MINUTES VILLAGE OF LOS LUNAS THURSDAY, AUGUST 11, 2016 The Board of Trustees of the Village of Los Lunas, County of Valencia, and State of New Mexico met Thursday, August 11, 2016 in regular session at 6:00 PM at the Council Chambers. Roll call was taken and the following were present: Mayor Charles Griego, Councilors Christopher Ortiz, Paulette Sanchez-Montoya, Gerard Saiz, and Councilman Gino Romero. Mayor: Charles Griego Mayor Pro Tem: Paulette Sanchez-Montoya Council: Gerard Saiz Christopher Ortiz Gino Romero Also present were: Gregory D. Martin, Martin Callahan, Andy Gomez, Jim Rickey, Sandy Schauer, Diego Luna, Joshua Chavez, Scott White, Stan Strickman, Kathy P.-Doyle, and Deborah Fox. In accordance with Ordinance 114A, the following agenda was prepared and circulated as required:  CALL MEETING TO ORDER.  PLEDGE OF ALLEGIANCE.  APPROVAL OF AGENDA.  PUBLIC INPUT FORUM. 1. RECOGNIZE LOS LUNAS POLICE OFFICER JEREMY SHAW. 2. RESOLUTION 16-20 – A RESOLUTION OF THE VILLAGE OF LOS LUNAS AMENDING THE HUNING RANCH AREA PLAN IN ORDER TO REVISE THE DESIGNATION OF THE PARCEL LOCATED AT LANDS OF HUNING LIMITED PARTNERSHIP, TRACT 1H 4.03 AC, SEC 30, T7N, R2E, B-5-30, REV 2007, FROM RF – RELIGIOUS FACILITIES TO C – COMMERCIAL IN ORDER TO ALLOW A NON-PROFIT PHILANTHROPIC INSTITUTION. 3. ORDINANCE 411 – AN ORDINANCE ANNEXING PORTIONS OF 33-B, 34-F, AND 34-G, MIDDLE RIO GRANDE CONSERVANCY DISTRICT, MAP 72, VALENCIA COUNTY, NM, AND FURTHER DESCRIBED IN EXHIBIT A – ALTA/ASCM LAND TITLE SURVEY. 4. ORDINANCE 276-2016-7 – AN ORDINANCE DESIGNATING ZONING FOR A CERTAIN PARCEL OF LAND. 5. REQUEST PERMISSION TO ENTER IN TO CONTRACT – EDUCATIONAL SERVICES. 6. EXECUTIVE SESSION: a) Hire Administrative Assistant – Community Development Department. b) Hire Code Enforcement Officer – Community Development Department. c) Hire Open Space Supervisor – Open Space Division / Community Services Department. d) Hire 2 Street Seasonal Labor Positions – Street Department / Public Works Department. 7. TRAVEL: IN-STATE / OUT-OF-STATE. 8. APPROVAL OF MINUTES: a) Minutes of July 28, 2016. 9. ADJOURNMENT.  CALL MEETING TO ORDER. At 6:00 PM, Mayor Charles Griego brought the meeting to order and welcomed the audience.  PLEDGE OF ALLEGIANCE. Mayor Griego led the Mayor, Council and audience in the Pledge of Allegiance.  APPROVAL OF AGENDA. Mayor Griego announced that the executive session would be moved to item one. Mayor Griego asked for a motion to approve agenda with amendment. APPROVAL: Motion to approve agenda with amendments MOVED: Councilman Romero SECONDED: Councilwoman Sanchez-Montoya CARRIED: Motion passed on a vote of 4 (Councilman Romero – yes; Councilman Ortiz – yes; Councilwoman Sanchez-Montoya – yes; Councilman Saiz – yes) FOR AND 0 AGAINST. Proclamation – Library Day.  PUBLIC INPUT FORUM. None. 1. EXECUTIVE SESSION. Mayor Griego announced that the Council would be going into executive session pursuant to NMSA 1978 Section 10-15-1, that the following matters would be discussed in closed session: discuss the hiring of an Administrative Assistant, hiring of a Code Enforcement Officer, hiring of Open Space Supervisor, and hiring of two Street Season Labor Positions. APPROVAL: Motion to go into executive session pursuant to NMSA 1978 Section 10-15-1 (H) (2). MOVED: Councilman Saiz SECONDED: Councilman Romero CARRIED: Motion passed on a vote of 4 (Councilman Romero – yes; Councilman Ortiz – yes; Councilwoman Sanchez-Montoya – yes; Councilman Saiz – yes) FOR AND 0 AGAINST. Adjourned at 6:09 p.m. At 6:42 p.m., Mayor Griego asked for a motion to reconvene to go back into open session after discussing the hiring of an Administrative Assistant, hiring of a Code Enforcement Officer, hiring of Open Space Supervisor, and hiring of two Street Season Labor Positions. APPROVAL: Motion to reconvene in open session pursuant to NMSA 1978 Section 10-15-1 (H) (2). MOVED: Councilman Saiz SECONDED: Councilman Romero CARRIED: Motion passed on a vote of 4 (Councilman Romero – yes; Councilman Ortiz – yes; Councilwoman Sanchez-Montoya – yes; Councilman Saiz – yes) FOR AND 0 AGAINST. Councilwoman Paulette Sanchez-Montoya removed herself from the vote. Regarding the hiring of Administrative Assistant – upon recommendation, Mayor Griego put up the name of Sonja Walker. APPROVAL: Motion to approve MOVED: Councilman Romero SECONDED: Councilman Ortiz CARRIED: Motion passed on a vote of 3 (Councilman Romero – yes; Councilman Ortiz – yes; Councilman Saiz – yes) FOR AND 0 AGAINST. Regarding the Code Enforcement Officer - Mayor Griego put up the name of Diego Luna. APPROVAL: Motion to approve hiring MOVED: Councilman Ortiz SECONDED: Councilman Romero CARRIED: Motion passed on a vote of 4 (Councilman Romero – yes; Councilman Ortiz – yes; Councilwoman Sanchez-Montoya – yes; Councilman Saiz – yes) FOR AND 0 AGAINST. Regarding the Open Space Supervisor - Mayor Griego put up the name of Pat Jaramillo. APPROVAL: Motion to approve hiring MOVED: Councilman Romero SECONDED: Councilman Saiz CARRIED: Motion passed on a vote of 4 (Councilman Romero – yes; Councilman Ortiz – yes; Councilwoman Sanchez-Montoya – yes; Councilman Saiz – yes) FOR AND 0 AGAINST. Regarding the Seasonal Street Laborer - Mayor Griego put up the name of Julian Silva. APPROVAL: Motion to approve hiring MOVED: Councilman Saiz SECONDED: Councilman Ortiz CARRIED: Motion passed on a vote of 4 (Councilman Romero – yes; Councilman Ortiz – yes; Councilwoman Sanchez-Montoya – yes; Councilman Saiz – yes) FOR AND 0 AGAINST. Regarding the Seasonal Street Laborer - Mayor Griego put up the name of Benjamin Martin. Mayor Charles Griego stepped down and Mayor Pro-Tem, Paulette Sanchez-Montoya resumed the meeting. 2. RECOGNIZE LOS LUNAS POLICE OFFICER JEREMY SHAW. Police Chief Naithan Gurule recognized Officer Jeremy Shaw for his outstanding job performance. Officer Shaw recently assisted a man is distress during a recent military activity. 3. RESOLUTION 16-20 – A RESOLUTION OF THE VILLAGE OF LOS LUNAS AMENDING THE HUNING RANCH AREA PLAN IN ORDER TO REVISE THE DESIGNATION OF THE PARCEL LOCATED AT LANDS OF HUNING LIMITED PARTNERSHIP, TRACT 1H 4.03 AC, SEC 30, T7N, R2E, B-5-30, REV 2007, FROM RF – RELIGIOUS FACILITIES TO C – COMMERCIAL IN ORDER TO ALLOW A NON-PROFIT PHILANTHROPIC INSTITUION. Motion to adjourn as council and move in to a public hearing. ORDINANCE 411 – AN ORDINACNE ANNEXING PORTIONSOF 33-B, 34-F, AND 34-G, MIDDLE RIO GRANDE CONSERVANCY DISTRICT, MAP 72, VALENCIA COUNTY, NM, AND FURTHER DESCRIBED IN EXHIBIT A – ALTA/ASCM LAND TITLE SUREY. POSTPONED UNTIL NEXT MEETING. 5. ORDINANCE 276-2016-7 – AN ORDINANCE DESIGNATING ZONING FOR A CERTAIN PARCEL OF LAND. POSTPONED UNTIL NEXT MEETING. 