Corrections were submitted by Commissioner Krieger, and Asst. Solicitor Veloso, to wit: page 6, line 11, strike Chairman Veloso, and insert Chairman Descoteaux; furthermore, page 6, line 16, delete the following Asst. Solicitor Veloso stated sale of the establishments is proposed in lieu of disciplinary [hearings]. Asst. Solicitor Veloso denied having made the statement. Motion by Commissioner Krieger to amend minutes as noted, second Commissioner Hogan, so voted. Commissioner Krieger made the motion, second by Commissioner Hogan, to approve amended minutes, so voted. The Commission reviewed applications for public amusement licenses for concert from Global Spectrum, LP, Keith Vaske, General Manager, at Lowell Memorial Auditorium; 50 East Merrimack St. Mr. Vaske was present. Sweet Adeline’s Rising Star, Saturday, August 2, 2014, 3 p.m. to 7 p.m. Dance for Peace, Wednesday, August 6, 2014, 5 p.m. to 10 p.m. On a motion by Commissioner Krieger, second by Commissioner McCarthy, to approve public amusement licenses for Global Spectrum, LP for events August 2 and August 6, 2014 at Lowell Memorial Auditorium, so voted. On a motion by Chairman Descoteaux, second by Commissioner Krieger, to place the following application at the end of the agenda: Special one-day license application to sell and/or dispense malt beverages & wines only, or either one by Eric Finn of Finn’s Pub, for enclosed outdoor area adjacent to 76-86 Merrimack Street, during Lowell Folk Festival weekend, July 25-26-27, 2014, hours: Friday, July 25, 6 p.m. to 12 midnight; Saturday, July 26, 12 noon to 12 midnight; Sunday, July 27, 12 noon to 6 p.m., so voted. The Commission reviewed the application for special events permit for amplified outdoor public entertainment from Blue Shamrock, Inc., Nicholas Petrakos, 105 Market Street, for sidewalk seating area at 105 Market Street, corner of Palmer St., July, August, September 2014 for live music, d. j., and radio. Mr. Petrakos was present. The Commission reviewed the application for special events permit for amplified outdoor public entertainment from Eric Finn of Finn’s Pub, for enclosed outdoor area adjacent to 76-86 Merrimack Street, during Lowell Folk Festival weekend, July 25-26-27, 2014, sound system. Mr. Finn was present. The Commission reviewed the applications for special events permit for amplified outdoor public entertainment from Olimpio Brasil of the Holy Ghost Society, at Holy Ghost Park, 65 Village Street. Mr. Brasil was present. On a motion by Commissioner Krieger, second by Commissioner McCarthy, to approve the amplification permits for the Blue Shamrock, Inc. and for Olimpio Brasil for events at Holy Ghost Park, so voted. The Commission reviewed Sidewalk Stand applications from the following: Anny Vong, d/b/a Humanity, for sidewalk stand sale at 128 Merrimack Street, Friday, July 25, Saturday, July 26, and Sunday, July 27, 2014, Lowell Folk Festival weekend only; Anny Vong was not present. Executive Secretary stated Ms. Vong was notified to appear at the meeting. Executive Secretary stated Mr. Hill was due to arrive after 7 p.m. On a motion by Commissioner Krieger, second by Commissioner McCarthy, to approve sidewalk stand permits for Cyrus Enterprises, Inc., Jeremy McKenna, and MVP Testing LLC, so voted. The Commission reviewed the application by Rami Salameh, d/b/a Wireless Professional, 480 Bridge Street, for license for Second Hand Articles and/or Clothing – May 1, 2014 to April 30, 2015. Mr. Salameh was not present. The Commission took no action on the application by Rami Salameh. The Commission reviewed the application by Richard Finamore, d/b/a Cash For Gold Lowell for license for Old Gold, Silver, Platinum – May 1, 2014 to April 30, 2015, for premises at 1687 Middlesex Street. Mr. Finamore was present. Archie DeFlorio was present. After a discussion, the Commission, on a motion by Commissioner McCarthy, second by Commissioner Krieger, voted to approve Old Gold, Silver, Platinum license for Richard Finamore for address at 1687 Middlesex St. License Commission minutes for July 17, 2014 page 3 of 10 The Commission reviewed the application by Oasis Grill and Restaurant, Inc., d/b/a Oasis Grill and Restaurant, all alcoholic beverages Restaurant licensee, 910-912 Gorham Street for change of officer, director, and manager from Joel S. Espinola to Edil Jose Cunha of Lowell, MA. Edil Jose Cunha and Atty. Sandra Meneses were present. Chairman Descoteaux questioned Atty. Meneses about the proposed corporate