Minutes for the Lowell License Commission meeting for Thursday, March 9, 2017 at 6:00 p.m., held
in the City Council Chamber, 2nd floor, City Hall, 375 Merrimack St., Lowell, MA 01852.
Present: John Descoteaux, Commissioner, Chairman, Commissioners Terry McCarthy, Martha Howe,
and Joseph Donahue; and Deputy Superintendent Jack Webb of the Lowell Police Department.
Absent: Commissioner Cliff Krieger
The Commission, on the motion by Commissioner Donahue, second by Commissioner McCarthy,
voted to approve the minutes for meeting February 16, 2017.
The Commission reviewed the applications for special one-day license to dispense wines only from
Jim Dyment, Executive Director, The Brush Art Gallery & Studios, 256 Market Street. Mr. Dyment
was present. The events are: Artist Reception "Exploring Relationships: Instructors and Students",
Saturday, March 25, 2017, 2:00 p.m. to 4:00 p.m.; Artist Reception "Contemporary Visions of Greece's
Golden Age", Sunday, April 23, 2017, 2:00 p.m. to 4:00 p.m.; Artist Talk "Book Design by Susan
Gaylord", Saturday, May 20, 2017, 2:00 p.m. to 4:00 p.m.; Artist Reception "Annual Studio Artist
Exhibition", Thursday, June 29, 2017, 5:00 p.m. to 7:00 p.m.; and, Artist talk "Annual Studio Artist
Exhibition", Sunday, July 23, 2017, 1:00 p.m. to 3:00 p.m.
The Commission, on the motion by Commissioner McCarthy, second by Commissioner Howe, voted
to approve licenses to dispense wines only for Jim Dyment of The Brush Art Gallery & Studios.
The Commission reviewed the applications for special one-day license to sell/dispense malt beverages
& wines only, or either one from Patricia Donahue, Gallery Z, 167 Market Street. Ms. Donahue was
present. The events are: Artist reception "Seeing Italy", Friday, March 10, 2017, 7:00 p.m. to 9:00
p.m.; Sunday brunch with Steve Clement, Sunday, March 12, 2017, 12:00 p.m. to 2:00 p.m.; Coffee
House/Music with David Warren, Saturday, March 18, 2017, 8:00 p.m. to 10:00 p.m.; "Cantia Italiana"
[fundraiser/dinner for GZ Italian Music, wine by Tuttobene Wine Cellars], Saturday, March 25, 2017,
6:00 p.m. to 8:00 p.m.; and, Sunday brunch with Steve Clement, Sunday, March 26, 2017, 12:00 p.m.
to 2:00 p.m. The Commission, on the motion by Commissioner Howe, second by Commissioner

Donahue, voted to approve licenses to sell/dispense malt beverages & wines only for Patricia Donahue
of Gallery Z.
The Commission reviewed the application for special one-day license to sell/dispense malt beverages
& wines only, or either one for James Dyment of Brush Art Gallery and Studios, Onyx Room, Western
Ave. Studios, 122 Western Ave., 35th Brush Birthday Party Fundraiser, Saturday, April 8, 2017, 6:00
p.m. to 9:30 p.m. Mr. Dyment was present. Mr. Dyment stated the event is a fundraiser with silent
auction for The Brush Art Gallery. The Commission, on the motion by Commissioner McCarthy,
second by Commissioner Howe, voted to approve the license to sell/dispense malt beverages & wines
only for Jim Dyment of The Brush Art Gallery & Studios.
The Commission reviewed the application for special one-day license to sell/dispense malt beverages
& wines only, or either one for Richard S. Barrett of Kilkenny Pub, enclosed area at parking lot
adjacent to Kilkenny Pub, 660 Rogers Street, St. Patrick's Day, Friday, March 17, 2017, 2:00 p.m. to
11:00 p.m. Mr. Barrett was present. Mr. Barrett stated that Kilkenny Pub has hosted the St. Patrick’s
Day event for 17 years. Chairman Descoteaux asked Deputy Supt. Webb if there had been a problem
with last year’s event. Deputy Webb stated a disturbance occurred among some of the patrons. After
the discussion, the Commission, on the motion by Commissioner McCarthy, second by Commissioner
Donahue, voted to approve the license to sell/dispense malt beverages & wines only for Richard S.
Barrett.
The Commission reviewed the application for special one-day license to sell/dispense malt beverages
& wines only, or either one for Joann Gumby of Gormley's Café, 139 East Merrimack Street, St.
Patrick's Day fundraiser for End 68 Hours of Hunger, Friday, March 17, 2017, 10:00 a.m. to 4:00 p.m.
Ms. Gumby was present. Ms. Gumby explained to the Commission that the fundraiser will benefit
school children, ten percent of sales to benefit the program. The Commission, on the motion by
Commissioner McCarthy, second by Commissioner Howe, voted to approve the license to
sell/dispense malt beverages & wines only for Joann Gumby.

