Minutes of meeting of the License Commission held Thursday, August 23, 2012, convened at 6:30 p.m. in the nd Council Chamber, City Hall, 2 floor, 375 Merrimack St., Lowell, MA 01852 Present: Commissioner Brian Akashian, presiding, Commissioner Denis Teague, and Capt. Jonathan Webb of Lowell police dept. Absent: Commissioner Walter Bayliss Applications for special one-day licenses for malt beverages& wines only Stanley Trzcienski, Corey Belanger, Jeff Prescott, Mike LaChance, Dan Berube, John Dyson, Ed Cyrus Mr. Trzcienski stated in response to question from Commissioner Akashian that the event is the third time [in as many years]. When asked by Commissioner Akashian, Corey Belanger stated there will be a relocation of the Beer Fest Commissioner Akashian stated to the applicants that the license is in your name, suggesting that they exercise caution, and if necessary call the local police, to have the main telephone number listed on their cell phones. Commissioner Teague asked several questions of Mr. Trzcienski as to location, hours for the sale/service of beer and wine, and the close proximity of Fletcher St.. Mr. Trzcienski stated that the softball tournament will be comprised of about 63 participants [teams], play will take place at the North Common [adjacent to Fletcher St.]. Commissioner Teague asked what time play was to start; Mr. Trzcienski stated 9 a.m.; Commissioner Teague expressed his concern of there being alcohol available at 9 a.m., probably 11 a.m. Commissioner Teague made the motion that the hours to allow for sale and service be 11 a.m. to 6 p.m.; second by Commissioner Akashian, so voted Commissioner Teague addressed Corey Belanger about the location of the Lowell Beer Fest. Mr. Belanger stated that there will be an area set-off for alcohol with a gate, security people, police officer, and rescue control present. Motion by Commissioner Teague, second by Commissioner Akashian to approve applications of Stanley W. Mr. Borba stated that he is Vice President [Holy Ghost Society] when asked by Commissioner Akashian of his official capacity with the non- profit organization. Commissioner Akashian noted that some of the events are 2 a.m. Mr. Borba stated that last call is 1 a.m.; everyone is out-of-the building by 2 a.m. Commissioner Teague noted the close proximity of a residential area. Commissioner Akashian addressed the history of outdoor amplification; the use of a sound meter in the adjacent parking lot. The Commission reviewed the applications for special events permit for amplified outdoor public entertainment: Lydia Sisson, Mill City Grows, c/o YWCA of Lowell, sound system for music, film, Mill City Grows Fall Harvest Festival, Saturday, September 29, 2012, 2:00 p.m. to 7:00 p.m., Rotary Park Garden @ 22 Richmond Avenue Michael Cavaleiro of MC restaurants, Inc., d/b/a Cavaleiro’s Restaurant, 573 Lawrence St., sound system for band, patio of Cavaleiro’s Restaurant, Sat., August 25, 2012, 8 p.m. to 12 midnight Lydia Sisson and Michael Cavaleiro were present. Commissioner Akashian cautioned each applicant that the permit is a common sense license, those residents who are not present for the scheduled activities may have problems with the amplified sound. Motion by Commissioner Akashian, second by Commissioner Teague, it was voted to approve a special events permit for Lydia Sisson of Mill City Grows and Michael Cavaleiro of Cavaleiro’s Restaurant. Minutes for August 23, 2012, page 2 of 3, License Commission The Commission reviewed the application for change of manager for the all alcoholic beverages Club licensee Social Club of Pawtucketville Lowell, Massachusetts, premises at 123 University Ave. William B. Welch of Hudson, NH is the proposed new manager. William Welch was present. Mr. Welch stated that he is T.I.P.S. certified. He is employed with the Lowell Housing Authority as an inspector; has worked part time as a server for Aramark at the Tsongas Arena, and at the UMass Lowell Inn and Conference Center. Commissioner Akashian asked if the Social Club of Pawtucketville maintains a sign-in book for members and guests; Mr. Welch stated yes, as well as a buzzer in response to question from Commissioner Teague. The club has 315 members according to Mr. Welch. There is a City parking lot across the street [University Ave.] which is accessible to club members. Motion by Commissioner Akashian, second by Commissioner Teague, it was voted to approve William Welch as manager of record for the Social Club of Pawtucketville Lowell, Massachusetts. Commissioner Akashian advised Mr. Welch that the A.B.C.C. must also approve the application for change of club manager.
