITTING PROCESS FOR SMALL RESIDENTIAL ROOFTOP SOLAR SYSTEMS. Fire Chief Marrison stated that he is turning over the presentation to Mike Brinkman with CSG who spoke regarding the expedited solar permitting process as it pertains to AB2188. Mayor Villalta opened the public hearing. No one came forward to speak and the public hearing was closed. Council Member Lewis stated that staff has advised her that they have already streamlined the process for the solar installation so this would just be a matter of formalizing it. Motion by Lewis, seconded by Faria to waive the second reading of Ordinance No. 1133 – Amending Title 8 of the Los Banos Municipal Code by Adding Chapter 6 to Provide an Expedited, Streamlined Permitting Process for Small Residential Rooftop Solar Systems. The motion carried by the affirmative action of all City Council Members present. Motion by Lewis, seconded by Faria to adopt Ordinance No. 1133 – Amending Title 8 of the Los Banos Municipal Code by Adding Chapter 6 to Provide an Expedited, Streamlined Permitting Process for Small Residential Rooftop Solar Systems. PUBLIC HEARING – TO RECEIVE PUBLIC COMMENT AND CONSIDERATION OF ELIMINATING CONDITION NO. 17 OF CONDITIONAL USE PERMIT #2014-09 FOR MI BARRIO FOOD & GAS MART, LOCATED AT 403 N. MERCEY SPRINGS ROAD, APN 082-072-024; CITY COUNCIL RESOLUTION NO. 5694 – APPROVING THE ELIMINATION OF CONDITION OF APPROVAL NO. 17 FOR CONDITIONAL USE PERMIT #2014-09 FOR MI BARRIO FOOD & GAS MART LOCATED AT 403 N. MERCEY SPRINGS ROAD. Senior Planner Elms presented the staff report, which included a PowerPoint presentation. City Manager Carrigan stated that he made the wrong recommendation last year by restricting the sales of single alcoholic beverages at Mi Barrio Food & Gas Mart and realizes now how restriction sales was a burden on the business. Mayor Villalta opened the public hearing. PASTOR JENKINS, New Canaan Baptist Church, spoke in support of Mi Barrio and how they were in support of Circle K at that same location, but he is not in support of the selling of alcohol, but he does feel that businesses should be treated fairly and right, Mi Barrio has been a very good neighbor and how they have been a great addition to the neighborhood, and he thanked the City Manager for the apology; JAY VIRK, Mi Barrio Gas n Mart, thanked staff for their support and spoke to how they have done what they promised and is now requesting approval of the elimination of the condition and allow him to sell alcohol without the restriction to nothing smaller than a three-pack. No one else came forward to speak and the public hearing was closed. Council Member Silveira stated that he is glad to see that staff has made a recommendation for this change and feels that this is fair, how the restriction put Mi Barrio at a competitive disadvantage, and is in full support of staff’s recommendation to eliminate the condition. Council Member Stonegrove thanked Mr. Virk for being here tonight and for being a business owner in our community, noting that she didn’t feel this condition was fair when approved and is happy to see it being removed. Motion by Silveira, seconded by Stonegrove, to approve City Council Resolution No. 5694 – Approving the Elimination of Condition of Approval No. 17 for Conditional Use Permit #2014-09 for Mi Barrio Food & Gas Mart Located at 403 N. Mercey Springs Road. The motion carried by the affirmative action of all Council Members present. PUBLIC HEARING – TO RECEIVE PUBLIC COMMENT AND CONSIDERATION OF ADOPTING A PROPOSED ORDINANCE FOR THE REGULATION OF SPECIAL EVENTS LOCATED IN TITLE 9 AND CHAPTER 3 OF THE LOS BANOS MUNICIPAL CODE; ORDINANCE NO. 1134 – ADDING ARTICLE 41 CHAPTER 3 TO TITLE 9 OF THE LOS BANOS MUNICIPAL CODE RELATING TO SPECIAL EVENTS ON PUBLIC PROPERTY (FIRST READING & INTRODUCTION). Council Member Faria will be recusing himself for the discussion and action because of a conflict in that his wife is the Executive Director for the Chamber of Commerce and left the City Council Chambers at 7:46 PM. Senior Planner Elms presented the staff report, which included a powerpoint presentation. Council Member Lewis inquired as to if there is some sort of standardization as to if they use a park, or if they do a parade are they charged by the blocks being used, how she would like to see a good pricing model so that the public has a clear understanding of what will be charged. Senior Planner Elms responded that it will be a learning process and staff is going to charge according to each event. Mayor Villalta noted that the City has quite a bit of history already so we will have a good idea of what it will cost and how much to charge. Mayor Villalta opened the public hearing. LUIS OLIVIERA, Los Banos DES, spoke in opposition of this proposed ordinance because their biggest issue is the actual cost of the special events especially for the non-profit groups like the Los Banos DES, he would like to see what these events are actually going to cost, the DES Parade has been going on for over 100 years and would like to be able to keep it going to keep their culture alive and not sure if they will be able to afford the costs associated with this new ordinance, would like to have more clarification of how much it will actual cost organizations to have these special events; MARISA COTACHEA, stated that she does not agree with the charging of