MINUTES VILLAGE OF LOS LUNAS THURSDAY, MAY 25, 2023 The Board of Trustees of the Village of Los Lunas, County of Valencia, and State of New Mexico met Thursday, May 25, 2023, in regular session at 6:00 PM. Roll call was taken and the following were present: Mayor Charles Griego, Councilman Christopher Ortiz, and Councilman Cruz Munoz were present. Councilmen Gino Romero and James Runyon were excused. Meeting was conducted in person and recorded through TEAMS. Mayor: Charles Griego Mayor Pro Tem: James Runyon, excused Council: Gino Romero, excused Christopher Ortiz Cruz Munoz Also present were Debra Sanchez, Gregory D. Martin, Luis Brown, and Craig Donahoe. In accordance with Ordinance 114A, the following agenda was prepared and circulated as required: 1. RESOLUTION 23-07 A RESOLUTION PERMITTING A SPECIAL USE AMENDMENT OF A DISGNATRED AREA WITIN THE MUNICIPALITY OF LOS LUNS, COUNTY OF VALENCIA, STATE OF NEW MEXICO. 2. RESOLUTION 23-09 – FY 2023 INTERIM BUDGET ADJUSTMENT – CREATION OF FUND 46, “LG ABATEMENT OPIOID FUND.” 3. CONTRACTS – REQUEST PERMISSION TO ENTER INTO CONTRACTS WITH INDIVIDUALS. 4. LOS CERRITOS HOMEOWNERSASSOCIATION – REQUEST TO DEDICATE THE LOS CERRITOS DRAIN POIND TO THE VILLAGE OF LOS LUNAS. 5. EXECUTIVE SESSION a) Hire FT Evidence Technician – Police Department. b) Hire FT Facility Maintenance Technician II – Facility Maintenance Division / Parks and Recreation Department. c) Hire FT Park Technician I – Parks Division / Parks and Recreation Department. 8. APPROVAL OF MINUTES: a) Minutes from May 11. 2023, Council Meeting. 9. ADJOURMENT. • CALL MEETING TO ORDER. At 6:00 PM, Mayor Griego brought the meeting to order and welcomed the audience. • PLEDGE OF ALLEGIANCE. Mayor Griego asked Dominic Otero to lead the Council and TEAMS participants in the Pledge of Allegiance. • APPROVAL OF AGENDA. Mayor Griego asked for a motion from Council. Motion to approve. APPROVAL: Motion to approve agenda as presented. MOVED: Councilman Ortiz SECONDED: Councilman Cruz CARRIED: Motion passed on a vote of 2 (Councilman Ortiz – yes; Councilman Munoz - yes) FOR AND 0 AGAINST. Mayor Griego announced that Councilmen James Runyon and Gino Romero was excused from tonight’s council meeting. • PUBLIC INPUT FORUM. None. 1. RESOLUTION 23-07 – A RESOLUTION PERMITTING A SPECIAL USE AMENDMENT OF A DESIGNATED AREA WITHIN THE MUNICIPALITY OF LOS LUNAS, COUNTY OF VALENCIA, STATE OF NEW MEXICO. Mr. Gregory D. Martin presented item one. Requesting item to be tabled until next meeting (item needs full quorum). Mayor Griego asked for a motion from council. APPROVAL: motion to table until next meeting MOVED: Councilman Ortiz SECONDED: Councilman Cruz CARRIED: Motion passed on a vote of 2 (Councilman Ortiz – yes; Councilman Munoz - yes) FOR AND 0 AGAINST. 2. RESOLUTION 23-09 – FY 2023 INTERIM BUDGET ADJUSTMENT – CREATION OF FUND 46, “LG ABATEMENT OPIOID FUND.” Ms. Cheryl Cates presented item two. Pursuant to the New Mexico Opioid Allocation Agreement requirements as directed by memorandum BFB #22-04 issued by the State of New Mexico Department of Finance and Administration. Fund tracks opioid allotments and funds should not be mingled with city funds effective 1/24. Mayor Griego asked for a recommendation from Council. APPROVAL: motion to approve resolution 23-09 MOVED: Councilman Ortiz SECONDED: Councilman Cruz CARRIED: Motion passed on a vote of 2 (Councilman Ortiz – yes; Councilman - yes) FOR AND 0 AGAINST. 3. CONTRACTS – REQUEST FOR PERMISSION TO ENTER INTO CONTRACTS WITH INDIVIDUALS. Mr. Gregory D. Martin asked that this item be tabled until next meeting. APPROVAL: Motion to approve MOVED: Councilman Ortiz SECONDED: Councilman Munoz CARRIED: Motion passed on a vote of 2 (Councilman Ortiz – yes; Councilman Munoz – yes) FOR AND 0 AGAINST. 4. LOS CERRITOS HOMEOWNERS ASSOCIATION – REQUEST TO DEDICATE THE LOS CERRITOS DRAIN POND TO THE VILLAGE OF LOS LUNAS. Mr. Michael Jaramillo presented item four. Los Cerritos HOA is requesting to deed the Los Cerritos drain pond located off Emilio Lopez Road to the Village of Los Lunas. The HOA has provided a survey, TOPO, and evaluation of the drain pond. Pond meets standards. HOA are requesting the Village of Los Lunas to accept the drainage pond in its current condition which includes the parking lot at the nearby park. Mayor Griego asked for a recommendation from Council. APPROVAL: Motion to approve MOVED: Councilman Ortiz SECONDED: Councilman Munoz CARRIED: Motion passed on a vote of 2 (Councilman Ortiz – yes; Councilman Runyon – yes) FOR AND 0 AGAINST. 