Lowell Zoning Board of Appeals Minutes
September 25, 2023 at 6:30 P.M.

Members Present: Chairman Pech, Vice Chair Callahan, Member McCarthy Member Briere, Member
Procope, Member Hovey
Members Absent: Member Nickerson
Others Present: Dylan Ricker, Associate Planner
The following represents the actions taken by the Zoning Board of Appeals at the 9/25/2023 meeting. This
meeting was held in the City Council chambers. Attendees had the ability to participate via Zoom as
permitted by Chapter 107 of the Acts of 2022, signed into law on July 16, 2022.
Chairmain Pech called the meeting to order at 6:30 PM

Fair Housing Training
The Citizens Planner Training Collaborative (CPTC) will hold a fair housing training.

J. Raitt presented the fair housing training.
III. Other Business
17 Montreal Street; 264-266 Plain Street: Administrative Review
Administrative Review to review compliance with the Special Permit approved September 27, 2022 and
compliance with outstanding conditions of approval.

Catherine Flood, Applicant’s Representative
C. Flood explained the updated work done since the last meeting. C. Flood said the portion of the fence on
the city ROW was removed and its inclusion in the plan was an oversight.
Discussion:
S. Callahan said that DPD sent a report from an abutter that said work was being done outside of work hours.
C. Flood said she was not aware of the report.
D. McCarthy asked why there was such a delay in complying the conditions of approval. C. Flood said she is
unsure why, and said her client is willing to comply with all conditions.
T. Hovey said there was a complaint about the property and said questions remain. D. McCarthy suggested an
administrative review be done in 3 months. V. Pech and G. Procope agreed.
C. Flood said she believes all of the conditions are complied with at this point. D. McCarthy said he would like
a new as-built for the fencing.
Motion:
D. McCarthy motioned, and G. Procope seconded the motion to continue the administrative review to the
January 8, 2024 Zoning Board of Appeals meeting. The motion passed unanimously, (5-0).

D. McCarthy motioned, and S. Callahan seconded the motion to approve the September 11, 2023 Zoning
Board meeting minutes. The motion passed unanimously, (5-0).
2024 Zoning Board of Appeals Schedule
D. McCarthy motioned, and G. Procope seconded the motion to approve the 2024 Zoning Board meeting
schedule. The motion passed unanimously, (5-0).
IV. Adjournment
D. McCarthy motioned and S. Callahan seconded the motion to adjourn the meeting. The time was
8:02PM.

The City of Lowell Zoning Board of Appeals will hold a meeting on Monday, September
25, 2023 at 6:30 PM.
Meetings will be held on Zoom ONLY by using remote participation as
follows:
Members of the public may view the meeting via ltc.org or local cable
channel 6. Those wishing to speak regarding a specific agenda item shall
register to speak in advance of the meeting by sending an email to
fcigliano@lowellma.gov AND dricker@lowellma.gov indicating the
agenda item and a phone number to call so that you may be issued zoom
link to the meeting. If no access to email, you may contact Development
Services at 978-674-4144. All requests must occur prior to 4:00PM on
the day of meeting.
