TOWN OF LOS GATOS COUNCIL AGENDA REPORT Minutes of the Town Council Meeting Tuesday, June 3, 2025 7:00 P.M. The Town Council of the Town of Los Gatos conducted a special meeting in person and via teleconference. MEETING CALLED TO ORDER AT 7:04 P.M. ROLL CALL Present: Mayor Matthew Hudes, Vice Mayor Rob Moore, Council Member Mary Badame, Council Member Rob Rennie, Council Member Maria Ristow. Absent: None. PLEDGE OF ALLEGIANCE Mayor Hudes led the Pledge of Allegiance. The audience was invited to participate. CONSENT ITEMS 1. Approve the Minutes of the April 22, 2025 Town Council Study Session Meeting. 2. Approve the Minutes of the May 20, 2025 Town Council Closed Session Meeting. 3. Approve the Minutes of the May 20, 2025 Town Council Regular Meeting. 4. Authorize the Town Manager to Execute an Agreement for Services with the Los Gatos Chamber of Commerce to Manage the Town’s Destination Marketing Services, Visit Los Gatos, and the Town’s Visitors Information Center, for a Total Agreement Amount Not to Exceed $88,000 for 2025-26. 5. Adopt a Resolution Establishing the Fiscal Year 2025-26 Gann Appropriation Limit for the Town of Los Gatos. RESOLUTION 2025-028 6. Take Actions Related to the Los Gatos Creek Trailhead Connector to Highway 9 Project (CIP 832-4505) including Project Acceptance, Directing Staff to Record the Notice of Completion, and Approving an Amendment to the Agreement for Services with Zoon Engineering to Reallocate Expenses Between Tasks within the Existing Total Agreement Amount of $1,220,822.07 and Authorize its Execution by the Town Manager. MOTION: Motion by Council Member Ristow to approve consent items one through six. Seconded by Vice Mayor Moore. VOTE: Motion passed unanimously. 110 E. Main Street Los Gatos, CA 95030 ● 408-354-6832 www.losgatosca.gov PAGE 2 OF 5 SUBJECT: Minutes of the Town Council Meeting of June 3, 2025 DATE: June 17, 2025 VERBAL COMMUNICATIONS Carl Guardino - Commented on an upcoming June 28 Stars and Strides Run/Walk event to support local public hospitals and healthcare clinics, and invited the council and residents to participate. Gus Who - Commented on concerns with parking, safety, censorship, a water bill, and recent events. Brent Knudsen - Commented on a letter he submitted and requested a reconsideration of the 143 and 151 East Main Street project decision. Lynley - Shared a personal statement about faith and provided religious material to the Council. Doreen Castleman - Commented on rising antisemitism nationally and requested a statement of support for the Jewish community in Los Gatos to stop hate and promote safety. The Mayor stated they will move to Council Matters. COUNCIL MATTERS Council considered a request for the reconsideration of the 143-151 East Main Street project decision and no motion for a reconsideration was made. - Council Member Badame stated she participated in meetings of a Wildfire Advisory Group, met with local leaders regarding field space for Los Gatos girls’ softball, attended a student presentation at Van Meter School, and attended Billy Jones Railroad Birthday Celebration Steam Engine #2. - Council Member Ristow stated she attended the ribbon cutting for The Grove at Los Gatos, the Los Gatos Parks and Public Works BBQ, the Senior of Distinction 25th annual event, the Memorial Day event at Los Gatos Memorial Park, County Supervisor Margaret Abbe Koga’s AAPI heroes luncheon; met with a representative from Eden Housing about affordable housing, the 2025 Local Energy Codes Update by Silicon Valley Clean Energy; hosted the fifth Friday lunch for present and former elected women in Santa Clara County, attended Billy Jones Railroad Birthday Celebration for Steam Engine #2, the NUMU Pride exhibit and reception, and the Silicon Valley Clean Energy Finance and Administration Committee meeting. PAGE 3 OF 5 SUBJECT: Minutes of the Town Council Meeting of June 3, 2025 DATE: June 17, 2025 - Vice Mayor Moore stated he performed the ceremonial ribbon cutting for The Grove at Los Gatos; attended the Los Gatos Parks and Public Works BBQ, the Daves Avenue Culture Fair; spoke at the Division 12 West Key Club event; attended Los Gatos High School Community Center Club event, and the community unveiling for the Community Centers conceptual designs. - Council Member Rennie stated he spoke with Eden Housing about affordable housing, attended the Silicone Vally Clean Energy Risk Oversite meeting, and had a few meetings with residents. - Mayor Hudes stated he met with a Wildfire Advisory Group; participated in the Senior of Distinction Awards event; attended a Community Center leadership meeting, a ribbon cutting at Petals Creamery; participated in an Africa Day event, the Memorial