1 Minutes for Lowell License Commission meeting, Thursday, December 3, 2015 at 6:30 p.m., City 2 Council Chamber, 2nd floor, City Hall, 375 Merrimack St., Lowell, MA 01852 3 Present: Commissioners Kristen Hogan, presiding, Terry McCarthy, Nancy McGovern; and Captain Jack 4 Webb of the Lowell Police Department. 5 Absent: Commissioners John Descoteaux, Cliff Krieger. 6 The Commission voted to continue the matter of the review of minutes for meeting November 19, 2015 7 on the motion by Commissioner McGovern, second by Commissioner McCarthy. 8 The Commission reviewed applications for special one-day license to sell/dispense malt beverages & 9 wines only, or either one 10 Andrew Jacobson of Brew'd Awakening Coffeehaus, 61 Market Street, Holiday Open House, Friday, 11 December 11, 2015, 5:30 p.m. to 10:00 p.m. Andrew Jacobson was present. 12 Charlotte A. Elizabeth Kegley was present. 9 The Commission voted to approve the license applications of Andrew Jacobson, Charlotte Parnigian, 10 John Dyson, Edgar Cyrus, and Elizabeth Kegley on the motion by Commissioner McCarthy, second by 11 Commissioner McGovern. 12 The Commission reviewed the application by Club Lafayette, Inc., all alcoholic beverages club licensee at 13 465 Fletcher St. for change of corporate officers and directors, and for change of manager of record to 14 Ronald P. Lowe of Hudson, NH. Ron Lowe was present. The Commission questioned Mr. Lowe about 15 the club, the present day operation of the club. Mr. Lowe stated the membership is approximately 230 16 members; he has been working at the club for seven months. The Commission, on the motion by 17 Commissioner McGovern, second by Commissioner McCarthy, voted to approve the application for 18 change of officers and directors, and Ronald Lowe as manager of record. 19 The Commission reviewed the application by Aaronap Cellars LLC, Noel A. Powell, Manager, a Farmer 20 Winery, for a license to sell wine at a Farmer’s Market at the premises of 250 Jackson St., Mill No. 5, 4th 21 floor, on Sundays, January 3 thru May 29, 2016, 10:00 a.m. to 2:00 p.m. each Sunday. Noel Powell was 22 present. Mr. Powell stated that it is the third application for a license at the Farmer’s Market since 23 February [2015]. The Commission voted to approve the license to sell wine at the Farmer’s Market, 250 24 Jackson St., on the motion by Commissioner McCarthy, second by Commissioner McGovern. 25 The Commission voted on the motion by Commissioner McCarthy, second by Commissioner McGovern, 26 to ratify the date of the public hearing for December 17, 2015 at 6:30 p.m. in the Council Chamber for the License Commission minutes for December 3, 2015 page 2 of 3 1 application by Bearcamp Inc., Wendi Wilkins, President, for the transfer of the malt beverages & wines 2 only package store license from R & Z Company LLC, d/b/a Tuttobene Wine & Cheese Cellars, 3 Catherine Rourke, Manager of LLC, for premises at 58 Prescott St., Rear #3C. The legal notice for said 4 application is to be published December 4, 2015 in local newspaper. 5 The Commission, on the motion by Commissioner McGovern, second by Commissioner McCarthy, voted 6 to ratify the continuance of hearing to December 17, 2015 for the licensee Vannak Kann, d/b/a The 7 Crown, 74 Middlesex Street, regarding the allegations of misconduct as charged by William M. Taylor, 8 Superintendent of Police, per request of Atty. Raymond Weicker, legal counsel for the licensee, in a type- 9 written communication on November 30, 2015. 10 The Commission reviewed the list of the 2016 renewal applications filed by Alcohol Beverages Licensees 11 – Hotels, Restaurants, and Clubs during the month of November in accordance with Massachusetts law 12 chapter 138, section 16A. The Executive Secretary explained that each on-premises licensee is required to 13 have a certificate of inspection for 2016, and a liquor liability insurance policy to be in effect during the 14 calendar year 2016. The City of Lowell License Commission is the certificate holder for each insurance 15 policy. The Commission reviewed the list of 2016 renewal applications filed by Alcohol Beverages 16 package store licensees during the month of November in accordance with MGL c. 138, s. 16A. On the 17 motion by Commissioner McCarthy, second by Commissioner McGovern, the Commission voted to 18 approve the on-premises renewal applications with the condition that each on-premises licensee shall 19 have a certificate of inspection valid for 2016, and a liquor liability insurance policy; further, it was voted 20 to approve package store renewals (off-premises) for 2016. 21 The Commission voted to adjourn the meeting at 6:45 p.m. on a motion by Commissioner McGovern, 22 second by Commissioner McCarthy. 23 Respectfully submitted by Ryan Wynn, Executive Secretary, present at meeting.
