Minutes for the Lowell License Commission meeting for Thursday, December 13, 2018 at 6:00 p.m., held in the City Council Chamber, 2nd floor, City Hall, 375 Merrimack St., Lowell, MA 01852. Present: Commissioners Clifford Krieger, presiding, Terry McCarthy, Martha Howe, and Joseph Donahue; and John R. Hucksam, Assistant City Solicitor, Captain James Hodgdon of the Lowell Police Department. Absent: Commissioner John Descoteaux The Commission, on the motion by Commissioner McCarthy, second by Commissioner Howe, voted to approve the meeting minutes for November 29, 2018. The Commission reviewed applications for special one-day license to sell/dispense malt beverages and wines only, or either one: Cynthia Kuenzler of Four Oaks Country Club Inc., at Middlesex Community College Rialto Building, 240 Central Street, Holiday Movie Showing, Saturday, December 15, 2018, 1:00 p.m. to 3:00 p.m. Cynthia Kuenzler was present. For License Commission ratification issuance of license to Ashley Roper, Catering Manager, Aramark, Mechanical Engineering Holiday Party, at the Allen House, 2 Solomont Way, Thursday, December 13, 2018, 5:00 p.m. to 10:00 p.m. Ashley Roper, Catering Manager, Aramark, UML Chancellor's Holiday Party at University Crossing, 220 Pawtucket St., Friday, December 14, 2018, 2:00 p.m. to 6:00 p.m. Ashley Roper was present. The Commission, on the motion by Commissioner McCarthy, second by Commissioner Donahue, voted to approve licenses for Cynthia Kuenzler of Four Oaks Country Club Inc., and Ashley Roper of Aramark. The Commission reviewed the application by CEC Entertainment, Inc., d/b/a Chuck E. Cheese's, a malt beverages & wines only restaurant licensee at 199 Plain Street, unit 5, for change of manager to Kaitlin Fisher of Nashua, NH. Kaitlin Fisher was present. Ms. Fisher presented her background as an employee for CEC Entertainment in New Hampshire. She is a T.I.P.S. certified server with managerial experience. The Commission, on the motion by Commissioner McCarthy, second by Commissioner Donahue, voted License Commission minutes December 13, 2018 page 1 of 14 to approve Kaitlin Fisher as manager of record for CEC Entertainment, Inc. The Alcoholic Beverages Control Commission will also review said application for approval. The Commission reviewed the application by Social Club of Pawtucketville Lowell, Massachusetts, Raymond Beaudry, Treasurer, all alcohol beverages club licensee at 123 University Avenue, for change of manager to Judi Wheeler of Pelham, NH, and change of club officers and directors. The following individuals were present: Judi Wheeler and Raymond Beaudry. Ms. Wheeler stated she was manager for the Lawrence Elks from 2001 to 2006; she is T.I.P.S. certified server. Mr. Beaudry stated as Club Treasurer the 2019 club officers and directors were approved by the members, and records with the Massachusetts Secretary of State, Department of Revenue, and Unemployment Assistance have been recently updated. The Commission, on the motion by Commissioner Howe, second by Commissioner McCarthy, voted to approve the application by the Social Club of Pawtucketville Lowell, Massachusetts. The Alcoholic Beverages Control Commission will also review said application for approval. The Commission reviewed the application by Lowell Lodge # 87, B. P. O. Elks of USA, Paul B. Beaulieu, Director, all alcohol beverages club licensee at 40 Old Ferry Road, for change of manager to Paul B. Beaulieu of Dracut, MA, and change of club officers and directors. Paul Beaulieu was present. Mr. Beaulieu stated that he is T.I.P.S. certified server, three times Exalted Ruler, and serves as interim manager. The Commission, on the motion by Commissioner Howe, second by Commissioner McCarthy, voted to approve the application by the Lowell Lodge # 87, B. P. O. Elks of USA. The Alcoholic Beverages Control Commission will also review said application for approval. The Commission reviewed the application by Holy Ghost Society, Inc., d/b/a Holy Ghost Society, Elizabeth Candido, Clerk, all alcohol beverages club licensee at 65 Village Street, for change of manager to Luis R. Silveira of Lowell, MA, and change of club officers