Geary outlined the project and the need for the zoning change and noted the Planning Board in a separate hearing recommended approval of the change. Donna and Gerard Barns spoke in favor of the petition indicating that the information provided was informative. Jeff Thomas spoke in favor of the petition indicating the project would benefit the City. C. Scott questioned the zoning change. Atty. Geary responded noting the history of the project and the zoning districts involved. C. Yem noted efforts of the developer. C. Nuon noted it was a good project in the final stages. 5. UTILITY PUBLIC HEARING 5.1. National Grid - Request installation of (1) SO Pole on Hayes Avenue. In City Council, Given 2nd Reading, Hearing held. Gitschier requested a quick response so if there are needs, they can be met and start moving forward. 6.2. C. Gitschier - Req. City Mgr. provide the City Council with the last three years of fire hydrant inspections done by the Lowell Fire Department during their annual inspections. In City Council, seconded by C. Gitschier noted the facility needs some upkeep and should be included in an MSBA project. 6.5. C. Nuon - Req. City Mgr. reach out to our state delegation urging them to support HD.326-An Act to Modernize Funding for Community Media Programming. In City Council, seconded by C. Chau - Req. Mayor proclaim April 17, 2025, as Cambodian Genocide Remembrance Day to recognize the 50th Anniversary of the fall of Cambodia. Mr. Chiemruom noted the history of the genocide and Ms. Theam noted many upcoming events surrounding the recognition. Registered speaker, Rep. Tara Huang (comment – noted the many sufferings encountered) addressed the Council. C. Nuon noted prior proclamations and noted the need to honor and pray for those who passed and their families. C. Yem noted it was the 50th anniversary. C. Chau commented how the event effected all people. C. Mercier commented on trip to Cambodia and the respect it should be given. C. Scott noted the importance of the recognition. C. Belanger commented on the many events involved with the anniversary. M. Rourke noted the City would take all efforts to put forth events. Motion by C. Gitschier, seconded by C. Robinson to take Item #6.10 out of order. So voted. 6.7. C. Robinson - Req. the City Mgr. consider working with the proper departments to coordinate cleanup efforts in our business districts utilizing workforce, volunteers, and Public Works resources for Spring thaw, cleanup efforts. In City Council, seconded by C. Scott, referred to City Manager. So voted. 6.9. C. Robinson - Req. the City Mgr. have the proper department examine our ordinance S 104-3 Kennels and provide any recommendation on possible adjustments to assist the pet grooming small business community operating in our city. In City Council, seconded by C. Mercier, referred to City Manager. So voted. Registered speaker, Mackenzie Van Camp (comment – questioned current ordinance), addressed the Council. C. Robinson noted the possible need for ordinance change to protect small businesses. C. Jenness noted state law is in conflict with ordinance and that regulations regarding dog daycare are important, but ordinance should allow enough dogs to support businesses. C. Jenness requested letter be sent to delegation regarding pending state law for kennels and daycare. C. Mercier requested the ordinance be amended. City Solicitor Williams noted that ordinance change would be appropriate. Motion by C. Robinson, seconded by C. Mercier to have Law Department amend ordinance regarding regulation of dog daycare and kennel use. So voted. Manager Golden, Jr. noted the administration has a direction for this solution. C. Gitschier noted the need to distinguish from a dog daycare and a kennel. C. Scott noted the need to be specific with dog daycare and also any language requiring collars in the facility should be eliminated. M. Rourke noted the City will address the issues. 6.10. C. Robinson/C. Gitschier - Req. the City Mgr. have the proper department explore drafting a “Construction Employment” ordinance similar to the Town of Billerica’s bylaw Article XX. In City Council, no second needed, referred to City Manager. So voted. Registered speakers, Amie Searles (comment – supports legislation); Jeff Thomas (comment – good idea for the City); and Tim Collins (comment – noted benefits of residency program), addressed the Council. Mr. Burroughs noted the improved quality of life due to residency requirements. C. Robinson noted a local element was beneficial especially with apprentice programs. C. Gitschier noted the most qualified local resident should be employed. C. Belanger noted he was a proponent for local hiring. C. Scott noted the benefits to the economy for local hiring. C. Mercier noted her experience with local hiring. 