1 Minutes for the Lowell License Commission meeting for Thursday, February 11, 2021 at 6:00 p.m., held
2 in compliance with Governor Baker’s Emergency Order Modifying the State’s Open Meeting Law issued

6 Present: John Descoteaux, Commissioner, Chairman, Commissioners Clifford Krieger, Terry McCarthy,
7 Martha Howe, and Joseph Donahue.
8 Chairman Descoteaux convened the meeting at 6:00 p.m.
9 The Commission voted to accept the meeting minutes for January 28, 202 on the motion of Commissioner
10 Donahue, second by Commissioner Howe.
11 The Commission opened the public hearing on the application by Coco Luna LLC, d/b/a The Luna
12 Theater, James T. Lichoulas III, Manager, premises at 250 Jackson St., # 490, for change of license
13 category from all alcoholic beverages restaurant to malt beverages and wines restaurant. Jim
14 Lichoulas was present. The Commission reviewed and ordered placed on file the affidavit and
15 mailing notice to abutters and others signed by Mr. Lichoulas, and white postal slips. Chairman
16 Descoteaux opened the hearing for public comment. There was no one present to speak in favor
17 of the application, and there was no one present to speak in opposition to the application. The
18 Chairman closed the public comment portion of the hearing. The Commission, on the motion by
19 Commissioner McCarthy, second by Commissioner Donahue, voted to approve the application by
20 Coco Luna LLC, d/b/a The Luna Theater, premises at 250 Jackson St., # 490, for change of license
21 category from all alcoholic beverages restaurant to malt beverages and wines restaurant for
22 calendar year 2021.
23 The Commission opened the public hearing on the application by Akshar Sales Corporation,
24 Himansu Patel, Manager, premises at 641-643 School St., for change of license category from malt

1 beverages and wines package store to all alcoholic beverages package store. The following
2 individuals were present: Himansu Patel, and Attorney Andrew Zaroulis, legal counsel for Akshar
3 Sales Corporation. The licensee business name is “Chuck’s Variety.” The Commission reviewed
4 and ordered placed on file the affidavit and mailing notice to abutters and others filed by Attorney
5 Zaroulis, and green return receipts, with white postal slips. Chairman Descoteaux opened the
6 hearing for public comment. There was no one present to speak in favor of the application, and
7 there was no one present to speak in opposition to the application. The Chairman closed the public
8 comment portion of the hearing. The Commission, on the motion by Commissioner Krieger,
9 second by Commissioner Donahue, voted to approve the application by Akshar Sales Corporation,
10 Himansu Patel, Manager, premises at 641-643 School St., for change of license category from malt
11 beverages and wines package store to all alcoholic beverages package store for calendar year 2021.
12 The Commission reviewed the application by New Excel Package Store, Inc., all alcoholic
13 beverages package store licensee, premises at 611-613 Merrimack St., for change of manager of
14 record from Himansu Patel to Malay Patel of N. Chelmsford, MA. Attorney Andrew Zaroulis,
15 legal counsel for New Excel Package Store, Inc., was present to address the Commission about the
16 manager change. Attorney Zaroulis stated that Malay Patel was delayed in traffic, and unable to
17 appear on ZOOM. Attorney Zaroulis stated Mr. Patel’s background experience in the restaurant
18 business. Commissioner Howe questioned Atty. Zaroulis about Mr. Patel’s knowledge of the
19 alcohol beverage rules and regulations. Atty. Zaroulis stated that Mr. Patel is T.I.P.S. certified for
20 restaurant management, and will pursue certification for retail package store management. At the
21 conclusion of the hearing, the Commission, on the motion by Commissioner McCarthy, second by
22 Commissioner Howe, voted to approve Malay Patel as Manager of Record for New Excel Package
23 Store, Inc.