changes. After a discussion, the Commission, on a motion by Commissioner Hogan, second by Commissioner Krieger, voted to approve Edil Jose Cunha as officer, director, and manager for Oasis Grill and Restaurant, Inc. The Commission, on a motion by Chairman Descoteaux, second by Commissioner McCarthy, voted to place the application for change of manager at the end of the agenda for BEKS, Inc., Brian’s Ivy Hall, 74 Merrimack Street, all alcoholic beverages Restaurant licensee from Kevin Hayhurst to Eric Finn of Salem, NH The Commission, on a motion by Chairman Descoteaux, second by Commissioner McCarthy, voted to place the application for change of manager at the end of the agenda for Hayhurst Group, Inc., d/b/a Finn’s Pub, 76-86 Merrimack Street, all alcoholic beverages Restaurant licensee from Kevin Hayhurst to Eric Finn of Salem, NH Joseph Slesar appeared before the Commission to inform the licensing board that legal notice had not been sent to abutters in accordance with section 15A of chapter 138 of MGL for the application by Slesar Bros. Brewing Company, Inc. The Commission did not open the public hearing on the application by Slesar Bros. Brewing Company, Inc., Joseph D. Slesar, President, for all alcoholic beverages Restaurant license for premises at 203 Cabot Street. After a discussion, the Commission, on a motion by Commissioner Krieger, second by Commissioner McGovern, voted to set a new hearing date and time for July 31, 2014 at 6:30 p.m. to be held in the Council Chamber, and that a legal notice be published on Monday, July 21, 2014 in the local newspaper. The Commission opened the public hearing on the application by SALT, Inc., Alan R. Marcotte, President, for malt beverages & wines only Package Store license for premises at 970 Gorham Street. The following individuals were present: Alan Marcotte, Atty. John F. Paczkowski, and Steve Craft. The applicant, Mr. Marcotte, is requesting to add beer and wine for customers; a petition of 150 signatures filed in behalf of the applicant; 10 years’ experience in the Town of Dracut; all employees are TIPS certified; carry liability insurance; store very clean; remodeling to sell beer/wine; an asset to the neighborhood. Chairman Descoteaux asked if anyone present wished to speak in favor of the application – four adults addressed the Commission in support of the application and the store owner. The License Commission minutes for July 17, 2014 page 4 of 10 favorable comment portion of the hearing closed, Chairman Descoteaux opened the hearing to those present who wished to speak in opposition to the application – six adults spoke in opposition to the application; Attorney George Theodorou of Lowell addressed the Commission in behalf of Rosenbloom Corporation, d/b/a Ornelas Liquors, 1088 Gorham Street. Atty. Theodorou submitted a petition of 220 signatures. The public commentary portion of the hearing was closed. After a discussion on the application, and for the merits of a license, the hearing was closed, and the following action taken: on a motion by Chairman Descoteaux, second by Commissioner Hogan, it was voted to grant a malt beverages & wines only Package Store license to SALT, Inc., b/b/a Tedeschi Food Shops, Alan R. Marcotte, President for premises at 970 Gorham Street, left-side unit of 3,495 square feet with 2,400 square feet of retail space, storage, office; one entrance/exit at left front, loading door right front, and exit at left rear of unit, for the license year to expire December 31, 2014; vote: ayes – unanimous. The Commission voted to approve Alan R. Marcotte as manager of record for SALT, Inc. The Commission opened the public hearing on the application by Makutano, Inc., Patrick Karongo, President, for the transfer of the all alcoholic beverages Restaurant license from The Old Place, Inc., Lawrence J. Valcourt, President, for premises at 282-284 Fletcher Street. The following individuals were present: Attorney Arthur Sullivan, legal counsel for Makutano, Inc., Patrick Karongo, James Nyoike, and Larry Valcourt of The Old Place, Inc. Attorney Sullivan stated that Mr. Karongo has waived his right to have his CORI reviewed in executive session. An explanation about Mr. Karongo background was stated by Atty. Sullivan. Attorney Sullivan also explained an amendment to the number of shareholders from seven individuals to five individuals, and a change in the office of Treasurer. There was discussion about James Nyoike as the proposed manager of record for Makutano, Inc. The