6.11. C. Yem - Req. City Mgr. Have The Appropriate Department Plan An Event In Conjunction With TUSKEGEE AIRMEN COMMEMORATION DAY in honor of the Tuskegee Airmen. In City Council, seconded by C. Scott, referred to City Manager. So voted. Registered speaker, Jacquelynn Coates (comment – noted the importance of the event and read a statement into the record), addressed the Council. C. Yem noted the importance of the remembrance and the information he was provided by Ms. Coates. 6.12. C. Yem - Req. that the City Mayor Prepare a Proclamation Dedicating the Fourth Thursday in March as TUSKEGEE AIRMEN COMMEMORATION DAY every year. In City Council, seconded by C. City Mgr. provide report outlining structural inspections performed on all city owned parking garages in the past 24 months, or any other inspections or activities undertaken with regard to falling concrete in multiple garages. Scott - Motion to rescind the Jan 14th 2025 vote to demolish the Smith Baker Center for the specific purpose of issuance of RFP with strict time and financial parameters. In City Council, no second needed, referred to City Manager. Adopted per Roll Call vote 9 yeas (C. Chau, C. Descoteaux, C. Jenness, C. Mercier, C. Nuon, C. Robinson, M. Rourke, C. Scott, C. Yem), 2 nays (C. Belanger, C. Gitschier). So voted. Registered speakers, Bruce Macaulay (comment – give opportunity to restore); Julie Winslow (comment – restore as once things are gone, they are gone); Dennis McCarthy (comment – develop and RFP); Jay Mason (comment – noted energy in the building); Ianna Hondros McCarthy (comment – need to be use as a community center); and Dori Alexandropoulos (comment – could be community event center) addressed the Council. Motion by C. Descoteaux, seconded by C. Mercier to allow former director of the Lowell Philharmonic Orchestra to address the Council. So voted. The former director noted site once housed the orchestra and could be done again. C. Descoteaux noted the need to rescind the vote as prior motions failed and that there must be a very specific RFP with strict time and money restraints. C. Scott noted was not present at vote to demolish but would not support that and that one more chance should be attempted to save the building. C. Jenness noted he was hopeful to save the building but not very optimistic of that and that huge expenses are now associated with the site. C. Jenness noted all processes must be quick as the site poses a big safety and liability risk for the City. City Solicitor Williams noted time frame for a new RFP. Yovani Baez-Rose (DPD) commented that there is time involved after the RFP is executed. C. Jenness noted that demolition time frame must be streamlined. Ms. Baez- Rose noted that there is a hazardous materials assessment being done. C. Robinson noted that the demolition process and the RFP process can run together so that time is not burned. C. Chau noted this would be the final chance to save the building. C. Gitschier noted that the RFP must be opened to all and not tailored to a specific group. C. Mercier noted votes can change and RFP can be given another a chance. C. Nuon noted conflict with RFP and that it needs to fit the situation of the site. C. Belanger noted building is not safe and has been neglected for some time. C. Belanger noted prior RFP was not beneficial and stalled the process. C. Descoteaux/C. Scott - Req. that the City Mgr. work with the appropriate city departments and stakeholders to develop and implement a monthly parking garage permit program for the downtown businesses. In City Council, no second needed, referred to City Manager. So voted. Registered speakers, Sarah Quigley (comment – noted issues for employee parking); and Shannon Arenburg (comment – effect on small business and need to lower amount needed for discount), addressed the Council. C. Scott noted that employees parking in garages open spaces on the streets. C. Descoteaux noted the concern of business owners. Manager Golden, Jr. commented the need for more flexibility in the rates. C. Belanger noted that relief was needed in the area. C. Jenness noted prior discussions regarding flexibility in the rates. C. Mercier noted the need to open street spaces. C. Gitschier noted many businesses have reached out. C. Robinson commented that small business should be in a position to extend benefits to their employees. C. Nuon noted the City must address small business needs. Motion by C. Scott, seconded by C. Scott - Req. the City Mgr. to provide an update on the odd/even street sweeping pilot program and ensure the FY2025 street sweeping calendar is posted as soon as possible, allowing residents to move their vehicles to help maintain cleaner streets. Informational Report - WinterFest Informational 2025 – Peter Crewe (Special Events) noted the report on the event and suggested he could be reached for questions.
