VILLAGE OF LOS LUNAS
THURSDAY, FEBRUARY 11, 2021
The Board of Trustees of the Village of Los Lunas, County of Valencia, and State of New Mexico met Thursday, February 11, 2021 in regular
session at 6:00 PM at the Council Chambers. Roll call was taken and the following were present: Mayor Pro Tem Christopher Ortiz,
Councilman Phillip Jaramillo, Councilman Cruz Munoz, and Councilman Gino Romero. Meeting was conducted and recorded through
Webex.com.

Also present were: Gregory D. Martin and Martin Callahan.
In accordance with Ordinance 114A, the following agenda was prepared and circulated as required:

2. AMENDED WATER AGREEMENT WITH NIAGARA BOTTLING ALLOWING NIAGARA BOTTLING TO EXPAND ITS PRODUCTION
CAPABILITIES.
3. 2020 STREETS AND ZONING MAPS.

At 6:00 PM, Mayor Pro Tem Ortiz brought the meeting to order and welcomed the audience.
• PLEDGE OF ALLEGIANCE.
Mayor Pro Tem Ortiz asked Del Archuleta to lead the Council and WebEx participants in the Pledge of Allegiance.
• APPROVAL OF AGENDA.
Mayor Pro Tem Ortiz announced that item two would not be heard tonight/request was withdrawn. Mayor Pro Tem Ortiz asked for a
motion from Council with the amendment.
APPROVAL: Motion to approve amended council agenda.
MOVED: Councilman Romero
SECONDED: Councilman Jaramillo
CARRIED: Motion passed on a vote of 3 (Councilman Romero – yes; Councilman Jaramillo – yes; Councilman Munoz – yes) FOR
AND 0 AGAINST.
1. PRESENTATION.
Mr. Del Archuleta presented item one. Del discussed a letter that was sent to Mayor and Council about a change that was taking place at
Molzen-Corbin. Announced his retirement from Molzen-Corbin – Kevin Eades is the new CEO.
2. AMENDED WATER AGREEMENT WITH NIAGARA BOTTLING ALLOWING NIAGARA BOTTLING TO EXPAND ITS PRODUCTION
CAPABILITIES.
Item removed from agenda.
3. 2020 STREETS AND ZONING MAPS.
Mr. Alex Ochoa presented item three. Discussed some notable changes over the past year (presented map to council – zone changes, streets,
buildings). Mayor Pro Tem Ortiz asked Council if there were any questions – there were none. Mayor Pro Tem Ortiz asked for a motion from
Council.
APPROVAL: Motion to approve.
MOVED: Councilman Jaramillo
SECONDED: Councilman Munoz
CARRIED: Motion passed on a vote of 3 (Councilman Romero – yes; Councilman Munoz – yes; Councilman Jaramillo – yes)
FOR AND 0 AGAINST.
4. MINUTES.
Mayor Pro Tem Ortiz asked if there were corrections to the council minutes of January 28, 2021 – there were none.
MOTION: Motion to approve.

CARRIED: Motion passed on a vote of 3 (Councilman Romero – yes; Councilman Munoz – yes; Councilman Jaramillo – yes) FOR

LARRY GUGGINO BOTTLING TO EXPAND ITS PRODUCTION CAPABILITIES.

BACKGROUND AND RATIONALE:
This matter was originally heard by the Council at the January 28, 2021 meeting. It was tabled, and staff was
instructed to place this matter on the Council Agenda for the February 11, 2021 Council meeting. On February
23, 2017, the Village and Niagara Bottling entered into an amended agreement (“Agreement”) for the provision
of water and wastewater services to Niagara Bottling by the Village. That Agreement provides that Niagara
would be a regular customer of the Village water and wastewater services. In the February 23, 2017 Agreement,
the Village agreed to supply Niagara up to 285 AFY of water. In order for the Village to supply Niagara Bottling
with the amount of water as stated in the Agreement, Niagara Bottling transferred water rights it leased from
PNM into the Village’s wells. In the current Agreement, if Niagara Bottling desires to expand its production,
Niagara Bottling is required to purchase and transfer consumptive use water rights into the Village wells in
accordance with Paragraph 5 of the current agreement. Niagara Bottling has requested to expand its plant and
is requesting the Village agree to provide up to 650 AFY of water to them. The proposed amended agreement
requires Niagara to transfer suitable water rights into the Village’s wells by lease instead of by purchase to
offset their water consumption. Niagara plans to secure these additional water rights with a lease from PNM.
