PLANNING & ZONING MEETING
July 3, 2013
The Village of Los Lunas Planning & Zoning Commission met in their regular session on Wednesday, July
3, 2013 at 6:35 pm in the Village Council Chambers. Members present were as follows: Commissioner
Terry Ulibarri, Frank Vigil & Walter Baca. Commissioners Phillip Jaramillo & Stephanie Williams were
absent. Staff members present were Christina Ainsworth & Marie Marquez, Recording Secretary. Josie
Navarrette was absent. Members of the public present were as follows: Eloy Castillo
The Meeting was called to order by: Acting Chairman Frank Vigil
APPROVAL OF AGENDA
Chairman F. Vigil called for any changes or additions to the agenda. Christina Ainsworth asked that Item
2 Comprehensive Plan be deleted for a special workshop being planned. Commissioner T. Ulibarri made
,
a motion to approve the agenda as presented. Commissioner W. Baca seconded the motion. Everyone
voted yes, motion carried.

AGENDA ITEMS: ZONE MAP AMENDMENT ELOY CASTILLO-
COMPREHENSIVE PLAN UPDATE
ITEM 1- ZONE MAP AMENDMENT - ELOY CASTILLO
Chairman F. Vigil introduced Item I, Zone Map Amendment by Eloy Castillo. Mr. Castillo has applied
for a zone atlas amendment from C-I to TOD-MU for Tract B-I Land of Jesus & Francisco Gonzales. The
action requested of this commission is to have a public hearing and send recommendation to Council for
approval or disapproval.
Christina Ainsworth pointed out the parcel on the screen. She said, the request is to rezone from C-I to
TOD-MU. The reason he is requesting rezoning is to place a manufactured home on the property to the
back. In the C-I you cannot do that. It can be done with a conditional use or designated use, but in the
future he has plans to have the commercial zoning closer to the street for a future business. Staff has
recommended that this be approved as per the comprehensive plan. Christina said, notices were sent out to
all property owners within 100 ft. A neighbor next door came in to talk to her but had no opposition. He
just wanted clarification. No other comments received from the public.
Mr. Eloy Castillo was called to come up and briefly state what his plans were. He said, he would very
much like to become a resident of Los Lunas. He said, he would like to park this manufactured home in the
back lot and have a small business in the front. Those are his plans. Chairman F. Vigil asked what type of
business he was planning to put in there? Mr. Castillo said, he would like to sell tractors and cargo trailors.
He said, the property is large enough and he would park them in a very convenient way to be able to move
them in and out, and have the yard landscaped really nice. He said, if approved perhaps he could place a
small office in one of the rooms or perhaps build a small one. Christina said, this is only approval for the
zone map amendment anything else in addition would have to be permitted through the normal permitting
procedures. She did tell Mr. Castillo that he would not be allowed to have the office in the manufactured
home. That is designed for a residential code and in order to have a commercial office, you have to be
compliant with the commercial building code, it would not be feasible. Christina told Mr. Castillo, he
could come in and staff would guide him through the development. The commissioners told Mr. Castillo
you will only be getting approved for the zone change, not the business.
Commissioner W. Baca said, previously there was a trailer and corvette for sale there. He said, is the kind
of business you intend to put in there? Mr. Castillo replied, no when I first bought the property I thought it
was out of the city limits and he didn’t stop to ask questions, so he put up a fence and he thought he was in
the right until he was approached by Code Enforcement that the fence was too high, so he had to lower it.
He had also taken in an RV where he planned to live in so he went ahead and parked it but then Code
Enforcement went and told him he couldn’t do that, so I sold it as well as the car. He also had a utility
trailer but he has it parked in the back. He said, he should of asked questions and he just didn’t have
enough knowledge about all the rules and regulations.
Commissioner T. Ulibarri cautioned Mr. Castillo because of where you’re at, any plans you may have
make sure you’re very specific and must be written down on paper because you will be asked to meet the
code each, and every time. You are so close to the transportation station and that whole area has it’s own
zoning and special uses. There were no further questions. Christina said, Mr. Castillo had been very
cooperative with Code Enforcement.
Chairman F. Vigil called for a motion. Commissioner T. Ulibarri made a motion to recommend to Council
approval of this zone atlas amendment from C-i to TOD-MU for Tract B-l, Land of Jesus Francisco
Gonzales and the findings will be that: It’s accordance with the Village of Los Lunas Comprehensive Plan
and Municipal Code. Commissioner W. Baca seconded the motion, everyone voted yes, motion carried.
ITEM 2 - APPROVAL OF MINUTES June 19 , 2013
Chairman F. Vigil called for any questions or amendments to the minutes. He then called for a motion to
approve the minutes for June 19, 2013. Commissioner W.. Baca made a motion to approve the minutes
for June 19, 2013 with an amendment as presented. Commissioner T. Ulibarri seconded the motion.
Everyone voted yes, motion carried.
ITEM 4- DISCUSSION
Community Activity Report Christina reported that interviews were done this week for the Planning
—
Tech position. There were 31 applicants, which are now narrowed down to 8. Hopefully, by next week
Council will hire one. The other thing that has happened is the building plans for Apple Bees have been
received. Chairman F. Vigil also mentioned that the Twilight homes is coming to LL and their models
grand opening will be on Friday, August 2 at 4:30 All Village of LL officials will be invited. Christina

said, she would get all the details from Ralph and send an email. This is a Max Kiehne development. She
said, there are other developers interested in buying other lots in LL.
Code Enforcement Issues - Christina told the Commissioners that Community Development Department
has been short of help due to one of the Code Enforcement Officer’s wife who has been quite ill, but doing
better.
ITEM 5- ADJOURNMENT
Chairman F. Vigil called for a motion to adjourn. Commissioner T. Ulibarri made a motion to adjourn.
Commissioner W. Baca seconded the motion. All voted yes, motion carried.