5. EXECUTIVE SESSION Mayor Griego announced that the Council would be going into executive session pursuant to NMSA 1978 Section 10-15-1(H), the following matter may be discussed in closed session: hiring of a FT Evidence Technician, FT Facility Maintenance Technician II, and FT Park Technician I. APPROVAL: Motion to adjourn into executive session MOVED: Councilman Ortiz SECONDED: Councilman Munoz CARRIED: Motion passed on a vote of 2 (Councilman Ortiz – yes; Councilman Runyon - yes) FOR AND 0 AGAINST. 6:11PM At 6:36PM, Mayor Griego asked for a motion from Council indicating that they discussed the hiring of a FT Evidence Technician, FT Facility Maintenance Technician II, and FT Park Technician I. APPROVAL: Motion to approve MOVED: Councilman Ortiz SECONDED: Councilman Munoz CARRIED: Motion passed on a vote of 2 (Councilman Munoz – yes; Councilman Ortiz – yes) FOR AND 0 AGAINST. Regarding the hiring of a FT Evidence Technician, Mayor Griego put up the name of Erika Saiz/ APPROVAL: Motion to approve MOVED: Councilman Munoz SECONDED: Councilman Ortiz CARRIED: Motion passed on a vote of 2 (Councilman Ortiz – yes; Councilman Munoz - yes) FOR AND 0 AGAINST. Regarding FT Facility Maintenance Technician II – Mayor Griego put up the name of Lorenzo Sanchez. APPROVAL: Motion to approve MOVED: Councilman Munoz SECONDED: Councilman Ortiz CARRIED: Motion passed on a vote of 2 (Councilman Ortiz – yes; Councilman Munoz - yes) FOR AND 0 AGAINST. Regarding the FT Park Technician I – Mayor Griego put up the name of Nikko Baca. APPROVAL: Motion to approve MOVED: Councilman Munoz SECONDED: Councilman Ortiz CARRIED: Motion passed on a vote of 2 (Councilman Ortiz – yes; Councilman Munoz - yes) FOR AND 0 AGAINST. 6. MINUTES. Mayor Griego asked if there were corrections to the council minutes of the May 11, 2023, Council Meeting – there were none. BACKGROUND AND RATIONALE: Dekker Perich Sabatini, acting agent for Huning LLC, has applied for a Special Use Amendment for the Los Senderos Area Plan for the purpose of accommodating the I-25 Morris Road interchange final geometry and required easement dedication and addressing clerical issues, development standards, and street cross sections. The area plan is located south of Lonestar St SW and west of I-25. CHERYL CATES 2. RESOLUTION 23-09 – FY 2023 INTERIM BUDGET ADJUSTMENT – CREATION OF FUND 46, “LG ABATEMENT OPIOID FUND.” TAB 2. ACTION REQUESTED OF COUNCIL: Approve or disapprove. BACKGROUND AND RATIONALE: Creation of new fund 46, “LG Abatement Opioid Fund”. Pursuant to the New Mexico Opioid Allocation Agreement (NMOAA) requirements and as directed by Memorandum BFB #22-04 issued by the State of New Mexico Department of Finance and Administration, Local Government Division. BACKGROUND AND RATIONALE: Village of Los Lunas/Valencia County DWI Program is requesting to enter into: (1) Contract with Program Evaluator for DWI Program Prevention Component, (1) Contract with Enforcement Coordinator, (1) Contract with Program Coordinator for the Youth Success Core/Mentoring program, (1) Contract with Mentor Coordinator for the Youth Success Core/Mentoring program and (1) Teen Center Assistant/Mentor for the Youth Success Core/Mentoring program. MICHAEL JARAMILLO 4. LOS CERRITOS HOMEOWNERS ASSOCIATION – REQUEST TO DEDICATE THE LOS CERRITOS DRAIN POND TO THE VILLAGE OF LOS LUNAS. TAB 4. ACTION REQUESTED OF COUNCIL: Approve or disapprove. BACKGROUND AND RATIONALE: The Los Cerritos Homeowners Association is requesting to deed the Los Cerritos Drainage Pond located off Emilio Lopez Road to the Village of Los Lunas. They have provided a survey, TOPO, and evaluation of the Los Cerritos Drain Pond capacity. With recent storm water drainage pond improvements on the Westside of the I-25 they agree with Anchor Engineering LLC analysis, evaluation, and conclusion. They are requesting the Village of Los Lunas to accept the Los Cerritos Drainage Pond in its current condition which includes the parking lot at the nearby Los Cerritos Park. 5.
