CITY COUNCIL MEETING MINUTES
APRIL 4, 2018
ACTION MINUTES – These minutes are prepared to depict action
taken for agenda items presented to the City Council. For greater
detail of this meeting refer to the electronic media (CD and/or audio)
kept as a permanent record.
CALL TO ORDER: Mayor Villalta called the City Council Meeting to order at the hour
of 7:00 p.m.
PLEDGE OF ALLEGIANCE: Police Commander Reyna led the pledge of allegiance.
ROLL CALL – MEMBERS OF THE CITY COUNCIL PRESENT: Council Members
Daronica Johnson-Santos (7:15 PM), Deborah Lewis, Scott Silveira, Mayor Michael
Villalta; Absent: Council Member Tom Faria.
STAFF MEMBERS PRESENT: City Manager Terrazas, City Attorney Vaughn, City
Clerk/Human Resources Director Mallonee, Police Commander Reyna, Fire Chief
Hurley, Finance Director Williams, City Treasurer/Accounting & Budget Supervisor
Williams, Assistant Public Works Director Pimentel.
CONSIDERATION OF APPROVAL OF AGENDA: Motion by Silveira, seconded by
Lewis to approve the City Council Meeting agenda as submitted. The motion carried by
the affirmative action of all City Council Members present, Faria and Johnson-Santos
absent.
PRESENTATIONS.
PROCLAMATION DECLARING THE MONTH OF APRIL AS “SEXUAL ASSAULT
AWARENESS MONTH” AND APRIL 25, 2018 AS “DENIM DAY” IN LOS BANOS.
Mayor Villalta presented the proclamation to Chee Yang of Valley Crisis Center. Ms.
Yang spoke to the history of Denim Day and how it came about and how Sutter
Memorial in Los Banos is now able to perform sexual assault examinations for cases in
Merced County.
PROCLAMATION RECOGNIZING VOLUNTEERS OF THE LOS BANOS POLICE
DEPARTMENT DURING NATIONAL VOLUNTEER WEEK. Mayor Villalta spoke to the
animal shelter volunteers and what their efforts entail. Animal Shelter Volunteer Charles
Thurston introduced himself and further spoke to the need of more volunteers and
encouraged students 18 years of age and older to apply for volunteerism.
Mayor Villalta spoke to the Police VITAL volunteers and what their efforts entail. Sandra
Gonzales, President of the VITAL volunteers, introduced herself and asked the other
volunteers to do so also. She spoke to some of the things they do in their volunteer
work and what becoming a volunteer entails.
Police Commander Reyna gave a formal thanks and expression of appreciation to all of
the volunteers. He spoke to how there is a VITAL volunteer nominated each year for
Volunteer of the Year by that group of volunteers and how the recipient for the 2017
year is volunteer John Gonzales. Police Commander Reyna read a short background
on Mr. Gonzales and presented him with a certificate. Mr. Gonzales expressed his
appreciation and introduced his family that was present.
Mayor Villalta read and presented the proclamation to the VITAL and Animal Shelter
volunteers in attendance.
PROCLAMATION RECOGNIZING VOLUNTEERS OF THE LOS BANOS FIRE
DEPARTMENT DURING NATIONAL VOLUNTEER WEEK. Fire Chief Hurley spoke to
the history of the Los Banos Volunteer Fire Department, what their volunteer work
consists of, the training they go through, and how these volunteers provide a possible
source of future quality employees. He asked the volunteers to introduce themselves
and state how long they have been a volunteer of the Department. Fire Chief Hurley
expressed his gratitude and appreciation for the volunteers and they work they do.
Mayor Villalta presented the proclamation to the Los Banos Fire Department
Volunteers.
[Council Member Johnson-Santos arrived at the Council Meeting at 7:15 pm and took
her seat at the dais.]
PUBLIC FORUM: MEMBERS OF THE PUBLIC MAY ADDRESS THE CITY COUNCIL
MEMBERS ON ANY ITEM OF PUBLIC INTEREST THAT IS WITHIN THE
JURISDICTION OF THE CITY; INCLUDES AGENDA AND NON-AGENDA ITEMS.
