MINUTES VILLAGE OF LOS LUNAS THURSDAY, AUGUST 25, 2022 The Board of Trustees of the Village of Los Lunas, County of Valencia, and State of New Mexico met virtually Thursday, August 25, 2022 in regular session at 6:00 PM. Roll call was taken and the following were present: Mayor Charles Griego, Councilman Cruz Munoz , Councilman Christopher Ortiz, Councilman Gino Romero, and Councilman James Runyon. Meeting was conducted in person and recorded through Webex.com. Mayor Griego asked the audience if there was anyone who wanted to talk to Council about an item that is not on the council agenda. Mr. Charles Lakins, attorney who represents Mr. and Mrs. Alvin Apodaca, approached the podium – he wanted to talk to the Mayor about an issue that he is currently having with the Middle Rio Grande Conservancy, a project that included the Village of Los Lunas. Mr. Lakins wrote a letter to MRGCD and to Mayor Griego – he has not heard a response. Mayor Griego directed Mr. Lakins to talk with the Village Attorney, Mr. Larry Guggino. 1. NM 6 SUN RANCH TO JUBILEE MULTIUSE TRAIL A302230. Mr. Michael Jaramillo presented item three. This project was approved by DOT and Federal Highway Commission about four years ago. Public Works Department received four bids for the project. Funds have been allocated for a 10’ wide multiuse asphalt trail with signage, drainage, striping and pedestrian lighting. TAPS funding is $674,976 while the Village match is $115,024 for a project-funding total of $790,000. Low bid is from Desert Fox, Inc. for $710,658.43. If awarded, would start in about 30-40 days. Mayor Griego asked Council if they had any comments – Councilman Runyon commented, the Village comes up with $115,024. Michael responded, yes. Time line: 120 days. This is the fourteenth amendment of the original agreement. Village attorney has reviewed the agreement. This has been a good partnership. The Los Lunas School District would like to continue with the 2022/2023 MIA for refuse removal at the Los Lunas School sites. Due to no changes there will be no increase to the new MOA. Per State purchasing regulations, we are required to advertise for these services every four years. The Village advertised for RFPs in July 2022 – we received one proposal. Ranked by a five- member review committee. Committee recommends awarding the proposal to the only responding firm and initiating contract negotiations. VERRA MOBILITY – AUTOMATED SPEED ENFORCEMENT SERVICES CONTRACT. Police Chief Frank Lucero presented item nine. Verra Mobility is a company that specializes in automated speed enforcement services. This automated speed enforcement service is violator funded and is not designed to be a revenue generating program. Texas based company that specialize in automated speed enforcement. The Village can sustain two vehicles – this is a five-year contract. Funds generated will be used to support program. Units will be the responsibility of the Village – maintenance and providing insurance. The Village Attorney has been consulted and he approves. Councilman Runyon asked where the money was coming from to start the program. Chief Lucero replied that this was a self-sustaining program. Mayor Griego asked Council if they had any comments – Councilman Runyon asked if these were actual vehicles. Chief Lucero replied, yes. Mayor Griego asked for a motion from Council. Martin, Village Administrator Mayor Griego  MINUTES VILLAGE OF LOS LUNAS THURSDAY, AUGUST 11, 2022 2. MINOR SUBDIVISION APPROVL FOR TRACT: 13A1 S: 16 T: 7N R: 2E 3.49 ACRES MAP 68 ON BLUE MOON AVE. NE. Ms. Erin Callahan presented item two. This is a minor subdivision on Blue Moon Ave. – applicant is requesting to subdivide one parcel into three one-acre parcels and to dedicate a 10’ sewer easement. The sewer line will be installed by the Village of Los Lunas in partnership with the property owner. The proposed use is for single family residential dwellings. Applicant name is Jeremy Utash who representing Emilio and Violet Otero. This is in the AR residential zone which requires a minimum size lot of one acre. This is in District 2 – Councilman Gino Romero. Notice of public hearing was published in the Valencia County News Bulletin on 6/16/22 and adjacent property owners were sent notice by certified mail. The Development Review Committee has received no phone calls or letter in favor and no calls or letters in opposition of the request. The applicant is in communication with the Public Works Department in regards to the sewer easement. Based on the Village of Los Lunas Municipal Code and Comprehensive Plan, the Community Development Department recommends approval of the minor subdivision. Mr. Jeremy Utash commented that this is a project that Emilio had started prior to his death. Mayor Griego asked council if they had any questions – there were none. Adjourned – 6:19PM 8. ORDNANCE 464 – VILLAGE OF LOS LUNAS AUTOMATED SPEED ENFORCEMENT ORDINANCE. Police Chief Frank Lucero presented item eight. The speed enforcement ordinance would allow the Police Department the ability to utilize portable automated devices to enforce their existing speeding ordinance. The systems can be integrated in to vehicles that can be easily deployed in to the problem areas. This ordinance would allow the Los Lunas Police to utilize automated video/camera systems to detect speed violators. LLPD Officers would verify these violations and upon verification, the vehicle owner will be issued a violation. The violation consists of a civil infraction, punishable by a fine of $100 or completion of our hours of community service. The violator has the right to request a hearing before the Municipal Court Judge. The Village Attorney has reviewed the ordinance and has approved. The ordinance was published in the Valencia County News Bulletin and have not received any opposition regarding the ordinance. Mayor Griego asked if there were any questions from Council. Councilman Munoz asked if it was going to be used in residential or high traffic. Chief Lucero replied that it could only be used only on Village owned roadways (residential) and could not be used on state roads (Hwy 314, NM 6/Main St.). Councilman Munoz asked what would be the speed (how much over the posted speed limit) when a ticket would be given. Chief Lucero replied, it would be 10 miles over the posted speed limit. Councilman Runyon commented that he loans out his vehicle, if his vehicle is tagged for speeding, now it’s his responsibility to prove that he was not behind the wheel driving – a bit frustrating. Mayor Griego asked if there was any one in the audience who wanted to comment. Danny commented – where does the recipient dispute. Chief Lucero replied, in Municipal Court. This does not impact your driver’s license. Mayor Griego asked for a motion to close public hearing and go back in to a council meeting.
