MINUTES PLANNING & ZONING MEETING December 3, 2014 The Village of Los Lunas Planning & Zoning Commission met in their regular session on Wednesday, December 3, 2014, at 6:00 pm in the Village Council Chambers. Members present were as follows: Commissioners Stephanie Williams, David Crawford, Terry Ulibarri & Walter Baca. Commissioner Frank Vigil was absent. Staff members present were Christina , Ainsworth, Community Development Director, Nathaniel Feddes, Special Project Planner and Marie Marquez, Recording Secretary. Members of the public present were as follows: Dominic Jaramillo, Whitney Andrews, Gerald & Darlene Jaramillo and Nancy Jaramillo. The Meeting was called to order by: Chairman Stephanie Williams APPROVAL OF AGENDA Chairman S. Williams called for any changes or additions to the agenda. Commissioner T. Ulibarri made a motion to approve the agenda as presented. Motion was seconded by everyone. Everyone voted yes, motion carried, SWEARING IN OF PARTICIPANTS AGENDA ITEMS: CONDITIONAL USE- Dominic Jaramillo ITEM 1 -CONDITIONAL USE- Dominic Jaramillo Chairman S. Williams introduced Item 1- The action requested of this commission is to have a public hearing to recommend approval or disapproval of the request for this Conditonal Use. Chairman S. Williams called on Nathaniel Feddes to present the item. Nathaniel Feddes said, Dominic Jaramillo has submitted a request for a Conditional Use Permit for S:28 T:7N R:2 MRGCD TRACT 97 A-i-B 11.65 AC, located at 267 Courthouse Rd SE. The property is located in District 4, and the request is for the purpose of an automotive repair shop. The current zoning is C-i and the future land use map shows the property as a commercial use. This property does fall within the Village as proposed TOD district. Nathaniel said, to date we have had one phone call asking questions and expressing concern about the application. After he explained it to the individual she was ok and was not in opposition to the request. It is the finding of the Community Development Department that the intended use is a supplementary use and must then adhere to the conditions as set forth in section 17.44.140 and .150. They are as follows: 1) all activities should be conducted within a completely enclosed building 2) there should not be storage of more than 8 automobiles provided that the outdoor area in which cars are stored shall be enclosed by a solid wall or fence and must be at least 6 ft in height and, 3) the minimum ground area of 8 ft x 20 ft. shall be required for each vehicle stored 4) all service stations will erect a solid masonry wall at least 6 ft. high between the activities and any contiguous residential use. Those are the requirements set forth for automotive repair shops. Staff does recommend approval of the Conditional Use Permit provided that the conditions mentioned are met and any of the conditions the Commission may require. Chairman called for any questions from the Commissioners. Commissioner D. Crawford asked, if there was an existing 6 ft. fence between the apartments and the proposed property? Nathaniel made some clarifications to avoid confusion. He said, he was out there today doing a site analysis and on the eastside of the lot there is chain link fencing and, on the southeast corner there is no fence. Chairman S. Williams called on Dominic Jaramillo to come up and state the purpose of his request. He said, he spoke to the owner since he will be leasing it for a year. He pointed out the area and fencing. He said, he has spoken to Joe Cordova, owner of the property and he has agreed to put up a fence straight across if needed which he plans on doing just in case he does store automobiles outside. He was asked for the number of vehicles that would fit in the building? He replied, approximately 3 or 4. He was also asked about the lighting? He said, yes there is lighting, heating and air conditioning. On the outside there is on the parking area. There is also handicap accessible parking. He does plan on putting up motion lights and cameras to limit any trespassing or theft incidents. Chairman also asked him if staff had mentioned all the requirements he is adhere to? Chairman S. Williams asked if chainlink or picket fence was ok? Christina Ainsworth said, no it must be a solid masonry 6 ft wall. Chairman S. Williams told Dominic you understand that you will have some expense there to be able to meet these requirements. Dominic said, There is no issues there, I can do that”. Commissioner T. Ulibarri told Dominic, you know you are going to have more than 3 cars. If you are going to do some real mechanic work, you will have to fence that area right. Commissioner Ulibarri said, you are going to have problems there because of the residents behind. They raise their children there and they want piece of mind. What hours will you be operating? Dominic said, I plan to operate Monday-Friday, 8 to 5 if needed I will extend it to 6 p.m. I have spoken to all the neighbors around and they are in agreement. Commissioner T. Ulibarri wished him well and told him it was good to be a good businessman. He also asked him about signage? He said, there was already an existing sign and he will have a sign on his building so they told him to make sure he gets approval before with Village Officials. Commissioner W. Baca also asked about prior businesses surrounding the area? He had concerns about the childcare business in the area. But that was clarified as being housed in the first building. He also had concerns about the noise in the area, since there are residents living in the area. Since it was a garage before I guess its ok. Chairman S. Williams called on further comments from the public. Mr. Gerald Jaramillo, Dominic Jaramillo’s father. He said, Dominic is well respected in the community and has worked in various places and does well. He said, he would be a good asset to the community. There no further comments. Chairman S. Williams then called on anyone who would like to speak in opposition. There were no comments. Chairman S. Willians then called for a motion to approve or disapprove this Conditional Use Permit. Commissioner T. Ulibarri made a motion to accept Dominic Jaramillo’s application for a Conditional Use Permit for the purpose of opening his brand new automotive shop located at 267 Courthouse Rd. SE. The staff comments that storage is not more than 8 automobiles, the outdoor area has to be fenced with a solid wall, lighting must be adequate, ground area of 8 ft. between automobiles, and all services within the enclosed building. It can get junky real fast, so be aware of that. This conditional is approved ONLY for the back building. Commissioner W. Baca seconded the motion, all voted yes, motion carried. ITEM 2—APPROVAL OF MINUTES — Minutes of November 5, 2014 Chairman S. Williams called for a motion to approve the minutes 11/5/14. “ er D. Crawford made a motion to approve the minutes as presented for November 5, 2014. Commisioner T. Ulibarri seconded the motion. All voted yes, motion carried. ITEM 3-DISCUSSION Community Development Activity Report Christina Ainsworth gave a brief report on the progress of the new business Buffalo Wings Restaurant which is due to open by Super Bowl Sunday. She also mentioned the status of the Merrilat Building that is vacant at the moment, they have been notified that they will be placed back on the tax roles, since they are in default of their revenue bond. Their respond was that they are selling the building. Options are currently to give them more time to sell. It has not been determined. Code Enforcement Issues — Christina told Commissioner Crawford that the issue he was concerned about, the old mail box concrete pad. She passed it on the officials, It can be removed or a bench could be placed there, but it is being taken care of. ITEM 4- ADJOURNMENT Chairman S. Williams called for a motion to adjourn.
