Minutes for Lowell License Commission meeting, Thursday, July 23, 2015 at 6:30 p.m., City Council Chamber, 2nd floor, City Hall, 375 Merrimack St., Lowell, MA 01852 Present: John Descoteaux, Commissioner, Chairman, Commissioners Cliff Krieger, Kristen Hogan, Nancy McGovern, and Terry McCarthy. The Commission voted to continue to the next scheduled meeting a review of minutes for meeting July 9, 2015 on the motion by Commissioner Krieger, second by Commissioner McCarthy. The Commission reviewed the application for special one-day license to sell/dispense malt beverages & wines only, or either one by Tracy Martino of Aramark, for event at Durgin Hall - Fisher Recital Hall, 35 Wilder Street, Sacred Heart Endowment Reception, Saturday, August 1, 2015, 8:30 p.m. to 12:30 a.m. Tabatha Garnett, representative, was present. The Commission voted to approve the license for Tracy Martino of Aramark for Saturday, August 1, 2015 on the motion by Commissioner McGovern, second by Commissioner Hogan. The Commission reviewed applications for special one-day licenses to sell/dispense all alcohol beverages by Isabel Chavez of the Holy Ghost Society, for Holy Ghost Park, 65 Village Street, for the following events: a birthday, Saturday, July 25, 2015, 5:00 p.m. to 12:00 midnight; a wedding, Saturday, August 1, 2015, 5:00 p.m. to 1:00 a.m.; a wedding, Saturday, August 8, 2015, 4:00 p.m. to 1:00 a.m.; a wedding, Saturday, August 22, 2015, 4:00 p.m. to 1:00 a.m.; Quizeneira birthday, Saturday, August 29, 2015, 6:00 p.m. to 1:00 a.m.; Loreto Feast by St. Anthony Church, Saturday, September 5, 2015, 5:00 p.m. to 12:00 midnight; Loreto Feast by St. Anthony Church, Sunday, September 6, 2015, 4:00 p.m. to 12:00 midnight; Loreto Feast by St. Anthony Church, Monday, September 7, 2015, 2:00 p.m. to 10:00 p.m.; and a wedding, Saturday, September 26, 2015, 5:00 p.m. to 1:00 a.m. Isabel Chavez was present. Chairman Descoteaux addressed Ms. Chavez about the responsibility she will have for the sale and service of alcohol beverages at each of the Holy Ghost events. The Commission, on the motion by Commissioner Hogan, second by Commissioner Krieger, voted to approve licenses for Isabel Chavez of the Holy Ghost Society. License Commission minutes for July 23, 2015 page 1 of 3 The Commission reviewed the applications for special events permit for amplification of sound for outdoor public entertainment from the following applicants: Ken Lavallee of Enterprise Bank, for disc jockey with sound system, for the customer appreciation cook- out, Thursday, August 13, 2015, 11:30 a.m. to 2:30 p.m., at the parking lot adjacent to Enterprise Bank, 222 Merrimack Street. Ken Lavallee was present. Isabel Chavez of the Holy Ghost Society, for sound system for music for the following events at the outdoor grounds of Holy Ghost Park, 65 Village Street: birthday for Saturday, July 25, 2015, 5:00 p.m. to 12:00 midnight; and for the Loreto Feast by St. Anthony Church, Saturday, September 5, 2015, 5:00 p.m. to 12:00 midnight, Sunday, September 6, 2015, 2:00 p.m. to 12:00 midnight, and Monday, September 7, 2015, 4:00 p.m. to 10:00 p.m. Isabel Chavez was present. Chairman Descoteaux reminded Mr. Lavallee and Ms. Chavez about maintaining a reasonable level on the amplification. The Commission voted to grant the special events permits for amplification of sound for outdoor public entertainment to Ken Lavallee of Enterprise Bank and to Isabel Chavez of the Holy Ghost Society on the motion by Commissioner Hogan, second by Commissioner Krieger. The Commission reviewed the applications for Sidewalk Stand license from the following individuals: Mina Rezkalla, Market St Market, Cyrus Enterprises, Inc., 95 Market Street, for July 24, 25, 26 – 2015, Mina Rezkalla was not present. Mark Coddaire, d/b/a Marx Running & Fitness, 118 Merrimack Street, for a 2015 Seasonal Permit, Mark Coddaire was present. Patricia Collins, The Coffee Mill, 23 Palmer Street, for July 24, 25, 26 – 2015, Patricia Collins was present. SSG Donald R. Thurman, US Army Recruiting Center, insured 105-107 Merrimack St R E Trust LLC, c/o Sarris Inc., 107 Merrimack Street, for July 24, 25, 26 – 2015; SSG Donald R. Thurman was present. The Commission approved the Sidewalk Stand applications of Mark Coddaire, Patricia Collins, and SSG Donald Thurman, and to defer approval of the application by Mina Rezkalla, on the motion by Commissioner Krieger, second by Commissioner Hogan. License Commission minutes for July 23, 2015 page 2 of 3 The Commission reviewed the application by Thirteen Fifty Middlesex LLC, d/b/a Angelina Two, Jasbir Saini, Manager, for a malt beverages & wines only package store license for premises at 1350 Middlesex Street, a one level convenience store, 1,600 square feet. The Commission reviewed the application by Pho VStar Restaurant & Lounge, LLC, Thai Duc Ninh, Manager, for the transfer of the all alcoholic beverages restaurant license from Amae Restaurant, LLC, for premises at 602-608 Merrimack St., one unnumbered door east side, and west side; first floor-one room for restaurant, kitchen, and office; basement for storage; sidewalk seating area in front of 602-608 Merrimack St. The Commission, on the motion by Commissioner McGovern, second by Commissioner McCarthy, voted to ratify the publication of legal notices for July 24, 2015 in the local newspaper, and to schedule public hearings for August 6, 2015 for the application by Thirteen Fifty Middlesex LLC, d/b/a Angelina Two, for premises at 1350 Middlesex Street, and the application by Pho VStar Restaurant & Lounge LLC for premises at 602-608 Merrimack St. The Commission discussed the matter of the license application by Mina Rezkalla for a Sidewalk Stand license. Chairman Descoteaux and Commissioner Krieger exchanged comments about precedence for granting a license without the presence of an applicant, and approval of the application by Mr. Rezkalla, provided he receives a note of caution from the Executive Secretary. The Commission approved the Sidewalk Stand license for Mina Rezkalla for Folk Festival weekend at 95 Market St. on the motion by Commissioner Krieger, second by Commissioner Hogan. The Commission voted to adjourn the meeting at 6:45 p.m. on a motion by Commissioner Krieger, second by Commissioner Hogan.
