Goal: 1.7: Implement zoning policies that achieve a desirable mix of different land uses and densities, preserve existing neighborhood character, and respect the rights of private property owners. B. Goal: 4.2: Continue to support a diverse mix of economic development and employment opportunities that balance social, economic, and environmental values and goals. The application for zone change should be in accordance with §17.40.010 and Chapter 17.60 of the Municipal Code. B. O na ACTION ON CONDITIONAL OR DESIGNATED USE PERMITS nl l In considering whether to approve an application for conditional use or designated use permits, the authorizing board shall proceed according to the following format: y Fo 1. The permit authorizing board shall consider whether the application is complete. If no member moves that the application be found incomplete then this shall be taken as an affirmative finding that the application is complete. 2. The permit authorizing board shall consider whether the application complies with all of the applicable requirements of this title. If a motion to this effect passes, the permit authority need not make further findings concerning such requirements. If such a motions fails or is not made then a motion shall be made that the application is found not in compliance with one or more of the requirements of this title. 3. If the permit authority concludes that the application fails to comply with one or more requirements of this title, the application shall be denied. If the permit authority concludes that all such requirements are met, it shall issue the permit unless it adopts a motion to deny the application for one or more of the reasons set forth in Section 17.16.010(C)(4) through (C)(6). SE Derrick Archuleta of Arch + Plan Land Use Consultants, acting agent for Virginia Otero Sonia Walker presented the case Special Use Amendment 21-1-R 6 Edeal Rd. SE. The applicant o was Arch & Plan Land Use Consultants. The property owner was Virginia B. Otero. The property has a legal description of Subd: Land of Ed Mccarty Tract: C2A2B (1.37 AC) & Tract C2B1 (0.73 O na AC) Total 2.10 Acres Map 72. The request is for a Special Use Amendment to change the zone from MH to SU. nl l The property is in Council District 4. It is in a FEMA flood zone of AE (SFHA) which is subject to the 1% flood. Surrounding zoning and land use are: to the North R-1, single family residential M-H y Fo and vacant; to the south, Valencia County Zoning, Residential; to the east C-2, vacant; and to the west, M-1, RV Park. The Notice of the Public Hearing was mailed to all adjacent property owners and published in the Valencia News-Bulletin on March 18, 2021.The Development Review Committee received one phone call and letter in opposition of the request. Ms. Veronica Chavez stated the documentation in the packet was illegal, proper notice was not given, and believed the hearing should be delayed. Notice of Public Hearing was sent per Municipal Code17.64.040 and was compliant. The current mobile home park has operated as a legal non-conforming use. Per Municipal Code 17.32.040, when the non-conformance is a mobile home, the nonconforming use is extended only to the life of that particular mobile home. In order to continue operating as a true mobile home park, the zoning should be SU and not MH, per municipal code. The Development Review Committee met regarding the application on March 9, 2021 and had the following comments: P & Z 04/07/2021 - Coordination would be needed with the Public Works Department regarding improvement to the dumpster to meet current standards. - At the time of development, an updated drainage review would be required to ensure compliance with Village of Municipal Code 15.20.030 - Drainage Plan - Criteria. S. Walker stated Ms. Otero is in communication with the Public Works Department. r Based on the Village of Los Lunas Municipal Code and Comprehensive Plan, the Community Development Department recommended approval of the special use amendment. Pu In S. Walker stood for questions. f Chairman A. Gomez asked S. Walker if anyone from Code Enforcement visited the site and if they rp or identified any issues. S. Walker confirmed Code Enforcement went to the site but deferred the question to E. Callahan. Callahan explained Code Enforcement had been to the site numerous times in routine patrol and had received complaints about vegetation, potential pesticide sprays, and RVs os m being parked at the site. She explained if ever a deficiency or a concern, Code Enforcement issued a notice of violation to alert the property owner, Ms. Otero, to address the concern. The zone change application came out upon Code Enforcement’s review of RVs parked at the property which led es ati them to research the zone designation that came in when the property was annexed. Per Village of Los Lunas Code, RVs are not to be used as a permanent residence. Chairman A. Gomez asked if there were further questions from the commission. o There were no further questions. O na Chairman A. Gomez opened floor to Derrick Archuleta. D. Archuleta, acting agent for Ms. Otero, confirmed that as staff stated, the request was for a zone nl l change from mobile home to special use on 2.1 acres. He explained the zone change application request was the first step in addressing and achieving the correct zoning for the property; reflecting the existing land use through the special use amendment for a mobile home park. Archuleta y Fo informed the commission that the mobile homes on the property had been operating as a legal non- conforming use since the property’s annexation into the village over thirty years before. When the applicant purchased the property in 1984, it reflected the same land use. The applicant had worked with village staff on the site plan and would continue to do so to achieve standards and requirements necessary. Archuleta concluded, the zone change would be more advantageous to the community with a special use zone for a mobile home park as reflected in analysis compliance with policies and municipal code achieved. D. Archuleta stood for questions. Commissioner B. Romero asked property owner, V. Otero, if there were any complaints from current owners of trailers and how many tenants total were on the property. V. Otero explained she had a total of twelve tenants but there were only complaints from one tenant, Veronica Chavez. Chairman A. Gomez asked V. Otero for the specific complaints. Otero responded the zone change application request started because of V. Chavez’s complaints about the RVs on the premises. Otero P & Z 04/07/2021 elaborated there were over two-hundred police reports from Chavez that included complaints about nats, people knocking on her windows, slashed tires, and several other grievances. Otero concluded the Village of Lunas Lunas staff was very familiar with Chavez and her protests. Commissioner B. Romero asked V. Otero if there would be increased security measures with the increase of tenants. Otero advised there would not be an increase in security measures. Commissioner A. Gomez asked if there were any further questions or discussion from the commission. There were no questions or further discussion from the commission. r Commissioner A. Gomez opened the floor to the public. Pu In Veronica Chavez introduced herself as one of the tenants at the premises. She explained she was not in favor of the zone change due to Virginia Otero’s hostile negligence, which she felt violated f federal building codes. According to Chavez, the property was not two acres and there were thirteen rp or mobile homes at the property. She stated there was continuous water, plumbing, electrical, and gas issues. V. Chavez felt strongly that Otero was in violation of the federal building codes. Chavez continued there was no lighting or security measures in place and she was seriously stressed due to os m those conditions. She also stated she was not given proper notice to the zone change application meeting. es ati Chairman A. Gomez gave V. Otero an opportunity to speak. Otero explained V. Chavez’s statements were not true. As she stated previously, there were over two-hundred police reports made by V. Chavez because any time V. Chavez has a complaint, V. Otero does contact the police. V. Otero explained that although Chavez was unhappy where she lived, she refused to move. o V. Chavez tried to respond but Chairman A. Gomez explained there would be no back and forth and O na he would not permit personal attacks because that was not what the meeting was about. Chairman A. Gomez asked if there were any questions from the commission. nl l Commissioner B. Romero asked E. Callahan if Code Enforcement had found any violations or reoccurring issues. Callahan explained there was a violation with the RVs parked at the location and y Fo the zoning was not compliant with Village standards and regulations, which was the reason for the zone change application. The zone change application meant V. Otero was not allowed to bring any additional homes to the park unless zoning allowed for it. A number of other complaints such as fire hazard concerns, chemicals, water seepage, insects, and pesticides had been submitted but no violations had been found from Code Enforcement, the Environment Department, or the Fire Department. Chairman A. Gomez asked if there were further questions or discussion from the commission. There were no further questions or discussion. Chairman A. Gomez called for a motion. Commissioner B.