hearing was declared closed, and on a motion by Chairman Descoteaux, second by Commissioner Krieger, it was voted to approve the transfer of the all alcoholic beverages Restaurant license from The Old Place, Inc. for premises at 282-284 Fletcher Street, one unnumbered door west side of building. First floor-one room for restaurant/lounge; basement for storage, for the license year to expire December 31, 2014; vote: ayes – unanimous. The Commission voted to approve James Nyoike as manager of record for Makutano, Inc. The Commission opened the public hearing on the application by Rivers Wild, Inc., d/b/a Jameson’s, Shannon M. KelleyBarrozo, President, for an all alcoholic beverages Restaurant license for premises at 26 Andover Street. License Commission minutes for July 17, 2014 page 5 of 10 Shannon M. KelleyBarrozo was present with Atty. Raymond Weicker, legal counsel for Rivers Wild, Inc. Atty. Weicker presented a summary of Ms. KelleyBarrozo’ s background, and of the favorable aspects of the premises. One individual spoke in favor of the application; there was no one to speak in opposition. The public commentary portion of the hearing was closed. On a motion by Commissioner McCarthy, second by Commissioner Krieger, it was voted to grant an all alcoholic beverages Restaurant license to Rivers Wild, Inc., d/b/a Jameson’s, Shannon KelleyBarrozo, President, for premises at 6 Andover Street, and four (4) unnumbered doors. Description of premises: two-story building with attached deck approximately 1350 sq. ft. at ground floor, west side; first floor one room as a restaurant, and a kitchen; ground floor one room as a function hall, and three storage rooms, for the license year to expire December 31, 2014; vote: ayes – unanimous. The Commission voted to approve Shannon KelleyBarrozo as manager of record for Rivers Wild, Inc. The Commission reviewed the application by James Hill of City Bicycle Co., 181 Market St., for a Sidewalk Stand permit for July 25, 26, 27 – 2014. Mr. Hill was present. Commissioner Krieger made the motion to grant the Sidewalk Stand permit to James Hill, second by Commissioner Hogan, so voted. The Commission, on a motion by Commissioner Hogan, second by Commissioner McCarthy, voted to grant a continuance as requested by Atty. John J. Hartigan for the hearing to July 31, 2014 on Resendes Incorporated, d/b/a Red Line Pub & Grill, John M. Resendes, Mgr., 1018 Gorham Street, alleged violations of section 1.16 of the Lowell License Commission Regulations, to wit, Manager’s Responsibilities; section 1.20 of the Lowell License Commission Regulations, to wit, Illegal Activities; section 4.02 of the Lowell License Commission Regulations, to wit: hours of operation; 204 CMR 2.05 (2), to wit: disorder, disturbance, illegality on the premises; chapter 138, section 41, M.G.L., to wit: delivery of alcoholic beverages as prima facie evidence of sale. Captain Kennedy stated records request from Atty. Hartigan will be processed this week. The Commission, on a motion by Commissioner Hogan, second by Commissioner McCarthy, voted to grant a continuance as requested by Shayne Cranmore for the hearing to July 31, 2014 on SP Entertainment Inc., d/b/a Savanna Palace, Shayne Cranmore, Mgr., 25 Market Street, alleged violation of section 1.16 of the Lowell License Commission Regulations, to wit, Manager’s Responsibilities. License Commission minutes for July 17, 2014 page 6 of 10 The Commission, on a motion by Chairman Descoteaux, second by Commissioner Krieger, voted to schedule a hearing for July 31, 2014 on the matter of the communication from William M. Taylor, Superintendent of Police, regarding Camila LLC, d/b/a Reservations, Jorge Torres, Manager, all alcoholic beverages Restaurant licensee, at 179 Central Street. Commissioner Krieger noted the need upon a spot inspection to have license posted without straining to see license and its content. The Commission, on a motion by Chairman Descoteaux, second by Commissioner Hogan, voted to place the complaint on file on the allegations of misconduct as charged by William M. Taylor, Superintendent of Police against Hayhurst Group Inc., d/b/a Finn’s Pub, Kevin Hayhurst, Manager, 76-84 Merrimack Street, alleged violation of section 1.20 of the Lowell License Commission Regulations, to wit, Illegal Activities. Chairman Descoteaux stated the exception he took on a local newspaper editorial recently about License Commission and the licensing board’s transparency at public meetings. The