MINUTES VILLAGE OF LOS LUNAS THURSDAY, SEPTEMBER 23, 2021 The Board of Trustees of the Village of Los Lunas, County of Valencia, and State of New Mexico met virtually Thursday, September 23, 2021 in regular session at 6:00 PM. Roll call was taken and the following were present: Mayor Charles Griego, Councilman Cruz Munoz, Councilman Christopher Ortiz, and Councilman Gino Romero. Meeting was conducted in person and recorded through Webex.com. Mayor: Charles Griego Mayor Pro Tem: Christopher Ortiz Council: Gino Romero Phillip Jaramillo, excused Cruz Munoz Also present were Gregory D. Martin, Debra Sanchez, Pauline Hernandez, Craig Donohoe, and Martin Callahan. In accordance with Ordinance 114A, the following agenda was prepared and circulated as required: 1. MEMORANDUM OF AGREEMENT – SAN JUAN CHAMA PROJECT CONTRACTORS ASSOCIATION. 2. NM (MAIN STREET) SOUTH ROUTE 66 NEON SIGNS. 3. ORDINANCE 460 – RECREATIONAL CANNABIS REGULATIONS. 4. EXECUTIVE SESSION: a) Pursuant to §10-15-1(H)(7) NMSA 1978, discussion in Executive Session of the New Mexico Taxation and Revenue Department’s acceptance of the counteroffer made by the Plaintiffs’ in the mediation of the case of the City of Albuquerque et. al. v. New Mexico Department of Taxation and Revenue (“TRD”), Cause No. D-202-CV-2018-08036 b) Hire Streets Superintendent – Streets Division / Public Works Department. c) Hire Street Maintenance Worker III – Streets Division / Public Works Department. d) Hire Park Technician I – Parks Division / Parks and Recreation Department. e) Hire PT Recreation Aide – Recreation Division / Parks and Recreation Department. f) Hire PT Library Aide – Library Department. 5. APPROVAL OF MINUTES: a) Minutes from September 9, 2021 Council Meeting. 6. ADJOURMENT. • CALL MEETING TO ORDER. At 6:00 PM, Mayor Griego brought the meeting to order and welcomed the audience. • PLEDGE OF ALLEGIANCE. Mayor Griego asked Clara to lead the Council and WebEx participants in the Pledge of Allegiance. Mayor Griego announced that Councilman Jaramillo was excused. • APPROVAL OF AGENDA. Mayor Griego asked if there were any changes to the agenda – there were none. Mayor Griego asked for a motion from Council. APPROVAL: Motion to approve council agenda. MOVED: Councilman Munoz SECONDED: Councilman Ortiz CARRIED: Motion passed on a vote of 3 (Councilman Romero – yes; Councilman Ortiz – yes; Councilman Munoz – yes) FOR AND 0 AGAINST. • PUBLIC INPUT FORUM. Mayor Griego asked if there was anyone who wanted to speak to the Council regarding an item that was not on the agenda. Ms. Erin Callahan approached the podium – she wanted to announce that the Village of Los Lunas received an award from ESRI Sag (Special Achievement in GIS) award for GSI mapping. Mr. Gregory D. Martin announced that the new and improved 2022 budget was placed at their stations for viewing. 1. MEMORANDUM OF AGREEMENT – SAN JUAN CHAMA PROJECT CONTRACTORS ASSOCIATION. Mr. Michael Jaramillo presented item one. Requesting approval or disapproval of a MOU of agreement between the San Juan Chama Project Contractors Association. A number of San Juan Chama contractors have created a formal organization to monitor actions of the Bureau of Reclamation and to advocate for all users of the SJCP throughout the state. The SJCP has requested that each stakeholder join the SJCP Water Users Association with the approval of the MOA. Have an agreement with a couple of water conservation groups to use water downstream. This MOA will ensure our water rights are being used properly/correctly. Michael Jaramillo will be the contact for this group. Mayor Griego asked Council if they had any questions, there were none. Mayor Griego asked if there has been any buy-ins from other entities. Michael replied yes – they have been in communication with six other communities. Mayor Griego asked for a recommendation from Council. NM (MAIN STREET) SOUTH ROUTE 66 NEON SIGNS. Mr. Michael Jaramillo presented item two. This is an item that was started in 2016; Michael spoke with Greg about installing some type of landmark for this historical route. The NM Department of Transportation has allowed the Village to install Historical South Route 66 signage. The signage can be installed on two custom constructed sign platforms on both sides of the river bridge. NMDOT would not allow the installation of any signs until the new bridge was accepted for maintenance and ownership by NMDOT. A bid was obtained through New Mexico Cooperative Educational Services for $98,560.00 w/o GRT. Mayor Griego asked Council if they had any questions. Councilman Romero asked if approved how long to install. Michael replied about 2.5 months. Mayor asked how secure is this project. Michael replied somewhere around $1,100 (the neon). Item has a coating to protect against any painting/graffiti. Mayor Griego asked for a motion from Council. ORDINANCE 461 – RECREATIONAL CANNABIS REGULATIONS. Mr. Alex Ochoa presented item three. Just a recap from the last meeting, state legislation – signed into law by Governor Lujan-Grisham on April 12, 2021. Cannabis control division created under NMRLD. Some of the key dates: September 1, 2021 – accept licenses for producers, med producers and microbusinesses; January 2, 2022 – promulgate commercial cannabis rules for licensing, training and educating, issue server permits; and April 2, 2022 – retail sales begin. Personal use – 2 oz. flower, 16g extract, 100mg edibles; 6 mature plants and 6 immature plants; 12 mature total 2 or more people in household. The permissible use chart was shown and will become part of the ordinance. The State authorizes local government to regulate buffered distance from schools and daycares of not more than 300 ft. At the last workshop, it was decided that 300 ft. was recommended. Buffers - can place additional buffers around facilities. Alex displayed map of 300 ft. buffers in the Village. Blue areas are special use areas. Erin stepped in to explain – within our special use zones those are all regulated either by an approved site plan or by an approved area plan. She treats every special use request as a rezone. Mayor feels like we are creating conflict in our land use ordinance. Alex proceed with explanation of the buffers. Councilman Munoz asked about buffers around community centers, city facilities/buildings. Alex commented that they could add buffers to those village facilities/buildings. Any special exclusions can be written in to the ordinance – religious ceremonies, etc. Public parks would be off limits – have buffer. State statue authorizes local governments to regulate a buffered distance from schools and daycares of not more than 300 ft. Also, authorizes to regulate the density of licensed establishments – retail, cultivation, manufacturing or combination. Alex asked Council if there were any type of recommendations for units per square mile. Mayor Griego asked Police Chief Gurule what his thoughts were. Chief Gurule commented that he felt buffers and square miles were good. Alex commented that he has received about 5 -10 people who are interested in submitting applications. We could allow one per two square mile. Alex mentioned that he would go back and work on putting together a working ordinance and present to Council for review.
