Minutes for the Lowell License Commission meeting for Thursday, June 7, 2018 at 6:00 p.m., held in the City Council Chamber, 2nd floor, City Hall, 375 Merrimack St., Lowell, MA 01852. Present: John Descoteaux, Commissioner, Chairman, Commissioners Clifford Krieger, Martha Howe, and Joseph Donahue; and Captain Paul Laferriere of the Lowell Police Department. Absent: Commissioner Terry McCarthy Chairman Descoteaux welcomed Captain Laferriere as the liaison to the License Commission for Acting Superintendent of Police Jonathan C. Webb. Chairman Descoteaux on behalf of the License Commission expressed appreciation to Acting Superintendent Webb for his service to the Commission as liaison, and best wishes in his new position as Acting Superintendent of the Lowell Police Department. The Commission approved the meeting minutes for May 24, 2018 on the motion by Commissioner Krieger, second by Commissioner Donahue. The Commission reviewed the application for special one-day license to sell/dispense all alcoholic beverages by Julia Gavin on behalf of Coalition for a Better Acre, 6 Degrees of the Acre fundraiser, Thursday, June 28, 2018 from 6:00 p.m. to 9:00 p.m. at the Ayer Mansion, 357 Pawtucket St. CBA Board Member Kerry Regan-Jenness was present as representative. The Commission, on the motion by Commissioner Howe, second by Commissioner Donahue, voted to approve license for Julia Gavin in behalf of the Coalition for a Better Acre. The Commission reviewed applications for special one-day license to sell/dispense malt beverages and wines only, or either one: Penny Hamel of Westford Rotary Charitable Endowment, Inc., at JFK Plaza, the 17th Annual Blues and Brews Festival, Saturday, August 11, 2018, 2:00 p.m. to 8:00 p.m. Ms. Hamel was present. The License Commission minutes June 7, 2018 page 1 of 5 Commission, on the motion by Commissioner Krieger, second by Commissioner Donahue, voted to approve license for Penny Hamel of the Westford Rotary Charitable Endowment, Inc. Corey Belanger on behalf of Lowell Festival Foundation was present. Kevin Camvan of Wat Lao Mixayaram, temple grounds at 45 Bernier St., fundraiser, Saturday, June 30, 2018, 12:00 p.m. to 8:00 p.m., and Sunday, July 1, 2018, 12:00 p.m. to 8:00 p.m. Mr. Camvan was present. Chairman Descoteaux asked Captain Laferriere if the event has been a problem for neighbors. Captain Laferriere indicated that event has not been a problem. The Commission, on the motion by Commissioner Howe, second by Commissioner Krieger, voted to approve licenses for Kevin Camvan of Wat Lao Mixayaram temple. The Commission reviewed application for special events permit for amplified outdoor public entertainment. Captain Laferriere was present as representative for Jonathan C. The Commission reviewed the application by Penny Hamel, Westford Rotary Charitable Foundation, Inc., live music at JFK Plaza for the 17th Annual Blues and Brews Festival, August 11, 2018, 10:00 a.m. to 8:00 p.m. Ms. Hamel was present. The Commission, on the motion by Commissioner Howe, second by Commissioner Donahue, voted to approve the special events permit for Penny Hamel of the Westford Charitable Foundation. The Commission reviewed the application by Kevin Camvan, Wat Lao Mixayaram of New England, sound system for band, for temple fundraiser, Saturday, June 30, and Sunday, July 1, 2018, 12:00 p.m. to 8:00 p.m. each day, fence enclosed grounds of temple at 45 Bernier St. Mr. Camvan was present. On the motion by Commissioner Krieger, second by Commissioner Donahue, the Commission approved the special events permit for amplification to Kevin Camvan of Wat Lao Mixayaram. Henry Hoffens appeared before the Commission as manager of the audio equipment for sound system, for the Puerto Rican Festival, Sunday, August 5, 2018, 12:00 p.m. to 10:00 p.m., at JFK Civic Center. Chairman Descoteaux asked Captain Laferriere if the event had been a problem last year. Captain Laferriere indicated that the event had not been a problem. The Commission, on the motion by License Commission minutes June 7, 2018 page 3 of 5 Commissioner Donahue, second by Commissioner Howe, voted to approve the special events permit for Henry Hoffens for August 5, 2018. The Commission reviewed the application for change of beneficial interest filed by all alcoholic beverages club licensee Portuguese-American Center, Inc., 59 Charles Street, Jose M. Melo, President. Mr. Melo was present. Chairman Descoteaux asked for an explanation. The Executive Secretary stated there is the statutory requirement for a club licensee to file annually a report of officers and paid employees for serving alcohol beverages. The Alcoholic Beverages Control Commission has established the condition that club licensees also file an application for change of officers and directors at the time said changes occur, noting the corporate amendment and annual report that is filed with the Corporations Division of the Massachusetts Secretary of State. The A.B.C.C. application is defined as “change of beneficial interest.” The Commission, on the motion by Commissioner Krieger, second Commissioner Donahue, voted to approve the application by Portuguese-American Center, Inc. The Commission reviewed application for special one-day license to sell/dispense malt beverages and wines only, or either one by Evelyn Rodriguez, Puerto Rican Festival, Sunday, August 5, 2018, 12:00 p.m. to 10:00 p.m. at JFK Plaza. Evelyn Rodriguez was present. The Commission, on the motion by Commissioner Donahue, second by Commissioner Howe, voted to approve the special one-day license for Evelyn Rodriguez. Manuel Silva of Portuguese American Civic League appeared before the Commission. The Commission reviewed applications for members' picnic, Saturday, July 28, 2018, 12:00 noon to 6:00 p.m. to be held at the club parking lot at 512 Central St., i.e. special one-day license to sell/dispense malt beverages and wines only, or either one, and special events permit for amplified outdoor public entertainment. The Commission approved said license and permit on the motion by Commissioner Howe, second by Commissioner Donahue. The Commission, on the motion by Commissioner Krieger, second Commissioner Howe, voted to approve the application by The Portuguese American Civic League of Lowell. The Commission, on the motion by Commissioner Howe, second by Commissioner Donahue, voted to accept for cancellation licenses surrendered for malt beverages & wines only for restaurant, common victualler, entertainment for Flavor Grill Restaurant, 415 Lawrence St., Kelvin Peralta, Mgr. Business was sold. For cancellation, special one-day license for malt beverages & wines only, event to be re- scheduled - Tabatha Garnett of Aramark, Faculty Showcase, Thursday, May 31, 2018, 4:30 p.m. to 9:00 p.m., University Crossing 260, 220 Pawtucket St. Commissioner Donahue inquired about the “for sale sign” he recently saw on the facade of the Gaelic Club, 255 Chelmsford St. The Commission agreed to the Executive Secretary’s suggestion that the applicant’s attorney be contacted for an update about the lease agreement with the landlord.
