MINUTES VILLAGE OF LOS LUNAS THURSDAY, NOVEMBER 3, 2022 The Board of Trustees of the Village of Los Lunas, County of Valencia, and State of New Mexico met virtually Thursday, November 3, 2022 in regular session at 6:00 PM. Roll call was taken and the following were present: Mayor Charles Griego, Councilman Christopher Ortiz, Councilman James Runyon and Councilman Gino Romero. Meeting was conducted in person and recorded through Webex.com. Mayor: Charles Griego Mayor Pro Tem: Cruz Munoz, excused Council: Gino Romero Christopher Ortiz James Runyon Also present were Debra Sanchez, Luis Brown, Erin Callahan, and Craig Donahoe. In accordance with Ordinance 114A, the following agenda was prepared and circulated as required: 1. RESOLUTION 22-24 – A RESOLUTION PERMITTING A SPECIAL USE AMENDMENT OF A DESIGNATED AREA WITHIN THE MUNICIPALITY OF LOS LUNAS, COUNTY OF VALENCIA, STATE OF NEW MEXICO. 2. RESOLUTION 22-25 – A RESOLUTION PERMITTING A SPECIAL USE AMENDMENT OF A DESIGNATED AREA WITHIN THE MUNICIPALITY OF LOS LUNAS, COUNTY OF VALENCIA, STATE OF NEW MEXICO. 3. RESOLUTION 22-23 – A RESOLUTION PERMITTING A SPECIAL USE AMENDMENT OF A DESIGNATED AREA WITHIN THE MUNICIPALITY OF LOS LUNAS, COUNTY OF VALENCIA, STATE OF NEW MEXICO. 4. ORDINANCE 276-2022-4 – AN ORDINANCE PERMITTING A ZONE CHANGE OF A DESIGNATED AREA WITHIN THE MUNICIPALITY OF LOS LUNAS, COUNTY OF VALENCIA, STATE OF NEW MEXICO. 5. EXECUTIVE SESSION a) Discussion of threatened or pending litigation in which the Village of Los Lunas is or may become a participant regarding the fee structure of a new Los Lunas Water Rights Ordinance as it applies to multi- family developments. 6. APPROVAL OF MINUTES: a) Minutes from October 20, 2022 Council Meeting. 7. ADJOURMENT. • CALL MEETING TO ORDER. At 6:00 PM, Mayor Griego brought the meeting to order and welcomed the audience. Mayor Griego announced that Councilman Munoz was excused. • PLEDGE OF ALLEGIANCE. Mayor Griego asked Kevin to lead the Council and WebEx participants in the Pledge of Allegiance. • APPROVAL OF AGENDA. Mayor Griego announced that Item 1 and 2 will be tabled – with that amendment, the Mayor asked council for a motion. APPROVAL: Motion to approve amended agenda. Mayor Griego announced that Councilman Munoz was excused this evening. • PUBLIC INPUT FORUM. Mayor Griego asked the audience if there was anyone present who wanted to speak to the Council that did not have an item on the agenda. Fire Chief Gabaldon approached the podium – they had their pinning ceremony for Kevin Garcia. 1. It was determined that the developer had a vested right in the previous ordinance and are instructing staff to move forward to implement. Mayor Griego asked for a motion from council. Ms. Erin Callahan announced that items 3 and 4 will be presented together but will require separate motions. Lawrence and Kathy Jaramillo, has applied for a Special Use Amendment for the properties described as Subd: Land of Lawrence Jaramillo and Kathy Jaramillo Tract: 1 S: 22 T: 7N R: 2E 1.05 Acres Plat N-724, Subd: Land of Lawrence Jaramillo and Kathy Jaramillo Tract: 2 S: 22 T: 7N R: 2E 0.50 Acres Plat N-724, and Subd: Land of Lawrence Jaramillo and Kathy Jaramillo Tract: 3 S: 22 T: 7N R: 2E 0.50 Acres Plat N-724, with street addresses of 1766 Los Lentes Rd NE, 1714 Los Lentes Rd NE, and 1716 Los Lentes Rd NE, respectively, for the purpose of updating a Day Care Center use within the requested zone, S- U. The second item on the agenda is case #22-09-R, 1714 and 1716 N. Los Lentes Rd. and this item applies to only to tracts 2 and 3 of the previously listed legal descriptions. The applicants name on both cases is John Kirkpatrick, architect, acting agent for Lawrence and Kathy Jaramillo, property owners. Application was submitted on September 16, 2022. This daycare was established about twenty years ago. The second item is a zone change to two of the parcels that are currently within the S-U zone – to remove those from the S-U and to establish them as R-1. In the S-U zoning, the applicant is asking for an amendment to allow for an expansion for parking and an open play area. Applicant is requesting to remove the two residential used parcels – those are 1714 & 1716 Los Lentes and establish as R-1 zones. There is a staff request with conditions if this is approved – if requests are approved, summary plat must be recorded with the Valencia County prior to publishing notice of adoption of the zone designations to avoid a split zone. Published in the Valencia County News Bulletin on September 9, 2022 and the Community Development Department has received 0 calls or letters in favor and 0 calls or letters in opposition of this request. Have received questions regarding the use of this property. One of the residential properties has several port-o- potties stored on the property. Staff review committee met on September 20, 2022. The committee did not have any issues with the application as submitted. Mayor Griego asked Council if they had any questions – none. Mayor Griego ask if there was anyone in the audience who wanted to speak. Ms. Elizabeth DeSherri commented on her concern about the 17 port-a-potties and she also supports the zone change. Mr. Guy DeSherri commented on his concern about the mobile home on tract 3. Mr. Tom Tucker is also concerned about the mobile home. Ms. Janet Tucker is concerned about the parking spaces and its close proximity to the basketball court. Erin expressed that she could not comment or address any of the questions/concerns. The Jaramillo’s were not present nor was there a representative. Mayor Griego asked if there were any more comments – there were none. Mayor Griego asked for motion to close the public hearing and go back in to a Council forum.