parades/processions and hopes that the City Council will reconsider this ordinance so that they can continue on with their tradition; MAYOR VILLALTA stated that this is not the end of the process, if this ordinance is adopted staff will come back with a resolution that establishes fees and explained that what has happened is that there have been a number of groups coming forward that want to have events and needing to be fair to each group and accommodating those that want special events; ED AMARAL, Los Banos, spoke on behalf of Our Lady of Fatima Society and Los Banos Portuguese DES Association, spoke in opposition to the new ordinance, explained what these groups do and mean to the community of Los Banos, how they have been doing their processions for over 50 years with the same routes for years, they are also non-profit groups solely made up of volunteers and rely on contributions/donations that they receive, how he reads that only the application fee is coming back to the City Council not a fee schedule and would like more information on the charges to be assessed. No one else came forward to speak and the public hearing was closed. City Manager Carrigan stated that there will be more conversation with staff because they do not know how much and will be figuring out a fair amount to charge, and how the current events are getting a great deal because the full cost is not being charged. Police Chief Brizzee stated that he understands and hears the concerns that are being said tonight, but he is trying to balance the needs of the community with the needs of the Police Department, explained what volunteers can be used for events, how he does all that he can to minimize costs for each event, there has been an increase in the number of events each year, and how it is really hard to know what that cost is before the event happens. Mayor Villalta stated that each group has their volunteers, maybe there is a way where the event volunteers can be cleared to be Police VITAL Volunteers for your event, how the City needs to cost out what they need to cost out to be sure that the event pays for its costs. Council Member Lewis stated that not only if you have people in your organization to be trained as VITAL Volunteers to not only help your event but they could help other events to reduce the costs to all organizations, how she feels that it is really important for basic things that we can cost out need to be cost out and listed so that the public can know the types of money they will be spending from their budget to put on events, various cultural events are very important to every city, but important that we need to cost this out and precisely as possible. Council Member Silveira asked for clarification as to the amount of time they have to submit the application, because not less than 30 days, but then you have 30 days to get back to them, doesn’t seem doable for which Senior Planner Elms stated that the first year the event is put on will be the most time consuming, but when the events are repeated it will take about 15 minutes or so to approve and give a cost. Council Member Silveira inquired as to when we charge for service, we are not in it for a profit, so could can we charge less than what it actually costs for which City Attorney Vaughn stated that this is intended to be a full cost-recovery concept, noting that this could be considered a gift of public funds and could come in to question if you are having an event that does not benefit the who community and is focused to just a particular group or part of the community, and added that the big thing the Planning Commission was talking about is that all these events are being put on by non profits and every event is important to that nonprofit, there is no easy answer and this is why the Planning Commission took three meetings to approve an ordinance for your consideration. Council Member Stonegrove stated that she is glad to have this conversation, noting that we are not trying to make a profit and are just trying to recovery our costs, really important to keep in mind that this is tax payer dollars that we are spending and we need to treat each group fairly. Mayor Villalta encouraged all groups to see if you can get people in your group to become VITAL Volunteers that can save your group money and other groups money, we need to recoup what it costs the City to support these special events, stated that City staff will come up with a cost sheet, help us help you, help us cut down on the cost it is going to cost you. Motion by Silveira, seconded by Lewis to waive the first reading of Ordinance No. 1134 – Adding Article 41 Chapter 3 to Title 9 of the Los Banos Municipal Code Relating to Special Events on Public Property. The motion carried by the affirmative action of all City Council Members present, Faria abstaining. PUBLIC HEARING – TO RECEIVE PUBLIC COMMENT AND CONSIDERATION OF ADOPTING A PROPOSED ORDINANCE FOR REGULATION OF FARMERS’ MARKETS LOCATED IN TITLE 9 AND CHAPTER 3 OF THE LOS BANOS MUNICIPAL CODE; ORDINANCE NO. 1135 – ADDING ARTICLE 42 CHAPTER 3 TO TITLE 9 OF THE LOS BANOS MUNICIPAL CODE RELATING TO CERTIFIED FARMERS’ MARKET. (FIRST READING & INTRODUCTION) Senior Planner Elms presented the staff report, which included a PowerPoint presentation. Council Member Lewis asked for clarification as to the location having to be approved by Merced