CITY COUNCIL MEETING MINUTES
JUNE 15, 2016
ACTION MINUTES – These minutes are prepared to depict action
taken for agenda items presented to the City Council. For greater
detail of this meeting refer to the electronic media (CD and/or audio)
kept as a permanent record.
CALL TO ORDER: Mayor Villalta called the City Council Meeting to order at the hour
of 7:01 PM.
PLEDGE OF ALLEGIANCE: Acting Police Chief Reyna led the pledge of allegiance.
ROLL CALL – MEMBERS OF THE CITY COUNCIL PRESENT: Council Members
Deborah Lewis, Scott Silveira, Elizabeth Stonegrove, Mayor Michael Villalta; Absent:
None.
STAFF MEMBERS PRESENT: City Attorney Vaughn, City Clerk/Human Resources
Director Mallonee, Interim City Manager Brizzee, Acting Police Chief Reyna, Finance
Director Williams, City Treasurer/Accountant I Brazil, Fire Chief Marrison, Senior
Planner Elms, Public Works Director/City Engineer Fachin and Information Technology
Director Spalding.
CONSIDERATION OF APPROVAL OF AGENDA: Motion by Faria, seconded by
Lewis to approve the City Council Meeting agenda as submitted. The motion carried by
the affirmative action of all City Council Members present.
PRESENTATIONS – PHOTO MEMORIAL – LOS BANOS WAR HEROES KILLED IN
ACTION. Mayor Villalta spoke regarding the history to the photo memorial, how it came
about, and presented it to the veterans in attendance, noting that it will be hung up in
the lobby at City Hall.
CERTIFICATES OF RECONGNTION TO VARIOUS ORGANIZATIONS FOR
HELPING FEED LOCAL RESIDENTS. Mayor Villalta presented certificates of
recognition of their generous contribution and continued support to help feed the local
residents in our community to: Pastor Jim Garrison of United Methodist Church, Leo
Williams from WalMart Store 2117, and Pastor Steve Hammond of Bethel Community
Church and their representatives in attendance at the meeting.
PUBLIC FORUM: MEMBERS OF THE PUBLIC MAY ADDRESS THE CITY COUNCIL
MEMBERS ON ANY ITEM OF PUBLIC INTEREST THAT IS WITHIN THE
JURISDICTION OF THE CITY; INCLUDES AGENDA AND NON-AGENDA ITEMS.
NO ACTION WILL BE TAKEN ON NON-AGENDA ITEMS. SPEAKERS ARE
LIMITED TO A FIVE (5) MINUTE PRESENTATION. DETAILED GUIDELINES ARE
POSTED ON THE COUNCIL CHAMBER INFORMATIONAL TABLE. RHONDA
LOWE, Los Banos, President of the Los Banos Downtown Association, spoke regarding
their efforts to make the downtown a more vibrant and vital part of the community, the
improvements with music/speakers, the August 5, 2016 Grapes Wines and Hopps event
and thanked the City Council for their support, and the Open Mic Night events they put
on; BERTHA FARIA, Los Banos Chamber of Commerce, spoke regarding the new
chamber members, upcoming events, Open Mic Nights, Relay for Life Los Banos, Los
Banos Genealogical Society meetings held every third Saturday from 10 am to 12 noon,
Dads Night Out event on June 18, 2016 in the Downtown on 6th Street, wished a Happy
Fathers Day to all dads, the upcoming Wells Fargo Mixer, and encouraged all to visit
and purchase fireworks at the Chamber of Commerce firework booth; FATHER NOAH
LAWSON stated that on June 25, 2016 the church will be celebrating the feast of St.
Albin with a community BBQ and events and invited all to attend; JOANN LAMAS,
Westside Government Representative for Senator Canella, introduced herself and
reminded everyone of the mobile district office hours held the third Thursday of every
month from 11:30 am – 12:30 pm at Los Banos City Hall. No one else came forward to
speak and the public forum was closed.
