License Commission

Minutes for the Lowell License Commission meeting for Thursday, November 3, 2016 at 6:30 p.m., held in the Council Chamber, 2nd floor, City Hall, 375 Merrimack St., Lowell, MA 01852. Present: John Descoteaux, Commissioner, Chairman, Commissioners Cliff Krieger, Terry McCarthy, Martha Howe, and Joseph Donahue; and Deputy Superintendent Jack Webb of the Lowell Police Department. The Commission recognized the public service of Walter F. Bayliss, Jr. who served as License Commissioner, and as Chairman for many years, from 1995 to 2012. Chairman Descoteaux offered the Commission’s condolences to the family of Commissioner Bayliss who died November 1, 2016. The Commission, on the motion by Commissioner Krieger, second by Commissioner McCarthy, voted to approve the minutes for the meeting of October 20, 2016 with amendment on page 10, line 3, “draft and submit.” The Commission, on the motion by Commissioner Donahue, second by Commissioner Krieger, voted to ratify the issuance of a special one-day license to sell/dispense malt beverages & wines only to Tabatha Garnett, Catering Manager, Aramark, for event at the ETIC Atrium, 40 University Ave., College of Engineering Dinner & Lecture, Tuesday, October 25, 2016, 5:30 p.m. to 9:00 p.m. Tracy Martino was present in behalf of Tabatha Garnett. The Commission reviewed the applications for special one day licenses to dispense Wines only by Angelique Ward, Ayer Lofts Art Gallery, 172 Middle St., Figuration Amalgam Art Exhibition, Saturday, November 5, 2016, 4:00 p.m. to 7:30 p.m.; Friday, November 25, 2016, 4:00 p.m. to 7:30 p.m. Angelique Ward appeared before the Commission. The Commission voted to approve the licenses to dispense wines for Angelique Ward on the motion by Commissioner Krieger, second by Commissioner Howe. The Commission reviewed the applications for special one-day license to sell/dispense malt beverages & wines only, or either one by Tabatha Garnett, Catering Manager, Aramark, for the following events: ETIC License Commission minutes November 3, 2016 page 1 of 3 Atrium, 40 University Ave., NextFlex Soft Robotics Workshop, Tuesday, November 8, 2016, 5:00 p.m. to 9:00 p.m.; and University Crossing, Honorary Degree Ceremony, Wednesday, November 16, 2016, 4:00 p.m. to 9:00 p.m.; from Patricia Donahue, Gallery Z, 167 Market Street, for the following events: music with Jess & Jamie Cohan, Saturday, November 12, 2016, 7:00 p.m. to 9:00 p.m.; and Sunday Brunch with artist Steve Clements, & artist Antoni Juzkiewicz, Sunday, November 13, 2016, 1:00 p.m. to 3:00 p.m. Clare Gunther, for the event at Lowell Community Health Center, 161 Jackson Street, for the Lowell Community Health Center Developing Leaders Winter Mixer, Wednesday, December 7, 2016, 5:30 p.m. to 8:00 p.m. Tracy Martino was present for Tabatha Garnett; Patricia Donahue and Clare Gunther were present. The Commission, on the motion by Commissioner McCarthy, second by Commissioner Krieger, voted to approve licenses for Tabatha Garnett, Patricia Donahue, and Clare Gunther. The Commission opened the public hearing on the application by GT Doyle & Co., Inc., Gregory J. Doyle, President, for the transfer of the malt beverages and wines package store license from Lowell Provision Company, Peter F. Doyle, Manager, for premises at 963 Chelmsford St. It is requested that Gregory J. Doyle be approved as manager of record for GT Doyle & Co., Inc. Legal notice published October 21, 2016, Lowell Sun newspaper. Gregory Doyle and Thomas Doyle were present. Greg Doyle addressed the Commission about the corporation change. Chairman Descoteaux opened the hearing for public comment for individuals who would like to speak in opposition to the application. There was no one present to speak in opposition; that portion of the hearing was closed. The hearing was opened for those individuals who wished to speak in favor of the application. There was no one present to speak in favor of the application; that portion of the hearing was closed. The Commission, on the motion by Commissioner Krieger, second by Commissioner Howe, voted to approve the transfer of the malt beverages & wines only package store license from Lowell Provision Company to GT Doyle & Co., Inc. for premises at 963 Chelmsford Street. It was voted to approve Gregory J. Doyle as Manager of Record for GT Doyle & Co., Inc. License Commission minutes November 3, 2016 page 2 of 3 Peter Huynh, Manager of 1981 Ramen Bar, LLC, all alcoholic beverages restaurant licensee at 129 Merrimack St., appeared before the Commission for a public hearing for alteration of premises. The Commission did not receive affidavit of abutter notification from Mr. Huynh. Upon review of the matter of notification to abutters by a license applicant, the Commission, on the motion by Commissioner Krieger, second by Commissioner McCarthy, voted to re-schedule a public hearing to be held on December 1, 2016 on the application by 1981 Ramen Bar, LLC, Peter Huynh, Manager, 129 Merrimack St., all alcoholic beverages restaurant licensee, for alteration of premises, to add outdoor seating, 6 tables, 15 chairs, 8’x16’ fenced patio. The Commission reviewed the application by The Vibe Lounge Inc., Steven Xigoros, President, for the transfer of the all alcoholic beverages restaurant license from CB Enterprises, Inc., d/b/a Wicked Irish Pub, Corey Belanger, Manager, for premises at 197 Market Street, one unnumbered door; first floor: one room for restaurant, one room for kitchen; basement for storage. The Commission on the motion by Commissioner Donahue, second by Commissioner McCarthy, voted to ratify the publication of a legal notice for November 4, 2016 in the Lowell Sun newspaper, and that the public hearing be held November 17, 2016 at 6:30 p.m., City Council Chamber. The Commission reviewed the Executive Secretary report on the matter of the request by James Lichoulas, dated October 25, 2016, that applications for public amusement licenses by James Lichoulas and Coco Luna, LLC, and Allison Turcotte for special one-day license for malt beverages and wines only for November 12, 2016, at Hi Hat, 250 Jackson Street, Mill No. 5, 4th floor, be continued beyond November 3, 2016 because applicant not prepared to move forward in the process. The Commission ordered said communication placed on file.