County Agricultural Commission, what is the difference between a certified market and the certificate and clarification on producers vs certified producers for which City Attorney Vaughn stated there are many regulations and that you have to be a producers of the product you are selling, not for re-sale. Council Member Lewis asked for clarification as to under standards for permits, shall operate as a physically cohesive collection of vendors on a site for which City Attorney Vaughn stated that it needs to be designated as a farmers market, as a cohesive group and separated by other groups that are not certified market. Council Member Lewis was concerned if we had to worry about a flea market being set up at a farmers market for which City Attorney Vaughn stated that a flea market would be subject to special permit rules and regulations. Mayor Villalta inquired as to why the paved surface requirement for which Senior Planner Elms stated that it came from a safety perspective and because of the overuse of grass in parks. Council Member Silveira stated that requiring a paved surface kind of contradicts itself by stating that it is allowable in parks and only allowing paved surface kind of doesn’t allow for park sites for which City Attorney Vaughn stated that the language may have been too general, the Planning Commission was meaning an improved surface, not an unimproved surface, they want to avoid dust issues and environmental concerns, a lot of farmers markets are on streets and paved surfaces. Mayor Villalta stated that if we have an improved surface, is it up to us to do our due diligence to make sure that the surface is usable for which City Attorney Vaughn stated that the grass surface is a maintenance issue. Mayor Villalta opened the public hearing. WILL AREIAS, Owner of Willie Bees Honey Bee Produce, born and raised in Los Banos, stated that for the last three years he has been selling his honey at his farmers market in the park, for a year and a half he has been permitted to sell in the park, on the weekends he sells as a certified grower only what he grows and what his bees can produce, he stated that he has become certified to accept WIC and also has been permitted to allow other growers join him in his market, how the ordinance sounds like a great idea but he has two small issues that conflict with what he is currently doing at Pacheco Park for the last two years: the grass surface allows for tents to be pegged down and limiting it to one day per week, how he would like to see that be multiple days. No one else came forward to speak and the public hearing was closed. Council Member Silveira inquired as to what was the Planning Commission’s reason behind the one day per week for which Senior Planner Elms stated that they looked at what other cities do, what the circuits do in that they go from city to city and sell on set certain days. City Attorney Vaughn stated that part of the consideration was that a Farmers Market might entail a street closure and doing that multiple times a week would be of concern and would we want to dedicate a portion of a park to vendors multiple days of the week. Council Member Silveira stated that life is about change, but we have a vendor who has been permitted to operate there more than one day a week for the last two years and feels that this is more of a change in order to stop one particular person from being at the park. City Attorney Vaughn explained how when Mr. Shasky put it a Farmers Market in the past Mr. Areias was a part of that, Areias has ventured out on his own, has been allowed to do it and is not sure that he is properly permitted. Mr. Areas stated that he has all the required permits but through the commissioner and was certified to sell there. City Attorney Vaughn stated that Mr. Areias has not gotten a use permit to sell there, there was no process in place, it has just been allowed because it was an offshoot of the original farmers market, there was not a motive to single out anybody, you could make a distinction between public property and private property. Council Member Stonegrove stated that she appreciates staff for bringing all these ordinances forward to be sure that we are treating everyone equally, Mr. Areias’ Farmers Market is the only one she has seen that has been operating for years at this location and feels that we should encourage it not prohibit it, if it’s not going to require a street closure it should be allowed to stay open longer than one day a week, but if it requires a street closure then the use should be restricted somehow. Council Member Lewis thanked Mr. Areias for the product that he sells, noted that from visiting farmers markets they are typically one day a week from May – September, not sure that they were intended to be an outdoor shopping center, it kind of takes away the uniqueness of a farmers market if you run it more than one day a week, in regards to the surface she would suggesting maybe tweaking the language to an improved surface as opposed to paved, how she hopes that the farmers market would grow to more than one vendor and should only be one day a week. Mayor Villalta stated that it is a matter of fairness, if the unpaved or improved surfaces opens up more places in town that you could have farmers market and he worries about that, especially to the permanent storefronts, he feels that