and directors. Luis Silveira was present. Mr. Silveira stated he is T.I.P.S. certified server since 2011 working the Holy Ghost bar. The Commission, on the motion by Commissioner McCarthy, second by Commissioner Howe, voted to approve the application by the Holy Ghost Society, Inc. The Alcoholic Beverages Control Commission will also review said application for approval. Powell, Manager, a Farmer Winery FW-LIC-000084, for a license to sell wine at a Farmer’s Market at the premises of 250 Jackson St., Mill No. 5, 4th and 5th floors, Sundays commencing January 6 thru June 30, 2019, 11:00 a.m. to 3:00 p.m. Noel Powell was present. Mr. Powell stated that he has participated in The Farm Market at Mill No. 5 for three years. The Commission, on the motion by Commissioner McCarthy, second by Commissioner Donahue, voted to approve the license for Aaronap Cellars LLC. The Commission reviewed the application by Dan Clapp dba 1634 Meadery, a Farmer Winery FW-LIC- 000104, for a license to sell wine at a Lowell Winter’s Farmers Market at the premises of 250 Jackson St., Mill No. 5, 4th floor, Sundays commencing December 23, 2018 thru March 17, 2019, 11:00 a.m. to 3:00 p.m., up to twice per month. Dan Clapp was present. Mr. Clapp stated that he is a T.I.P.S. certified server. The Commission, on the motion by Commissioner McCarthy, second by Commissioner Donahue, voted to approve the license for Dan Clapp dba 1634 Meadery. The Executive Secretary presented the list of 2019 Renewal for Alcohol Beverages – hotels, restaurants, clubs, package stores, and pouring permit. The Commission conducted hearings for the following 2018 licensees who have filed timely renewal in the month of November 2018, but the premises are closed or operating one calendar day per week: Lowell Steakhouse, Inc., d/b/a Bob’s Bar & Grill, 490 Central St., Robes Barboza, Manager, Restaurant, All Alcohol. Mr. Barboza was present. He stated he had been closed for three months, and apologized for not having notified the License Commission. He explained the circumstances that had him move family to New Jersey. Walter Humphrey, Inspector from Lowell Fire Prevention, explained his site inspections three months ago and most recently last week. There were serious code violations that have been corrected, and to date the licensed premises is in compliance with the Fire Code. Commissioner McCarthy made the motion to approve the renewal of license, second by Commissioner Donahue, so voted. Louilowell LLC, d/b/a Loui Loui, 11 Kearney Sq., Jonathan Joo, Manager, Restaurant, All Alcohol. Jonathan Joo was present. He stated that new manager was hired which would permit the restaurant to re- License Commission minutes December 13, 2018 page 3 of 14 open, but the individual hired decided to step down. Mr. Joo requested to withdraw the renewal application for 2019. The restaurant will remain closed. The withdrawal of license was accepted by the Commission. MBOA Alliance LLC, 135 Central St., Stanley Takang Tabi, Manager, Restaurant, All Alcohol. Stanley Tabi was present. The Executive Secretary stated that MBOA Alliance to date has not been issued a license for all alcoholic beverages restaurant since the original application was approved in 2017. Mr. Tabi stated that he has maintained the lease with the landlord for said premises, however, major renovations are required, and he and his business partner have been seeking financing to complete the necessary work. Mr. Tabi is looking to open in March. After some discussion, the Commission, on the motion by Commissioner Howe, second by Commissioner Donahue, approved the renewal of the license for MBOA Alliance LLC for 2019, and that the Commission will schedule a hearing for the first meeting in March should the 2019 license not have been issued by the end of February because a certificate of inspection has not been issued. Vannak Kann, d/b/a The Crown, 74 Middlesex St., Vannak Kann, Manager, Restaurant, All Alcohol. Vannak Kann was present. Mr. Kann explained that family illness in 2018 was cause for the business to close. Mr. Kann is planning to resume weekend activity and add weekday lunches in anticipation of the