Lowell License Commission minutes for meeting, Thursday, March 14, 2013 at 6:30 p.m., Council Chamber, 2nd

Present: Brian Akashian, Commissioner (Chairman), Christy Delaney, Commissioner, Cliff Krieger, Commissioner,
Captain Jack Webb of Lowell police department, Elliott Veloso, Asst. City Solicitor
Commissioner Krieger motion to approve minutes for meeting February 14, 2013, second Commissioner Akashian,
so voted.
The Commission reviewed applications for public amusement licenses from Thomas McKay - Mill City
Management, Inc., for Show to be held at the Lowell Memorial Auditorium, 50 East Merrimack St., entertainer
Louis CK – Comedian, for Tuesday, March 26, 2013, 7:30 p.m. to 11:00 p.m., AM Productions, promoter. Kira
Waltz, MCM representative present. Motion to approve C. Krieger, second C. Delaney, so voted;
License application from Dean & Flynn Inc., d/b/a Fiesta Shows of Seabrook, NH, John A. Flynn, representative,
for Fiesta Shows Carnival to be held at Regatta Field, Pawtucket Boulevard, beginning Thursday, May 23, Friday,
May 24, 2013 - 6 p.m. to 11 p.m.; Saturday, May 25 - 1 p.m. to 11 p.m.; Monday, May 27 to Friday, May 31, 2013 - 6
p.m. to 11 p.m.; and Saturday, June 1, 2013 - 1 p.m. to 11 p.m. Commissioner Akashian asked Mr. Flynn how many
years has Fiesta Shows had the carnival; Mr. Flynn stated 27 years; motion to approve C. Delaney, second by C.
Akashian, so voted.
The Commission reviewed special one-day license applications for malt beverages & wines only, or either one from
Rev. Raymond P. Benoit of St. Margaret Parish [present], for the following events:
Dinner dance at Sacred Heart Hall, St. Margaret Parish, 374 Stevens St., Saturday, April 6, 2013, 6:30 p.m. to 11:00
p.m., and the 2013 Distinguished Graduate Award Dinner to be held at the John J. Nangle Hall at St. Margaret
School, 486 Stevens St., Saturday, April 27, 2013, 6:00 p.m. to 8:30 p.m. Motion to approve C. Delaney, second C.
Krieger, so voted.
The Commission reviewed the application for special event permit for amplification of sound by Jon Cheam of the
Clemente Park Committee, sound system for band, public address at the Annual Cambodian New Year Celebration,
Saturday, April 13, 2013 with a rain date Sun., April 14, 2013, hours for the amplification are from 12:00 noon to
8:00 p.m., at the Pailin Volleyball Complex at Clemente Park. Jon Cheam was present. Commissioner Akashian
informed Mr. Cheam to keep the sound within reason. Motion to approve C. Delaney, second C. Krieger, so voted.
The Commission reviewed the application for Second Hand Articles license by Edward Ramirez Grullon, d/b/a
New to You, 244 High Street. It was continued from the meeting of February 28, 2013. Licensee at present is Angel
A. Kuilan, d/b/a New-To-U Thrift Store. Edward Grullon and Angel Kuilan were present. Mr. Kuilan stated that
he and Mr. Grullon spoke to police officer who is fluent in Spanish about the rules and regulations; Captain Webb
confirmed that Detective Kelly stated the meeting did take place. On a motion by Commissioner Delaney, second
by Commissioner Krieger, it was voted to grant a Second Hand Articles license to Edward Ramirez Grullon, dba
New to You, for premises at 244 High Street, vote: ayes – C. Delaney, C. Krieger, and C. Akashian.
The Commission reviewed two communications from the Alcoholic Beverages Control Commission; the first
regarding the application for change of manager for the Lowell Post No. 87 of the Dept. of Massachusetts The
American Legion Inc., 684 Westford St.; said application approved by the License Commission on December 20,
2013 was returned by the ABCC, having taken no action because “Licensee is listed as revoked under the Secretary of
State’s Corporations Division.” The Commission discussed having the licensee manager appear at the next meeting,
a motion [C. Akashian] to that affect for consideration, but Asst. Solicitor Veloso introduced for discussion seizing
the Club’s liquor license because the licensee is not a “legal entity.” Captain Webb stated when asked by the
Commission that there had been no recent problem [by the American Legion]. Following discussion, Commissioner
Akashian amended his motion that the liquor license granted and issued to Lowell Post No. 87 of the Department
of Massachusetts The American Legion (Inc.) for 2013 be suspended, and seized forthwith by Lowell police, and
said suspension shall remain in effect pending revival of the corporation, a revival certificate to be issued by the
Secretary of the Commonwealth, second by Commissioner Krieger, vote: - ayes C. Akashian, C. Krieger, and C.
Delaney.
The Commission ordered the communication about the Portuguese American Center, Inc., 59 Charles St., issued a
notice of hearing for Tuesday, April 23, 2013 to be placed on file.
On a motion by Commissioner Akashian, second by Commissioner Delaney, it was voted to adjourn the meeting at
6:55 p.m., respectfully submitted: Ryan Wynn, Executive Secretary [present at meeting].