6. REQUEST PERMISSION TO ENTER IN TO CONTRACT – EDUCATION SERVICES. Ms. Cynthia Shetter presented item six. Contractor will develop and teach an early childhood reading program for ages 3-5 years of age. The program will be weekly one and half hour long class that will run from August 11, 2016 to June 1, 2017 at the Los Lunas Library. Mayor Pro-Tem Sanchez-Montoya asked for a motion from council APPROVAL: Motion to approve contract for Ms. Mabel Velasquez. MOVED: Councilman Saiz SECONDED: Councilman Ortiz CARRIED: Motion passed on a vote of 3 (Councilman Romero – yes; Councilman Ortiz – yes; Councilman Saiz – yes) FOR AND 0 AGAINST. 7. TRAVEL: IN-STATE / OUT-OF-STATE. Mayor Pro-Tem Sanchez-Montoya asked if there were any comments on travel – there were none. Mayor Pro-Tem asked for a motion from Council. MINUTES. Mayor Pro-Tem Sanchez-Montoya asked if there were corrections or additions to the council minutes of July 28, 2016 – there was none. RESOLUTION 16-20 – A RESOLUTION OF THE VILLAGE OF LOS LUNAS AMENDING THE HUNING RANCH AREA PLAN IN ORDER TO REVISE THE DESIGNATION OF THE PARCEL LOCATED AT LANDS OF HUNING LIMITED PARTNERSHIP, TRACT 1H 4.03 AC, SEC 30, T7N, R2E, B-5-30, REV 2007, FROM RF – RELIGIOUS FACILITIES TO C – COMMERCIAL IN ORDER TO ALLOW A NON-PROFIT PHILANTHROPIC INSTITUION. Ms. Christina Ainsworth presented item three. This application is to amend application for special use. This particular parcel is designated for religious use. Planning & Zoning has recommended approval and there was no opposition from the public. Ms. Ainsworth asked if there were any questions – there were none. Mayor Pro-Tem Sanchez-Montoya asked to close the public hearing and Council would go back in to open meeting. The Village of Los Lunas Council is pleased to have residents of the community take time to attend Village Council Meetings. Attendance and participation is encouraged. Written materials will not be accepted during regular agenda items in the interest of time. NAITHAN GURULE 1. RECOGNIZE LOS LUNAS POLICE OFFICER JEREMY SHAW. TAB 1. ACTION REQUESTED OF COUNCIL: Informational purposes only. BACKGROUND AND RATIONALE: LLPD would like to recognize Los Lunas Police Officer Jeremy Shaw for his outstanding job performance. The Los Lunas Police Officer and Kirtland Air National Guard member helped a man in distress during a recent military activity. During a routine stop, Senior Airman Jeremy Shaw of the 150 th Special Operations Wing Prime Power Unit and 6 year veteran of Los Lunas Police Department observed a man was having a seizure. Without hesitation Officer Shaw used his knowledge and police training to assist the man until further medical attention arrived. Officer Shaw did not mention this incident to anyone at the police department, as he was trying to go unnoticed. A story written about the incident in the Kirtland Airforce Base Nucleus was discovered and shared with staff. CHRISTINA AINSWORTH 2. BACKGROUND AND RATIONALE: Red Cap Properties, LLC has applied for a zone designation of R-2 for the property located in Portions of 33-B, 34-F and 33-G, Middle Rio Grande Conservancy District, Map 72, Valencia County, NM and further described in Exhibit A – ALTA/ACSM Land Title Survey, for the purposes of allowing an existing apartment complex. The only cost to the Village will be for fuel for the city vehicle. c) Village employees are requesting permission to travel out-of-state to Las Vegas, NV to attend the Caselle Annual Conference (October 11-13, 2016). Estimated cost: $2,398.00. d) Councilman and Village Administrator are requesting permission to travel out-of-state to Pittsburgh, PA to attend the National League of Cities Annual Conference (November 15-20, 2016).