CONSIDERATION OF APPROVAL OF CONSENT AGENDA. Motion by Silveira,
seconded by Stonegrove to approve the consent agenda as follows: Check Register for
#159658 - #159895 in the Amount of $896,822.61; Minutes for the Adjourned City
Council Meeting of May 31, 2016; Minutes for the Adjourned City Council Meeting of
June 6, 2016; City Council Resolution No. 5756 – Approving a Tentative Agreement/
Memorandum of Understanding by and between the City of Los Banos and the Los
Banos Police Dispatchers/Community Services Officers Association for July 1, 2016 –
June 30, 2018; City Council Resolution No. 5757 – Amending Division 4, Salary
Schedule – Employee Classifications Relating to Changes to Section G – Police to
Reflect Changes Associated with the Approval of the Tentative Agreement with the Los
Banos Police Dispatchers/Community Services Officers Association. The motion
carried by the affirmative action of all City Council Members present.
PUBLIC HEARING – TO RECEIVE PUBLIC COMMENT AND CONSIDERATION OF
THE APPROPRIATION LIMITATION FOR THE 2016/2017 FISCAL YEAR (FY); CITY
COUNCIL RESOLUTION NO. 5758 – SETTING THE TAX RELATED
APPROPRIATION LIMIT IN COMPLIANCE WITH PROPOSITION 4 AND
PROPOSITION 111 FOR THE 2016/2017 FY. Finance Director Williams presented the
staff report.
Mayor Villalta opened the public hearing. No one came forward to speak and the public
hearing was closed.
Motion by Faria, seconded by Silveira to adopt City Council Resolution No. 5758 –
Setting the Tax Related Appropriation Limit in Compliance with Proposition 4 and
Proposition 111 for the 2016/2017 FY. The motion carried by the affirmative action of
all Council Members present.
PUBLIC HEARING – TO RECEIVE PUBLIC COMMENT AND CONSIDERATION OF
THE 2016/2017 FISCAL YEAR (FY) BUDGET; CITY COUNCIL RESOLUTION NO.
5759 – ADOPTING THE 2016/2017 FY BUDGET, INCLUDING EMPLOYEE SALARY
SCHEDULE (DIVISION 4) OF LOS BANOS POLICY & PROCEDURES MANUAL.
Finance Director Williams presented the staff report, which included a PowerPoint
presentation.
There was Council Member and staff discussion regarding bonding out for a new police
station, how much those payments would be, new fire stations, plans for a fueling facility
and training tower, city hall generator, and generators/power at fire stations.
Mayor Villalta opened the public hearing. No one came forward to speak and the public
hearing was closed.
There was additional Council Member and staff discussion regarding the great job
Finance Director Williams and her staff has done and thanking them for their hard work
on this budget, thanked the department heads too for all their work on the budget,
excited to be moving police/fire employees from general fund to Measure P and giving
back to employees for all the sacrifices they give to our City, likes that we are taking
advantage of one time money for special projects, additional funding for the volunteer
fire fighters, and some funding for police volunteers, how the reason things are working
well is because of our management team, how the budget people are the ones that
make sure it all balances out.
Motion by Stonegrove, seconded by Lewis to adopt City Council Resolution No. 5759 –
Adopting the 2016/2017 FY Budget, Including Employee Salary Schedule (Division 4) of
Los Banos Policy & Procedures Manual. The motion carried by the affirmative action of
all Council Members present.