opening of the Judicial Center. Captain Hodgdon, in response to Commissioner Donahue question, there has been no issues with The Crown in 2018. Commissioner Donahue made the motion, second by Commissioner McCarthy to approve the renewal, so voted. The Commission opened the hearing to allow for testimony by Donald Sterling of 8 Wamesit Ct. after his presentation to the License Commission on November 29, 2018 regarding the towing of motor vehicles to the open lot at 705 Dutton St., property of Kazanjian Used Parts, Inc., Allan W. Kazanjian, President, a Junk Dealer licensee, and the blocking of the private driveway at 8 Wamesit Ct., the abutting property, by the owners of the towed vehicles. Allan Kazanjian was present. Wanda Aisle, Operation Manager for Kazanjian, was present. Captain Hodgdon stated Lowell Police Department has a contract with Kazanjian to tow vehicles 24 hours/7 days, as necessary. Mr. Sterling noted the numerous complaints against License Commission minutes December 13, 2018 page 4 of 14 Kazanjian dating back to 1993. Mr. Sterling offered a CD of pictures as evidence. Mr. Kazanjian addressed the complaints of Mr. Sterling, stating that inspections done in the past ten years since City Manager Lynch have shown there have been no violations by Kazanjian Used Parts, Inc. Ms. Aisle stated employees have been informed not to park in the area of 8 Wamesit Court. Commissioner Donahue spoke of the current Building Commissioner’s inspection found no violations. Commissioner McCarthy requested that Mr. Kazanjian continue to instruct employees not to park trucks in front of 8 Wamesit Ct. The Commission asked Captain Hodgdon about checking on a no parking sign for the property owner. Mr. Kazanjian was asked if possible not to have trucks back up late at night and early morning in order to avoid activating the warning signal required of construction vehicles. After discussion, the Commission, on the motion by Commissioner McCarthy, second by Commissioner Donahue, voted to place Mr. Sterling’s complaint on file. The Commission opened the hearing on neighbor’s recent complaint to License Commission discussed on November 29, 2018 about junk material stored at the site of Coelho Fuel, Inc., Francisco Coelho, President, used car dealer licensee at 493 Princeton Blvd. The allegations are a violation of the Zoning Board of Appeals conditions stipulated on June 8, 2009. Francisco Coelho was absent. Edward Bud Caufield, resident of 585 Princeton Blvd., was present. Mr. Caufield stated a history of the site from the time when it had been a gas station owned by Marchand Oil. Since an inspection by Shawn Machado in January 2017, when it was determined the site was used for the storage junk vehicles, the City Council and Neighborhood Sub Committee have reviewed the site. City Manager Murphy found the site to be a junk yard. Commissioners Howe and Donahue spoke of their findings upon inspecting the lot. It is in disarray, equipment all over. There are a number of cars without plates. Commissioner Krieger requested Assistant Solicitor Hucksam state the procedural approach to having Mr. Coelho answer to the allegations that he is in violation for the Zoning Board conditions, and License Commission regulations. Asst. Solicitor Hucksam recommended the conservative notice, the licensee’s right to be heard, a fourteen days’ notice be mailed certified. Commissioner Howe stated a notice of hearing as strong as legally as possible. Commissioner McCarthy agreed with Commissioner Howe. Commissioner Howe made the motion that License Commission minutes December 13, 2018 page 5 of 14 the Second Hand Motor Vehicles license by Coelho Fuel, Inc. not be renewed pending notice of hearing for January 10, 2019. Commissioner Donahue seconded the motion, so voted. The Executive stated that the legal counsel for the applicant withdrew the application of Two 55 Club, Inc. [Business Corporation], Sean Gannem, President, for the transfer of the all alcoholic beverages club license from The Gaelic-American Club, Inc., Catherine Brady, President, for premises at 255-265 Chelmsford St. A new application will be filed at a later date.