Day event; participated in the Council Policy meeting, the West Valley Mayor and Managers luncheon, the Community Heath and Senior Services Commission meeting; met with Deb Davis; attended a ribbon cutting for In Hands Post Operative Therapy, the Billy Jones Railroad Birthday Celebration Steam Engine #2, the unveiling of the Community Centers conceptual designs; and spoke at the Hillbrook eight grade promotion ceremony. TOWN MANAGER MATTERS - The Town Manager stated he had nothing to report. PUBLIC HEARINGS 7. Adopt a Resolution Approving the Town of Los Gatos Fiscal Year (FY) 2025-26 Operating Budget and FY 2025-26 – 2029-30 Capital Improvement Program (CIP); Adopt a Resolution Approving Commitment of Fund Balances under GASB 54; and Approve FY 2024-25 Budget Adjustments and Reclassifications. RESOLUTION 2025-029 and RESOLUTION 2025-030. Chris Constantin, Town Manager, and Gitta Ungvari, Finance Director presented the staff report. Council asked preliminary questions. Mayor Hudes opened public comment. No one spoke. Mayor Hudes closed public comment. Council discussed the item. PAGE 4 OF 5 SUBJECT: Minutes of the Town Council Meeting of June 3, 2025 DATE: June 17, 2025 MOTION: Motions by Council Member Badame to adopt a resolution approving the Town of Los Gatos Fiscal Year (FY) 2025-26 Operating Budget and FY 2025-26–2029-30 Capital Improvement Program (CIP), including new appropriations, minor corrections, and carry-forward appropriations, as presented in Attachment One with Exhibit A - Total Town Revenues and Expenditures by Fund; and adopt a resolution approving commitments of Fund Balances under GASB 54, as presented in Attachment Two; and approve FY 2024-25 Year-End Budget Adjustments and Reclassifications as listed in Attachment Three. Seconded by Council Member Ristow. VOTE: Motion passed unanimously. 8. Conduct a Public Hearing to Hear Protests and Adopt Resolutions Confirming the Diagrams and Assessments and Levying and Authorizing the Collection of Assessments for Landscape and Lighting Assessment Districts No. 1 and 2 for Fiscal Year 2025-26. RESOLUTION 2025-031, RESOLUTION 2025-032, RESOLUTION 2025-033, RESOLUTION 2025-034, RESOLUTION 2025-035, AND RESOLUTION 2025-036. Meredith Johnston, Administrative Technician presented the staff report. Council asked preliminary questions. Mayor Hudes opened public comment. No one spoke. Mayor Hudes closed public comment. Council discussed the item. MOTION: Motion by Council Member Badame to adopt resolutions as contained in attachments one through six to continue the annual process of renewing the Landscape and Assessment Districts one and two for Fiscal Year 2025 through 2026. Seconded by Council Member Ristow. VOTE: Motion passes unanimously. 9. Consider the Introduction of an Ordinance and Adoption of a Resolution Approving the Fire Hazard Severity Zones Map to Comply with State Government Code Section 51178 and an Amendment of the General Plan Hazards and Safety Element to Incorporate the Fire Hazard Severity Zones Map. Adoption of this Ordinance and Resolution is Exempt Pursuant to CEQA, Section 15268, in that it is Required by the State. General Plan PAGE 5 OF 5 SUBJECT: Minutes of the Town Council Meeting of June 3, 2025 DATE: June 17, 2025 Amendment Application GP-25-01 and Town Code Amendment A-25-03. Project Location: Town Wide. Applicant: Town Of Los Gatos. RESOLUTION 2025-037 Robert Gray, Building Manager, and Brad Fox, Assistant Fire Marshall presented the staff report. Council asked preliminary questions. Mayor Hudes opened public comment. No one spoke. Mayor Hudes closed public comment. Council discussed the item. MOTION: Motion by Council Member Badame to introduce an Ordinance in Attachment One and adopt a resolution in Attachment Two to approve the Fire Hazard Severity Zones Map to comply with State Government Code Section 51178 and an amendment of the General Plan Hazards and Safety Element to incorporate the Fire Hazard Severity Zones Map, and include the correction to the resolution the phrase 120 “days” and to direct the Town Clerk to read the title of the Ordinance and waive further reading. Seconded by Vice Mayor Moore. VOTE: Motion passes unanimously. Wendy Wood, Town Clerk read the title of the Ordinance “The Ordinance of the Town Council of the Town of Los Gatos Adopting Revised Cal Fire Requirements for Local Responsibility Area Fire Hazard Severity Zones.” Closed Session Report Gabrielle Whelan, Town Attorney, stated the Council met in closed session to discuss one item of anticipated litigation, pursuant to Government Code Section 54956.9 and previously on May 27, to also discuss, anticipated litigation pursuant to Government Code Section 54956.9.
