CITY OF LOS BANOS PLANNING COMMISSION MEETING MINUTES JULY 13, 2022 ACTION MINUTES - These minutes are prepared to depict action taken for agenda items presented to the Planning Commission. For greater detail of this meeting refer to the electronic media (CD and/or audio) kept as a permanent record. CALL TO ORDER: Vice Chair Uhley called the Planning Commission Meeting to order at the hour of 6:02 p.m. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Commissioner Robinson. ROLL CALL - MEMBERS OF THE PLANNING COMMISSION PRESENT: Planning Commission Members John Cates, Christopher Perrecone, Elias Reyes, Rob Robinson, and Katherine Uhley; ABSENT: John Cates. STAFF MEMBERS PRESENT: Community & Economic Development Director Stacy Elms, Associate Planner Luquin, Planning Technician/Planning Commission Secretary Justin Ragunton, Public Workers Director/City Engineer Nirorn Than and City Attorney William A. Vaughn. CONSIDERATION OF APPROVAL OF AGENDA. Motion by Robinson, seconded by Perrecone to approve the agenda as submitted. The motion carried by the following roll call vote: AYES: Perrecone, Reyes, Robinson, Uhley; NOES: None; ABSENT: Cates. CONSIDERATION OF APPROVAL OF THE ACTION MINUTES FOR THE REGULAR PLANNING COMMISSION MEETING OF JUNE 22, 2022. Motion by Perrecone, seconded by Reyes to approve the minutes as submitted. The motion carried by the following roll call vote: AYES: Perrecone, Reyes, Robinson, Uhley; NOES: None; ABSENT: Cates. PUBLIC FORUM: MEMBERS OF THE PUBLIC MAY ADDRESS THE PLANNING COMMISSION MEMBERS ON ANY ITEM OF PUBLIC INTEREST THAT IS WITHIN THE JURISDICTION OF THE CITY; INCLUDES AGENDA AND NON-AGENDA ITEMS. NO ACTION WILL BE TAKEN ON NON-AGENDA ITEMS. SPEAKERS ARE LIMITED TO A FIVE (5) MINUTE PRESENTATION. DETAILED GUIDELINES ARE POSTED ON THE COUNCIL CHAMBER INFORMATIONAL TABLE. Vice Chair Uhley opened the public forum. Nobody indicated that they would like to speak. Vice Chair Uhley closed the public forum. PUBLIC HEARING - TO CONSIDER A CATEGORICAL EXEMPTION FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO SECTION 15332, INFILL DEVELOPMENT PROJECTS, AND APPROVAL OF VARIANCE #2022- 01 TO ALLOW FOR THE POTENTIALLY EXCESSIVE NOISE ASSOCIATED WITH THE CONSTRUCTION OF THE NEW LOS BANOS POLICE STATION LOCATED AT 1111 G ST.; MORE SPECIFICALLY IDENTIFIED AS ASSESSOR'S PARCEL NUMBERS: 026-161-003, 011. Associate Planner Luquin presented the staff report, which included a PowerPoint presentation. Community & Economic Development Director Elms clarified that the pouring of concrete will only be for a specific time during this summer. They will be for the pouring of the tilt- up walls for the project. Once the tilt-up wals are constructed, there will be no need to have the early morning construction for the project. She clarified that the Chief of Police, confirmed that the early morning concrete pours will be done within six to eight specific days. The pouring of the concrete in the morning is to allow for the concrete to properly cure during this time of extreme heat that will occur in the next coming months. After the the walls are constructed, the regular construction time will start a around 5:30 am. Vice Chair Uhley opened questions to staff before opening the public hearing. Commissioner Robinson had a question regarding the duration of the project and how long will the project be expected to last. Police Chief Brizzee, came forward to the podium to provide clarification. He commented that the duration of the project will be completed by mid to end of September 2023. The closeout for the entire project should be November 2023. Vice Chair Uhley opened the public hearing. Vice Chair Uhley asked if the audience had any comments. No one indicated they would like to speak. Vice Chair Uhley closed the public hearing and opened questions back up to staff. All commissioners indicated that they had no further questions. Motion by Perrecone, seconded by Reyes to adopt Planning Commission Resolution No. 2022-21 - Approving a Categorical Exemption from the California Environmental Quality Act (CEQA) Pursuant to Section 15332, Infill Development Projects, and Approval of Variance #2022-01 to Allow for the Potentially Excessive Noise Associated with the Construction of the New Los Banos Police Station Located at 1111 G St.; More Specifically Identified as Assessor's Parcel Numbers: 026-161-003, 011. The motion carried by the following roll call vote: AYES: Perrecone, Reyes, Robinson, Uhley; NOES: None; ABSENT: Cates. PUBLIC HEARING - TO CONSIDER APPROVAL OF RESOLUTION NO. 2022-22, APPROVING SITE PLAN REVIEW #2022-01 FOR THE DEVELOPMENT OF TWO (2) COMMERCIAL STRUCTURES WITH DRIVE-THRUS TOTALING 5,800 SQUARE FEET, A 374 SQUARE FOOT PATIO AND ASSOCIATED SITE IMPROVEMENTS LOCATED WITHIN THE HIGHWAY COMMERCIAL ZONING DISTRICT AT 1443 W. PACHECO BLVD.; MORE SPECIFICALLY IDENTIFIED AS ASSESSOR'S PARCEL NUMBER: 430-010-045. Associate Planner Luquin presented the staff report, which included a PowerPoint presentation. Vice Chair Uhley opened questions to staff before opening the public hearing. No commissioners had any questions. Vice Chair Uhley opened the public hearing. Vice Chair Uhley asked if anyone had any comments. No one indicated they would like to speak. Vice Chair Uhley closed the public hearing and opened questions back up to staff. All commissioners indicated that they had no questions. Motion by Reyes, seconded by Robinson to adopt Planning Commission Resolution No. 2022-22 - Approving Site Plan Review #2022-01 for the Development of Two (2) Commercial Structures with Drive-Thrus Totaling 5,800 Square Feet, a 374 Square Foot Patio and Associated Site Improvements Located within the Highway Commercial Zoning District at 1443 W. Pacheco Blvd.; More Specifically Identified as Assessor's Parcel Number: 430-010-045. The motion carried by the following roll call vote: AYES: Perrecone, Reyes, Robinson, Uhley; NOES: None; ABSENT: Cates. COMMUNITY & ECONOMIC DEVELOPMENT DIRECTOR REPORT. Community & Economic Development Director Elms gave her report. She reported that the City has a new Interim City Manager, Gregory Wellmen. She commented that he was a former C.E.O. for Merced County, former City Manager for the City of Atwater, and Interim City Manager for the City of Oakdale. She encouraged the Commissioners if they see him around town to stop by and say hello. She commented if the Commissioners would like a formal introduction to meet Mr. Wellmen, to stop by City Hall and arrange a formal greeting. She reported that the City is in the public review period for the General Plan 2042 Draft and the Environmental Impact Report (EIR) Draft. She commented that the City will be holding a public meeting on July 14, 2022 for any questions or comments the public may have regarding the General Plan Draft and the EIR Draft. She reported that the Drafts are currently under a 45 day review period and the closing date is August 1, 2022 by 5:00 pm. She commented that once the Drafts have passsed the review period, the item will come forth to the Planning Commission for review and consideration. The Planning Commission will then make a recommendation to City Council. She stated that if the Commissioners have any questions to feel free to contact her or check out the website for the General Plan 2042 Draft and EIR Draft. She encouraged all the Commissioners to take a look into the Drafts on their free time. She then concluded her report. PLANNING COMMISSION MEMBER REPORTS. CATES: No report. PERRECONE: No report. REYES: No report. ROBINSON: Reported on the 35 mile per hour speed limit signs on Pacheco Blvd. He expressed his content for the speed limit signs and gave thanks to the department in charge of it. APPEAL RIGHTS AND FILING PROCEDURES Any person dissatisfied with an act or determination of the Planning Commission may appeal such act or determination to the Planning Commission by filling written notice with the Planning Commission Secretary not later than five (5) business days (excluding holidays) after the day on which the act or determination was made. An appeal must state the act or determination which is being appealed, the identity of the applicant and his/her interest in the matter, and set forth in concise statement(s) the reasons which render the Commission's decision unjustified or inappropriate. (Los Banos Municipal Code Section 9-3.2326) Concerning an action taken by the Planning Commission related to Chapter 2 Articles 1 through 17 of the Los Banos Municipal Code "Subdivisions", if a subdivider or other affected property owner is dissatisfied with any action of the Commission with respect to a tentative map or the nature and extent of improvements recommended or required he/she may within fifteen (15) days after such action appeal to the Planning Commission Secretary for a public hearing on the matter. An appeal must state the action being appealed, identify the agenda item by agency number or project title, and set forth in concise statement(s) the reasons for the appeal.