NO ACTION WILL BE TAKEN ON NON-AGENDA ITEMS. SPEAKERS ARE
LIMITED TO A FIVE (5) MINUTE PRESENTATION. DETAILED GUIDELINES ARE
POSTED ON THE COUNCIL CHAMBER INFORMATIONAL TABLE. MARLENE
SEIMILLER ALVES, Los Banos, recognized the professional experiences she has had
with the Fire Department and the Animal Shelter, spoke to how she feels Code
Enforcement is coming on too strong and how these enforcement issues are uninviting,
she spoke to graffiti and beautification issues she is seeing downtown; JENNIFER
LOA, Board Member and Secretary for Habitat for Humanity, expressed her
appreciation for Council’s recent attendance at an open house event, spoke to a
Women Build Event that is coming up and invited everyone to join in on the fun;
COLEEN CRAWFORD, Los Banos, spoke to recently installed speed cushions and how
well they work, it is a big improvement in the neighborhood and cars are forced to go
the speed limit; GARY MUNOZ, Los Banos, spoke to how he volunteers his time at the
McArthur Apartments and how he hears complaints about traffic on F Street and would
like to see some traffic calming devices installed there for which Mayor Villalta asked
that he contact Police Commander Reyna or Police Chief Brizzee to discuss the
situation and how to proceed. No one else came forward to speak and the public forum
was closed.
CONSIDERATION OF APPROVAL OF CONSENT AGENDA. Motion by Johnson-
Santos, seconded by Silveira to approve the consent agenda as amended as follows:
Check Register for #209731 – #209932 in the Amount of $924,381.11; Minutes for the
March 7, 2018 City Council Meeting; Minutes for the March 21, 2018 City Council
Meeting; Measure P Oversight Committee Report. The motion carried by the affirmative
action of all Council Members present, Faria absent.
PUBLIC HEARING – TO RECEIVE PUBLIC COMMENT AND CONSIDERATION OF
REPEALING AND AMENDING IN ITS ENTIRETY CHAPTER 1 OF TITLE 11 OF THE
LOS BANOS MUNICIPAL CODE REGULATING BUSINESS LICENSES;
ORDINANCE NO. 1163 – AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF LOS BANOS REPEALING AND AMENDING IN ITS ENTIRETY CHAPTER 1 OF
TITLE 11 OF THE LOS BANOS MUNICIPAL CODE REGULATING BUSINESS
LICENSES. (SECOND READING & ADOPTION) City Attorney Vaughn presented the
staff report.
Mayor Villalta opened the public hearing. No one came forward to speak and the public
hearing was closed.
Motion by Silveira, seconded by Lewis to waive the second reading of Ordinance No.
1163 – An Ordinance of the City Council of the City of Los Banos Repealing and
Amending in its Entirety Chapter 1 of Title 11 of the Los Banos Municipal Code
Regulating Business Licenses. The motion carried by the affirmative action of all
Council Members present, Faria absent.
Motion by Silveira, seconded by Lewis to adopt Ordinance No. 1163 – An Ordinance of
the City Council of the City of Los Banos Repealing and Amending in its Entirety
Chapter 1 of Title 11 of the Los Banos Municipal Code Regulating Business Licenses.
The motion carried by the following roll call vote: AYES: Faria, Johnson-Santos, Lewis,
Silveira, Villalta; NOES: None; ABSENT: Faria.
ADVISEMENT OF PUBLIC NOTICES (No Report).
CITY MANAGER REPORT. City Manager Terrazas expressed his appreciation for the
City’s volunteers and congratulated John Gonzales on his Volunteer of the Year
designation.
CITY COUNCIL MEMBER REPORTS.
SCOTT SILVEIRA: Council Member Silveira spoke how the Los Banos Arts Council
will be presenting the Grammy award-winning “Okie Dokie” on Sunday, April 8, 2018 at
1:00 p.m. and referenced ticket prices and location. On Monday, April 9, 2018 he will be
attending a public meeting regarding a new school farm to be located at Pacheco High
School. He reminded everyone of the May Day Fair to be held on May 2-6, 2018.
TOM FARIA: Absent.
DARONICA JOHNSON-SANTOS: Council Member Johnson-Santos apologized for
her tardiness and thanked the volunteers for all the work they do.
DEBORAH LEWIS: Mayor Pro Tem Lewis spoke to an installation and luncheon
ceremony she attended for the new General Postmaster of Los Banos, Jasmine Kaur,
and how her journey to her new position was a great story and is happy to see someone
in that position who really cares about the community.
MAYOR MICHAEL VILLALTA: Mayor Villalta spoke to how today is the 50 th
anniversary of the assassination of Dr. Martin Luther King who was a champion for
peace. He further recognized the volunteers that were honored tonight and how these
volunteers contribute to the betterment of the community. Mayor Villalta spoke of a
Rotary group meeting he attended and how mental illness was discussed at that event
and the need for mental health services both locally and countywide.
ADJOURNMENT. The meeting was adjourned at 8:07 p.m.