Mr. Areias’ situation is becoming a business and does not feel that the City should be offering full time/part time business site, and inquired as to what kind of improved surfaces are we talking about; City Attorney Vaughn stated that we are a farming community and we should be encouraging agriculture product, what needs to be decided is the distinction between private and public properties and how many days on each; Council Member Silveira feels that two days a weeks is a good compromise; City Attorney Vaughn stated that staff tried to make the location the purview of the City Manager, because it is public property and we need to have very clear rules, private locations need to go through a permitting process with Community &Economic Development Department. Council Member Lewis fells that operation should be limited to one day per week anywhere in the City and not allowed to be moved from location to location every day, we are trying to narrow it down so that there is a clear definition as to what the City is expecting. Mayor Villalta stated that this ordinance was written to not allow farmers markets at Pacheco Park. Council Member Stonegrove stated that she doesn’t see the harm in allowing the farmers markets to be open two days a week in the same location, how we’re an agricultural community and we should support businesses, pointing out that earlier in the meeting we had to go back and make a correction to an action we made last year, doesn’t want to make that same mistake again, how Mr. Areias was doing what he thought he needed to do and we currently do not have an ordinance, how she doesn’t want to approve this and eliminate the one farmers market we have in town. Mayor Villalta suggested that this item be tabled until the next meeting, have Mr. Areias talk to the City Manager and staff and bring back new language, noting that he is not ready to vote yes for this item. Motion by Villalta, seconded by Silveira to continue this item to the September 16, 2015 City Council Meeting. PUBLIC HEARING – TO RECEIVE PUBLIC COMMENT AND CONSIDERATION OF ADOPTING A PROPOSED ORDINANCE FOR THE REGULATION OF BLOCK PARTIES LOCATED IN TITLE 9 AND CHAPTER 3 OF THE LOS BANOS MUNICIPAL CODE; ORDINANCE NO. 1136 – ADDING ARTICLE 43 CHAPTER 3 TO TITLE 9 OF THE LOS BANOS MUNICIPAL CODE RELATING TO RESIDENTIAL NEIGHBORHOOD BLOCK PARTIES. (FIRST READING & INTRODUCTION) Senior Planner Elms presented the staff report, which included a powerpoint presentation. Mayor Villalta inquired as to if fireworks were permitted including safe and safe on City property except as approved by the Los Banos Fire Department for which Fire Chief Marrison stated that it is against State law to do fireworks year round, only in accordance with 4th of July holiday as stated in the Los Banos Municipal Code. Mayor Villalta stated that the only complaint he gets is that the party is not okay between the hours of 10:00 PM-10:00 AM and could we have the parties end a 9:00 PM for which Senior Planner Elms stated that it has to be at a certain noise level at different times of the day. Council Member Lewis inquired as to if it is the block party holders responsibility to clean up the street after a block party for which it was stated yes. Police Chief Brizzee stated that generally one of the conditions is that the lawful orders of a Police Officer have to be followed if they come to visit you during the course of the event and if they do not we shut them down right away. ADVISEMENT OF PUBLIC NOTICES (One Report). Senior Planner Elms stated that there will be a public hearing at the September 9, 2015 Planning Commission Meeting to consider a Mobile Vendor Permit to allow the operation of a mobile truck to vend on private property located at 1155 I Street, Tacos El Jefe. CITY MANAGER REPORT. City Manager Carrigan reminded all about the cancer awareness pink t-shirts being sold – buy one for a friend. CITY COUNCIL MEMBER REPORTS. TOM FARIA: Reminded all about the upcoming Knights of Columbus soccer event, Movie Night, September 26, 2015 Annual Spring Clean Up Day, Veterans Day Parade on November 7, 2015, October is Domestic Violence Awareness Month, October 16, 2015 walk at Pacheco Park beginning at 6:00 PM, how the Los Banos Art Council brings music and arts to town and encouraged all to support the arts activities in town and the upcoming events. DEBORAH LEWIS: Nothing to report. SCOTT SILVEIRA: Reminded all the September 11, 2015 is the CASA event being held at the Los Banos Fairgrounds, she gave appreciation to staff that we are taking the time to revisit our ordinances and streamline them. ELIZABETH STONEGROVE: Stated that she is looking forward to the Los Banos Fire Department 125th Anniversary Celebration on September 12, 2015 with Movie Night too. MAYOR MICHAEL VILLALTA: Thanked Marco Boffa and James Savage and his parents for the notoriety he brought to Los Banos for his swim to Alcatraz, adding that with all the negativity that you hear about law enforcement, police/fire, they never get enough credit, they keep this town safe, take care of our citizens, it is time that we all join together and praise these men and women for the job that they do, they have helped to keep our town drug free and will continue to do this with a vengeance, urged citizens to continue to form Neighborhood Watch groups, volunteer to curb illegal activity.
