1 Minutes for the Lowell License Commission meeting for Thursday, January 14, 2021 at 6:00 p.m., held in
2 compliance with Governor Baker’s Emergency Order Modifying the State’s Open Meeting Law issued

6 Present: John Descoteaux, Commissioner, Chairman, Commissioners Terry McCarthy, Martha Howe, and
7 Joseph Donahue, and Kerry Jenness, Assistant City Solicitor, and Captain Mark LeBlanc of the Lowell
8 Police Department.
9 Absent: Commissioner Clifford Krieger
10 Chairman Descoteaux convened the meeting at 6:00 p.m.
11 The Commission voted to accept the meeting minutes for December 17, 2020 on the motion of
12 Commissioner Donahue, second by Commissioner McCarthy.
13 The Commission opened the discussion continued from December 17, 2020 on the review of the
14 communication from Attorney Colleen Garry re: used car Dealer license at 1418 Middlesex Street, Abdi
15 Ardehali, d/b/a Karman Auto Sales. Attorney Garry was present. Attorney Garry stated that she had
16 received correspondence from the Massachusetts Attorney General’s office on the matter of her records
17 request about complaints filed from consumers of vehicles purchased from Karman Auto Sales. Attorney
18 Garry requested a continuance of the hearing in good faith since she heard from Attorney Peter Nicosia,
19 legal counsel for Abdi Ardehali, who is unable to join the meeting this evening. Atty. Garry stated she
20 contacted the bond company for the 2009 Abdi Ardehali surety bond, A.A. Dority. A.A. Dority has not
21 held the bond for a number of years. Atty. Garry requested proof of the bond for the last three or four years.
22 Chairman Descoteaux asked Asst. Solicitor Jenness about the bond requirements. Asst. Solicitor Jenness
23 stated it is a requirement for Class II licensees. It is not requested of a licensee to provide new copy of the
24 document [proof of renewal]. Chairman Descoteaux questioned what is the License Commission procedure,
25 how far can we go if [papers] are in line. If a customer has issue, is it the Attorney General or court
26 jurisdiction to pursue compliance in order to hold a licensee to adjudicate any dispute. Commissioner Howe

1 stated not to have a bond is an outrageous point; questioned the bond, to license a dealer who does not use
2 unfair practices. Asst. Solicitor Jenness referenced MGL chapter 93A - Regulation of Business Practices
3 for Consumers Protection, if licensee is not in compliance. At the conclusion of discussion, the
4 Commission, on the motion by Commissioner Howe, second by Commissioner Donahue, voted to schedule
5 the hearing for Abdi Ardehali, d/b/a Karman Auto Sales, to January 28, 2021 at 6 p.m. The licensee is to
6 provide evidence of compliance of MGL chapter 140, section 58, of $25,000 bond for years 2014 thru 2021.
7 The Commission reviewed the application filed by Akshar Sales Corporation, premises at 641-643 School
8 St., for change of license category from malt beverages and wines package store to all alcoholic beverages
9 package store. Attorney Andrew Zaroulis was present. Atty. Zaroulis stated the licensee’s business name is
10 Chuck’s Variety. It is a request to obtain an all-purpose license. The client is co-owner of the New Excel
11 Package Store [611 Merrimack St.]. Commissioner Howe inquired about the manager of New Excel store.
12 Atty. Zaroulis stated there will be a change of manager for New Excel. The Commission, on the motion by
13 Commissioner Donahue, second by Commissioner McCarthy, voted to schedule the public hearing for
14 Thursday, February 11, 2021 at 6:00 p.m. via ZOOM video conference; legal notice for publication Friday,
15 January 29, 2021 in the Lowell SUN newspaper.
16 The Commission reviewed the application filed by Coco Luna LLC, d/b/a The Luna Theater, premises at
17 250 Jackson St., for change of category from all alcoholic beverages restaurant to malt beverages and wines
18 restaurant. Jim Lichoulas, LLC Manager, was present. Mr. Lichoulas stated he would like to reduce the
19 “license” to malt beverages and wines only. The Commission, on the motion by Commissioner McCarthy,
20 second by Commissioner Howe, voted to schedule the public hearing for Thursday, February 11, 2021 at
21 6:00 p.m. via ZOOM video conference; legal notice for publication Friday, January 29, 2021 in the Lowell
22 SUN newspaper.
23 The Commission reviewed the application by Speed Motors Inc., Bruno P. Chagas Sales, President, 47
24 Aiken Ave., for Second Hand Motor Vehicles license, Class II, for calendar year 2021. Bruno P. Sales, and
25 Atty. Brian Akashian, legal counsel for Speed Motors, were present. Attorney Akashian stated that Mr.
26 Sales had interest in Revolution Motors, Inc. [located at 1582 Middlesex St.]. Mr. Sales has lived in

1 Chelmsford for two years. Atty. Akashian stated Mr. Sales will obtain a bond before the license is issued.
2 The Commission, on the motion by Commissioner Donahue, second by Commissioner McCarthy, voted to
3 grant a Second Hand Motor Vehicles license, Class II, [#773-B] used car Dealer to Speed Motors, Inc.,
4 Bruno P. Chagas Sales, President, for premises at 47 Aiken Ave.
5 The Commission, on the motion by Commissioner Donahue, second by Commissioner Howe, voted to
6 adjourn the meeting at 6:25 p.m.