ADVISEMENT OF PUBLIC NOTICES (Three Reports). Senior Planner Elms stated
that there will be three public hearings at the Planning Commission Meeting on June 22,
2016: consideration of a conditional use permit to allow the operation of a mortuary in
the Highway Commercial zoning district (H-C) for Wayne Bynum at 285 Mercey Springs
Road, Suite A; consideration of Site Plan Review #2016-05 for O’Reilly’s Auto
Enterprises, LLC for the construction of a new 8,712 sq. ft. auto parts store at the
northwest corner of Pacheco Boulevard and Sixth Street; consideration of a Conditional
Use Permit to allow the use of a Type 41 Alcohol License for the on-sale beer and wine
in conjunction with an eating place, Taqueria 152, located at 1041 W. Pacheco
Boulevard;
CITY MANAGER REPORT. Interim City Manager Brizzee spoke regarding how hard
the Finance staff worked on the budget, they were very accommodating during the
process, how this is his last meeting and it has been a blast, appreciates all the work
and all the patience from everyone, and thanked the City Council for allowing him to
serve.
CITY COUNCIL MEMBER REPORTS.
SCOTT SILVEIRA: Thanked Interim City Manager Brizzee, Finance Director Williams,
and City Attorney Vaughn for the recently approved revenue sharing agreement with
Merced County which he feels is fair and equitable for both entities, thanked Interim City
Manager Brizzee for the hard work that he continues to do, the new City Manager will
be at the July 6, 2016 Council Meeting and how he will be walking into a pretty good
situation.
ELIZABETH STONEGROVE: Thanked Interim City Manager Brizzee for his service for
the last several months, it was a better than seamless transition, thanked the Police
Department and Public Works Department for their efforts on Graffiti Clean-up Day held
on June 10, 2016 particularly thanking Patricia and Pacheco Softball & Cheer for their
participation in the event and all who worked on that effort.
TOM FARIA: Spoke to the fantastic work on sealing the revenue sharing deal which
was a tremendous accomplishment, noting it was in the process for many years, how
Interim City Manager Brizzee, City Attorney Vaughn and Finance Director Williams
pushed to make that happen, how Interim City Manager Brizzee held the city together
very very well, a masterful accomplishment, how Los Banos is home to a world record
holder to swim Alcatraz and back, James Savage, a tremendous young little man and
quite a big deal, congratulated James on his accomplishment, spoke regarding the
Veterans Memorial Picture here at City Hall and invited all to come down and see it,
upcoming Flag Day, thanked the groups here tonight for feeding the hungry in the City,
our people take care of our people, upcoming Fathers Day, Friday Tom Cat event, and
Saturday’s Fathers Day event.
DEBORAH LEWIS: Thanked Interim City Manager Brizzee for holding our city together
during this transition, appreciate the job you did and how you afforded the two Police
Commanders the opportunity to step in and gain additional leadership experience as
Acting City Manager, thanks to those who help feed the community as recognized at
tonight’s and also to those who donated, wished all a Happy Fathers Day and enjoy
your time with your family, how she would like to bring back our special events
ordinance code to review it and reconsider the fees that are being charged, and
reached out to all the Warrior fans out there: let’s hope they bring back a trophy
tomorrow night. City Attorney Vaughn spoke in regards to the special events ordinance,
which the plan was to bring it back and staff is working on a plan to revamp that
ordinance.
MAYOR MICHAEL VILLALTA: Stated that Interim City Manager Brizzee has been
given a lot of accolades tonight, noting how staff can make you or break you, and staff
has made his job very easy, when one person departs things can go very well or terribly
wrong and in our case all of staff came together to make it go very very right, how he is
very impressed with how staff came together as one cohesive unit, very seamless
transition, noting how when the new City Manager comes it is going to be another
seamless transition because of staff, how Los Banos is the only city in Merced County
to have a new revenue sharing agreement and how happy they are with what they will
receive due to the hard work of Interim City Manager Brizzee, City Attorney Vaughn,
and Finance Director Williams, spoke regarding Open Mic Night at Positive Changes on
June 10, 2016 and how movers and shakers are the individuals in town who want good
things for our community, Dads Night Out is new and something else for the community
to attend, the St. Albin’s event encouraging everyone to go visit them they would love to
have you, how there are a lot of functions in Los Banos and encouraged all to support.
ADJOURNMENT. The meeting was adjourned at 8:18 PM in memory of the 15 Los
Banos men who died in service of this country.