1 The Commission opened the public hearing on the application by Olympic Restaurant, LLC,
2 Ratana Heng, LLC Manager, for an all alcoholic beverages restaurant license for premises at 452-
3 454 Chelmsford St. It is requested Ratana Heng be approved as manager of record for Olympic
4 Restaurant, LLC. Olympic Restaurant, LLC has filed applications for license for common
5 victualler, and for entertainment in a licensed restaurant – live music, disc jockey, juke box. The
6 following individuals were present: Ratana Heng, and Attorney Michael Zaim, legal counsel for
7 Olympic Restaurant, LLC. Attorney Zaim stated Mr. Heng has business experience, but not
8 business with alcohol beverages. Atty. Zaim described the premises at 452-454 Chelmsford as
9 designed to be a function hall, which was previously owned and managed by the licensee Sunnyda.
10 Commissioner Donahue questioned if there would be a lounge with restaurant. Atty. Zaim stated
11 Mr. Heng would like to operate as a function hall. Commissioner McCarthy asked the capacity for
12 the hall. Atty. Zaim stated the capacity is 400. Atty. Zaim stated that Mr. Heng and staff for the
13 function hall will be T.I.P.S. and S.A.F.E. certified, and will also have Crowd Control Manager
14 training. The Commission reviewed and ordered placed on file the affidavit and mailing notice to
15 abutters and others filed by Attorney Zaim, and green return receipts, with white postal slips.

20 by Olympic Restaurant, LLC for an all alcoholic beverages restaurant license for premises at 452-
21 454 Chelmsford St., for calendar year ending December 31, 2021. The Commission approved
22 Ratana Heng as Manager of Record for Olympic Restaurant, LLC. The Commission granted the
23 license for common victualler, and entertainment in a licensed restaurant-live music, disc jockey,

1 juke box to Olympic Restaurant, LLC, for premises at 452-454 Chelmsford St. for calendar year
2 2021.
3 The Commission reviewed the application by DCD Nucar Loma, Inc., Christopher D. Dagesse,
4 President, doing business as Nucar Lannan Chevrolet of Lowell, for Second Hand Motor Vehicles
5 license, Class I, used car Agent, for premises at 831 Rogers St., for calendar year 2021. Licensee
6 is Lannan Chevrolet of Lowell Inc., # 197-A. Attorney Kevin Broderick, legal counsel for DCD
7 Nucar Loma, Inc., appeared before the Commission. Attorney Broderick stated that Christopher
8 Dagesse with his father were viewing the meeting. Atty. Broderick stated DCD Nucar Loma is
9 requesting a Class I Agent license for the Chevrolet dealership. The Commission reviewed the
10 application and supplementary documents, submitted by Christopher Dagesse for DCD Nucar
11 Loma, Inc. The Commission, on the motion by Commissioner Krieger, second by Commissioner
12 Donahue, voted to grant a Second Hand Motor Vehicles-Class I, used car Agent license [# 210-A]
13 to DCD Nucar Loma, Inc., Christopher D. Dagesse, President, doing business as Nucar Lannan
14 Chevrolet of Lowell, for premises at 831 Rogers St., for license year ending January 1, 2022. The
15 Class I, Agent license for Lannan Chevrolet of Lowell Inc., # 197-A, is cancelled effective issuance
16 of said license to DCD Nucar Loma, Inc.
17 The Commission reviewed the application by Mr. Nice Guys Auto Sale and Repair Inc., Krikour
18 Jabnian, President, for Second Hand Motor Vehicles license, Class II, used car Dealer, for premises
19 at 147 Cambridge St., Front. The following individuals were present: Krikour Jabnian, Scheila
20 Kindermann Campos, and a spokesperson. The Commission was advised that Mr. Jabnian and his
21 business partner have 12 years of experience in the second hand motor vehicle business. The
22 Commission reviewed the application and supplementary documents, submitted by Mr. Nice Guys
23 Auto Sale and Repair Inc. The Commission, on the motion by Commissioner McCarthy, second

1 by Commissioner Howe, voted to grant a Second Hand Motor Vehicles-Class II, used car Dealer
2 license [# 774-B] to Mr. Nice Guys Auto Sale and Repair Inc., Krikour Jabnian, President, for
3 premises at 147 Cambridge St., Front., for year ending January 1, 2022.
4 The Commission, on the motion by Commissioner Krieger, second by Commissioner McCarthy, voted to
5 adjourn the meeting at 6:30 p.m.