The Commission reviewed the application for special one-day license to sell/dispense malt beverages
& wines only, or either one for Tabatha Garnett, Catering Manager, Aramark, Allen House, 2
Solomont Way, Chancellor's Celebration of Music - Reception, Friday, March 31, 2017, 5:30 p.m. to
8:30 p.m. Ms. Garnett was present. The Commission, on the motion by Commissioner Howe, second
by Commissioner Donahue, voted to approve the license to sell/dispense malt beverages & wines only
for Tabatha Garnett.
The Commission reviewed the application for a special events permit for amplified outdoor public
entertainment by Richard S. Barrett of Kilkenny Pub, Inc., sound system for band, disc jockey, St.
Patrick's Day, Friday, March 17, 2017, 2:00 p.m. to 11:00 p.m., in an enclosed area at the parking lot
adjacent to Kilkenny Pub, 660 Rogers Street. Mr. Barrett was present. The Commission, on the motion
by Commissioner McCarthy, second by Commissioner Donahue, voted to approve the special events
permit for amplified outdoor public entertainment for Richard S. Barrett of Kilkenny Pub, Inc.
The Commission, on the motion by Commissioner Donahue, second by Commissioner Howe, voted to
ratify the following regarding special one-day licenses to sell/dispense malt beverages & wines only:
Amended license: Tabatha Garnett, Catering Manager, Aramark, Allen House Gallery, 2 Solomont
Way, John Kaag Reading & Book Signing, Thursday, March 9, 2017, 3:00 p.m. to 7:00 p.m. from
February 9, 2017, credit of license fee paid 02-02-2017;
License cancellation: License approved on 02-16-2017, event cancelled 02-22-2016 - Tabatha Garnett,
Catering Manager, Aramark, Alumni Hall, 84 University Ave., Chancellor’s Celebration of Music,
Saturday, February 25, 2017, 5:00 p.m. to 9:00 p.m.;
License issued 3-2-2017: Tabatha Garnett, Catering Manager, Aramark, at Allen House Gallery, 2
Solomont Way, Portuguese Culture & Research Advisory Board Reception, Thursday, March 2, 2017,
5:30 p.m. to 9:30 p.m.
The Commission opened the public hearing on the application by Coco Luna LLC, d/b/a Coffee and
Cotton, James T. Lichoulas III, Manager Member, for a malt beverages and wines only restaurant

license for premises at 250 Jackson Street, unit # 434. It is requested that James T. Lichoulas III be
approved as manager of record for Coco Luna LLC. Coco Luna LLC filed application for license for
entertainment in a licensed restaurant for live music, disc jockey, juke box. James Lichoulas was
present. The Commission reviewed affidavit of notice to abutters, and white postal slips. Chairman
Descoteaux requested a review of the plan of the premises; Mr. Lichoulas approached the
Commissioners’ table to describe the layout of the restaurant “Coffee and Cotton.” Chairman
Descoteaux opened the hearing for public comment. There was no one present to speak in favor of or
against the application by Coco Luna LLC. The hearing was declared closed, and the following action
taken on the motion by Commissioner McCarthy, second by Commissioner Donahue: To approve
license for malt beverages and wines only restaurant for Coco Luna LLC for premises at 250 Jackson
Street, unit # 434 for calendar year 2017; to approve James T. Lichoulas III as manager of record; to
approve license for entertainment in a licensed restaurant for live music, disc jockey, and juke box for
calendar year 2017.
The Commission reviewed the application filed for change of officers, directors, shareholders,
manager of record, and business name on behalf of BS Collaborative, Inc. all alcoholic beverages
restaurant licensee for premises at 61 Merrimack Street. It is proposed that Ms. Yu Ping Li be
approved as manager of record, corporate officer, director, shareholder; Mr. Wen Qing Chen as
corporate officer, director, shareholder for BS Collaborative, Inc., d/b/a Fuji [new business name]. On
the motion by Commissioner Donahue, second by Commissioner McCarthy, the Commission ratified
the publication of the legal notice for March 10, 2017, and to hold a public hearing for March 23, 2017
at 6:00 p.m. in the City Council Chamber.
The Commission reviewed the application filed by The Liquor Shack, Inc., Theanseng T. Cheam,
Manager, 815 Lakeview Ave., for alteration of premises, i.e. first floor 2 rooms, 2,225 sq. ft.;
basement 2 storage rooms, 1,810 sq. ft. On the motion by Commissioner Howe, second by

Commissioner Donahue, the Commission ratified the publication of the legal notice for March 10,
2017, and to hold a public hearing for March 23, 2017 at 6:00 p.m. in the City Council Chamber.
The Commission voted, on the motion by Commissioner McCarthy, second by Commissioner Howe,
to table Commissioner Krieger’s motions for License Commission to (a) review Alcoholic Beverages
Regulations for Licenses Issued by the Lowell License Commission; (b) to have managers attend
session on review of alcoholic beverages regulations from time to time.
The Commission, on the motion by Commissioner Howe, second by Commissioner Donahue, voted to
adjourn the meeting at 6:20 p.m.
