MINUTES VILLAGE OF LOS LUNAS THURSDAY, SEPTEMBER 7, 2023 The Board of Trustees of the Village of Los Lunas, County of Valencia, and State of New Mexico met Thursday, September 7, 2023 in regular session at 6:00 PM. Roll call was taken and the following were present: Mayor Charles Griego, Councilman Cruz Munoz , Councilman James Runyon, Councilman Christopher Ortiz and Councilman Gino Romero. Meeting was conducted in person and recorded through TEAMS. Mayor: Charles Griego Mayor Pro Tem: James Runyon Council: Gino Romero Christopher Ortiz Cruz Munoz Also present were Gregory D. Martin, Debra Sanchez, Luis Brown, Erin Callahan, and Craig Donahoe. In accordance with Ordinance 114A, the following agenda was prepared and circulated as required: 1. ZONING ORDINANCE REVISION UPDATE. 2. EXECUTIVE SESSION a) Discussion – Thirteenth Judicial District Court’s decision reversing the Village’s denial of the designated use permit in the zoning appeal of Pando v. Village of Los Lunas. b) Hire FT Park Technician II – Parks Division / Parks and Recreation Department. c) Hire 2-FT Code Enforcement Officers – code Enforcement Division / Community Development Department. d) Hire 2-FT Solid Waste Laborers – Solid Waste Division / Public Works Department. e) Hire FT Operator in Training – Watewater Treatment Plant / Public Works Department. 3. APPROVAL OF MINUTES: a) Minutes from August 10, 2023 Council Meeting. 4. ADJOURMENT. • CALL MEETING TO ORDER. At 6:00 PM, Mayor Griego brought the meeting to order and welcomed the audience. Mayor Griego announced that Councilman Runyon was excused. • PLEDGE OF ALLEGIANCE. Mayor Griego asked Arianna and Natalie to lead the Council and WebEx participants in the Pledge of Allegiance. • APPROVAL OF AGENDA. Mayor Griego asked if there were any comments regarding the agenda – with that amendment, the Mayor asked council for a motion. APPROVAL: Motion to approve amended agenda. MOVED: Councilman Runyon SECONDED: Councilman Ortiz CARRIED: Motion passed on a vote of 4 (Councilman Romero – yes; Councilman Ortiz – yea; Councilman Runyon – yes; Councilman Munoz – yes) FOR AND 0 AGAINST. • PUBLIC INPUT FORUM. • PROCLAMATION – CHILDHOOD CANCER AWARENESS MONTH. Councilman Cruz Munoz read proclamation. Families of Arianna and Natalie spoke on behalf of childhood cancer awareness. They wanted to bring awareness to the community about childhood cancer and the research funding support they are seeking for this cause. A brief explanation of what the program currently provides for families of children with cancer. Mayor Griego and Council expressed their sincere appreciation and join their support of this deadly disease. Mr. Michael Jaramillo wanted to present an update on the I-25 interchange. The Village has submitted, today, the 90% plan to the New Mexico Department of Transportation for review on the Los Lunas Blvd. project. This project was started in 2014. DOT will take about a month to review the 800+ page document and then meetings will start. Edit will take place in December/January – then will, hopefully, be able to go out to advertise for bids and award somewhere around June 2024. Michael also praised Erin Callahan for all her help. Council gave their comments on the project. 1. ZONING ORDINANCE REVISION UPDATE. Ms. Erin Callahan presented item one. The Village of Los Lunas is revising their zoning ordinance. Consensus Planning gave a brief presentation to Council so that they could discuss and review proposed revisions. This guides property owners as to what they can do on their property and how they can do it. It has been 20 years since it has had a full revision. Erin introduced consultants Jackie Fishman and Char Johnson, who were present. Project was started second half of May – projecting that they will be done in January. Have been meeting with Focus Group and Planning and Zoning and will be scheduling a public meeting sometime in the future. Purpose of zone code update – to create a “user-friendly” zone code that is easier to navigate, understand, and administer. Provide clear and unambiguous language that supports the Village’s goals. Address inconsistencies in regulations, align regulations with NM statutory laws, and replace outdated terminology. Also, promote smart growth goals and modern walkable trends and made the code more consistent with the 2040 comprehensive plan. Code review / evaluation parameters: general structure, readability, clarity, use of terms, construction of code language, organization, relationship to comprehensive plan and other adopted plans, ease of navigation and comprehension, applicability, and enforceability. They created a draft reorganization outline: items that need revision, omissions that should be addressed/updated; conflicts with the comprehensive plan and other adopted plans/policies; and identification of overarching practical issues found through the review of the zoning code. A week ago they delivered a draft of Article 1. Next steps: complete draft revisions and continue meetings. Jacke asked if there were any questions. Mayor Griego commented that the ordinance is not user friendly. Councilman Munoz concurred with the Mayor. (Informational only) 4 .EXECUTIVE SESSION. Mayor Griego announced that the Council would be going into executive session pursuant to NMSA 1978 Section 10-15-1(H), the following matter may be discussed in closed session: discussion – Thirteenth Judicial District Court’s decision reversing the Village’s denial of the designated use permit in the zoning appeal of Pando v. Regarding the discussion/ruling of the Thirteenth Judicial District Court’s decision, after discussion with our attorney, we have decided not to appeal the decision.