Commission opened the hearing on the allegations of misconduct as charged by William M. Taylor, Superintendent of Police against Hayhurst Group Inc., d/b/a Finn’s Pub, Kevin Hayhurst, Manager, 76-84 Merrimack Street, alleged violations of section 1.16 of the Lowell License Commission Regulations, to wit, Manager’s Responsibilities; section 1.20 of the Lowell License Commission Regulations, to wit, Illegal Activities; A.B.C.C. regulation 204 CMR 2.05 (2), permitting an illegality on the licensed premises, to wit: committing a felonious assault on a person in violation of MGL, chapter 265, section 13A. Eric Finn was present. Asst. Solicitor Veloso addressed the Commission about the meeting of the License Commission of May 22, 2014 which was held without a quorum of licensing board members. The Commission was also apprised of the matter of the meeting of the License Commission of June 26, 2014 as it relates to Finn’s Pub and Brian’s Ivy Hall by Asst. Solicitor Veloso. Asst. Solicitor Rossetti addressed the Commission about the administrative dissolution by the Corporations Division of the Office of the Secretary of State of the licensee BEKS, Inc. on June 30, 2014. Commissioner Descoteaux asked about the process of correcting the matter for BEKS, Inc. Asst. Solicitor Rossetti stated that application may be made with the Secretary of State for re-instatement. Chairman Descoteaux addressed Eric Finn about the matter of BEKS since Mr. Finn is listed as a corporation director. The Commission, on a motion by License Commission minutes for July 17, 2014 page 7 of 10 Commissioner Krieger, second by Commissioner Hogan, voted to suspend indefinitely the all alcoholic beverages Restaurant license, license for common victualler, license for entertainment in a licensed restaurant granted and issued to BEKS, Inc., d/b/a Brian’s Ivy Hall, for premises at 74 Merrimack St., 3rd floor, for calendar year 2014 due to the dissolution of the corporation by the Secretary of State. Chairman Descoteaux requested of Captain Kennedy that the license for BEKS, d/b/a Brian’s Ivy Hall be retrieved. The Commission opened the hearing on the allegations of misconduct as charged by William M. Taylor, Superintendent of Police against licensee Hayhurst Group Inc., d/b/a Finn’s Pub, Kevin Hayhurst, Manager, 76-84 Merrimack St. Eric Finn was present. Captain Kennedy read aloud for the record the letter from the Superintendent of Police to the License Commission, dated April 4, 2014. Mr. Finn stated he could not present a defense of the allegations. The following individuals appeared before the Commission as eyewitnesses to the incident of March 16, 2014: Timothy Greenhalge, Kayla Soares, and Greg Balamotis. Mr. Greenhalge presented testimony as the victim of an assault and battery; Mr. Greenhalge identified Kevin Hayhurst as his assailant. Ms. Soares and Mr. Balamotis testified to being witnesses to the assault upon Mr. Greenhalge; each person identified Kevin Hayhurst as Mr. Greenhalge’s assailant. Commissioner Krieger asked Mr. Finn if he was aware of the commotion. Mr. Finn stated he was aware of the commotion but not of someone being injured at the time. When asked by Commissioner Krieger if a report was filed with the License Commission by the licensee; Mr. Finn stated he was not aware of a violation being reported. Commissioner McCarthy questioned Captain Kennedy about the pending court complaint; Captain Kennedy stated there is a court date in August. As a follow-up, Chairman Descoteaux asked Captain Kennedy about an incident from 2013. Captain Kennedy stated that the case is pending. Commissioner Krieger cited the responsibility of the licensee to protect patrons. Chairman Descoteaux asked Mr. Finn if he would like to make other comments. Mr. Finn declined. Asst. Solicitor Veloso presented to the Commission summation of the past incidents attributed to former manager of record for Finn’s Pub, and a recommendation for the Commission. Chairman Descoteaux requested of the Commission their comments. Commissioner Krieger recommended two- days suspension held in abeyance from 2013 to be served; and seven days suspension with two-days of said seven days to be held in abeyance. Commissioner McCarthy stated Finn’s Pub is out-of-control, recommending 30 days suspension. On a motion by Commissioner McCarthy, second by Chairman Descoteaux, it was voted to suspend License Commission minutes for July 17, 2014 page 8 of 10 for thirty (30) days the all alcoholic beverages