Special Meeting Minutes
Special Meeting (Vice Chair Rourke)
Date: August 31, 2017
Time: 7:00 PM
Location: City Council Chamber, 375 Merrimack Street, 2nd Floor, Lowell, MA
1. ROLL CALL
1.1. Purpose: Request the City Manager and the Law Department seek a
declaratory judgement regarding the City Council's authority to select the site of
the new Lowell High School.
Roll Call showed 9 present.
Mayor Kennedy presiding.
In City Council, M. Kennedy noted the purpose of the meeting. Motion by C. Rourke,
seconded by C. Mercier to request the City Manager and the Law Department seek a
declaratory judgement regarding the City Council's authority to select the site of the new
Lowell High School. C. Rourke noted filing of suit this day and that there would be
preliminary hearing on matter on September 12, 2017 and further noted that there had
been no formal service upon the City and noted the need to move quickly on the matter.
Motion to amend language to indicate action should be taken regarding declaratory
judgment if City is not served on or before September 7th. Roll Call on motion to amend
8 yeas, 1 abstain (M. Kennedy). So voted.
Motion to adopt as amended by C. Rourke, seconded by C. Mercier. Adopted per Roll
Call vote 8 yeas, 1 abstain (M. Kennedy). So voted.
M. Kennedy noted that the Council had received a courtesy copy of complaint. C.
Rourke noted that there had been no service. C. Leahy noted need for all parties to
come together on issue.

2. ADJOURNMENT
In City Council, Motion to Adjourn by C. Rourke, seconded by C. Milinazzo. So voted.
