CITY OF LOS BANOS CITY COUNCIL MEETING MINUTES APRIL 20, 2016 ACTION MINUTES – These minutes are prepared to depict action taken for agenda items presented to the City Council. For greater detail of this meeting refer to the electronic media (CD and/or audio) kept as a permanent record. CALL TO ORDER: Mayor Villalta called the City Council Meeting to order at the hour of 7:02 p.m. PLEDGE OF ALLEGIANCE: Acting Police Chief Hedden led the pledge of allegiance. ROLL CALL – MEMBERS OF THE CITY COUNCIL PRESENT: Council Members Deborah Lewis, Scott Silveira, Elizabeth Stonegrove, Mayor Michael Villalta; Absent: Council Member Tom Faria. STAFF MEMBERS PRESENT: City Attorney Vaughn, City Clerk/Human Resources Director Mallonee, Interim City Manager Brizzee, Finance Director Williams, City Treasurer/Accountant I Brazil, Fire Chief Marrison, Senior Planner Elms, Public Works Director/City Engineer Fachin and Information Technology Director Spalding. CONSIDERATION OF APPROVAL OF AGENDA: Motion by Silveira, seconded by Stonegrove to approve the City Council Meeting agenda as submitted. The motion carried by the affirmative action of all City Council Members present, Faria absent. PRESENTATIONS PROCLAMATION RECOGNIZING SEXUAL ASSAULT AWARENESS MONTH. Mayor Villalta presented the proclamation to the Chee Yang & Reyna Nuno, Valley Crisis Center and thanked them for all they do. Ms. Yang & Reyna Nuno spoke to the services they provide to the Westside of Merced County and how they will now be able to provide services 5 days a week. PUBLIC FORUM: MEMBERS OF THE PUBLIC MAY ADDRESS THE CITY COUNCIL MEMBERS ON ANY ITEM OF PUBLIC INTEREST THAT IS WITHIN THE JURISDICTION OF THE CITY; INCLUDES AGENDA AND NON-AGENDA ITEMS. NO ACTION WILL BE TAKEN ON NON-AGENDA ITEMS. SPEAKERS ARE LIMITED TO A FIVE (5) MINUTE PRESENTATION. DETAILED GUIDELINES ARE POSTED ON THE COUNCIL CHAMBER INFORMATIONAL TABLE. RICK TOSCANO, Los Banos American Legion Post Chairman of Boys State, along with Veterans Alan Cotta and Mike Hughes spoke to what Boys State is all about and explained what the students experience and learn while they are there, and introduced the candidates: Los Banos High School: Giovanni Mevi; Pacheco High School: Juan Ramos, and alternate Armani Kazani; ALAN COTTA, thanked the City Council for allowing us to present our candidates; MIKE HUGHES echoed the comments made and regarding the Boys State candidates noting how they get better and better each year, spoke regarding the Los Banos Veterans event on April 21, 2016, and stated that American Legion Auxiliary is the sponsor for the Girls State; for which NANCY WILLIAMSON, MARIANNE PARADISO & MARY BOSH, came forward and explained what Girls State is about and what they experience and learn while they are there, and introduced the candidates and named their parents: Los Banos High School: Kiara Gilardi (Bill & Nancy Gilardi), alternate Marcella Garcia (Rigoberto & Silvia Garcia), Pacheco High School: alternate Katlyn Downward, Brian & Jennifer Downward, Cassandra Ramirez (Gabriel & Lizbeth Ramirez), alternate Danielle Mimoto (Steven & Kathryn Mimoto). Mayor Villalta stated how happy he is that they are providing this service to Los Banos, you are keeping the dream alive and thanked them for what they do; JOHN SPANKOWSKI & ANN MARIE WHITE spoke regarding the Los Banos High School Band and the activities they participate in, and highlighted their upcoming Silent Auction and encouraged all to attend May 7, 2016 event; he also spoke to how impressive the list is that far furthered their careers than you would ever expect from a small town; ERIK LIMON, Los Banos and Republic Services, gave kudos to the opening prayer who is a driver for Republic Services, how he missed the last meeting and reported that last weekend was the very successful Spring Clean Up Day with coordinated donation opportunities of used clothes; EVETTE URIAS, spoke to how she and her daughter were victims of an assault in Los Banos, she feels that the assailants are getting away with it and they are the victims and would urged the City Attorney to look into the case as the District Attorney is not, she is also asking the City to please look into and feels that she has not been served the justice that they deserve, feels that they have been treated as people who have done something wrong and they have not done anything wrong; Mayor Villalta stated that everything will be done in proper procedure, but noting that Merced County has final say. No one else came forward to speak and the public forum was closed. CONSIDERATION OF APPROVAL OF CONSENT AGENDA. Motion by Silveira, seconded by Stonegrove to approve the consent agenda as follows: Check Register for #158701 – #158937 in the Amount of $1,182,419.92; Third Quarter Investment Report for Fiscal Year 2015-2016; City Council Resolution No. 5742 – Awarding Contract for Legal Advertising to the Los Banos Enterprise for Fiscal Year Ending June 30, 2017 and Authorizing and Directing the City Manager to Execute Agreement; City Council Resolution No. 5743 – Approving and Authorizing the Interim City Manager to Execute a Professional Services Agreement for Banking Services. The motion carried by the affirmative action of all City Council Members present, Faria absent. ADVISEMENT OF PUBLIC NOTICES (Three Reports). Senior Planner Elms stated that on April 27, 2106 there will be a Public Hearing held by the Los Banos Planning Commission to consider a site plan review and a conditional use permit for Windecker, Inc. for a convenience store, fuel station, automatic car wash on the northwest corner of Ward Road and Pacheco Boulevard, APN 428-160-016. CITY MANAGER REPORT. Interim City Manager Brizzee stated that for the first four months of this year we have seen about eighty-five new housing permits pulled in the Community & Economic Development Department. CITY COUNCIL MEMBER REPORTS. SCOTT SILVEIRA: In partnership with Los Banos Police Department and District Attorney’s office there is Got Drugs Campaign to turn in your unused or expired prescriptions drugs on April 30 at the Los Banos Police Annex; reminded all about the upcoming May Day Fair and how tickets are still being presold at discounted admission prices, thanked Code Enforcement for the extra effort they have been dealing with on issues around town, thanks to Sergeant Ceja, Commander Reyna, Dana Rawls and Sergeant Reyes. ELIZABETH STONEGROVE: Hopes everyone has a great time at the fair next week. TOM FARIA: Absent. DEBORAH LEWIS: Stated that last week she attended the Annual Fire Fighters Dinner in Merced where Los Banos had two recipients to receive an award: Mark Frontella & Tom Flynn, it was a wonderful evening to be there and to see them receive their awards. MAYOR MICHAEL VILLALTA: Stated that he also attend the Annual Fire Fighters Dinner, spoke regarding the upcoming Jazz Concert, Vets on Site Services on April 21, 2016, May Day Fair and how it is the safest place in the world, great family fun 5 days, how fantastic our Code Enforcement Department is and thanked Acting Police Chief Hedden & Fire Chief Marrison for all they do, how they are cleaning up issues that have been brought to their attention, they are not there to punish they are there to help. CLOSED SESSION – PUBLIC EMPLOYEE EMPLOYMENT, CITY MANAGER, PURSUANT TO GOVERNMENT CODE SECTION 54957. This Closed Session was not held. ADJOURNMENT.