Restaurant license, license for common victualler, and license for entertainment in a licensed restaurant granted and issued to Hayhurst Group, Inc., d/b/a Finn’s Pub, 76-86 Merrimack Street, for calendar year 2014; vote – yea: Commissioner McCarthy, Chairman Descoteaux, Commissioner Hogan, Commissioner McGovern; nay: Commissioner Krieger. Final tally: four (4) yeas; one (1) nay – suspension to take effect forthwith. Eric Finn stated to the Commission that he was not notified and therefore not prepared for the License Commission’s action to open the hearing for the complaint against Hayhurst Group, Inc. Mr. Finn was told by Asst. Solicitor Rossetti and the Executive Secretary of the notice of hearing sent to Attorney Weicker when the hearing was scheduled for June 26, 2014. Attorney Raymond Weicker, speaking in his own behalf, addressed the Commission about the discussion held with Assistant Solicitor Veloso on the matter of the injunction filed in behalf of Hayhurst Group, Inc., and the subsequent reason for requesting of the court a release of the injunction. Atty. Weicker stated his objection to the information conveyed by Asst. Solicitor Veloso to the License Commission. Chairman Descoteaux addressed Atty. Weicker for comments not relevant to the action of the License Commission. Asst. Solicitor Veloso addressed the Commission objecting to the comments of Atty. Weicker; further, outlining the discussion with Atty. Weicker prior to the License Commission action regarding Hayhurst Group, Inc. The Commission reviewed the application for change of manager of record for Hayhurst Group, Inc., d/b/a Finn’s Pub, 76-86 Merrimack Street, from Kevin Hayhurst to Eric Finn of Salem, NH. After a discussion on the suitability of Mr. Finn as a manager due to the circumstances of his position as Director of the dissolved corporation BEKS, on a motion by Chairman McCarthy, second by Commissioner Krieger, not to approve Eric Finn as manager of record for Hayhurst Group, Inc., d/b/a Finn’s Pub; vote: yeas – unanimous. Chairman Descoteaux requested Captain Kennedy to retrieve the license for Hayhurst Group, Inc. On a motion by Chairman Descoteaux, second by Commissioner McCarthy, to place on file the application for change of manager for BEKS, Inc., d/b/a Brian’s Ivy Hall, 74 Merrimack St. from Kevin Hayhurst to Eric Finn of Salem, NH; vote: yeas – unanimous License Commission minutes for July 17, 2014 page 9 of 10 On a motion by Chairman Descoteaux, second by Commissioner McCarthy, to place on file the allegations of misconduct as charged by William M. Taylor, Superintendent of Police, against BEKS, Inc., d/b/a Brian’s Ivy Hall, 74 Merrimack Street regarding the violations of the licensee Hayhurst Group, Inc. as a result of the incident at Finn’s Pub on March 16, 2014; vote: yeas – unanimous On a motion by Chairman Descoteaux, second by Commissioner Krieger, to place on file applications for special one-day malt beverages & wines only licenses by Eric Finn of Finn’s Pub, for enclosed outdoor area adjacent to 76- 86 Merrimack St. for July 25, 26, 27 – 2014; vote: ayes – unanimous On a motion by Chairman Descoteaux, second by Commissioner Krieger, to place on file applications for special permit for amplification of sound by Eric Finn of Finn’s Pub, for enclosed outdoor area adjacent to 76-86 Merrimack St. for July 25, 26, 27 – 2014; vote: ayes – unanimous Executive Secretary presented request for License Commission ratification of the issuance of a sound amplification permit to Penny K. Hamourgas of Worthen House Café, Inc. for sound system for band and/or disc jockey during Lowell Folk Festival at the enclosed parking area at 152 Worthen St. on Friday, July 25 and Saturday, July 26; and for the alley only at 141 Worthen Street on Sunday, July 27, 2014; motion by Chairman Descoteaux to ratify, second Commissioner Hogan, so voted. The Executive Secretary requested authorization to send notification to the manager of record of Centralville Social Club, 364 West Sixth Street, to appear at the next regular meeting of the License Commission because the club licensee has not filed 2014 club reports, and that 3-notices have been sent to manager of record David W. Burns; motion by Chairman Descoteaux to ratify, second Commissioner Krieger, so voted. The Executive Secretary informed the Commission that the license was not issued for dispensing wines to Donna Howard of millWORKS Gallery at Appleton Mills, 219 Jackson Street, for event date of July 10, 2014.
