Lowell Zoning Board of Appeals Minutes May 13, 2024 at 6:30 P.M. Note: These minutes are not completed verbatim. Members Present: Chairman Pech, Vice Chair Callahan, Member McCarthy, Member Briere, Member Procope, Member Hovey Members Absent: Member Nickerson Others Present: Peter Cutrumbes, Assistant Planner The following represents the actions taken by the Zoning Board of Appeals at the 5/13/2024 meeting. This meeting was held in the City Council chambers. Attendees had the ability to participate via Zoom as permitted by Chapter 107 of the Acts of 2022, signed into law on July 16, 2022. Chairman Pech called the meeting to order at 6:30 PM I. Continued Business II. New Business ZBA-2024-15 Petition Type: Variance Applicant: Lexx Estates LLC Property Located at: 63 Chambers Street 01852 Applicable Zoning Bylaws: Section 5.1; Section 6.1.4 Petition: Lexx Estates, LLC has applied to the Zoning Board of Appeals seeking Variance approval to demolish a pre-existing, non-conforming 6-bay garage and construct a 6-unit townhouse-style development at 63 Chambers Street. The property is located in the Traditional Neighborhood Multifamily (TMF) zoning district and requires Variance approval under Section 5.1 for relief from the usable open space requirement and under Section 6.1.4 for relief from the off-street parking requirements and for any other relief required under the Lowell Zoning Ordinance. On Behalf: The applicant’s attorney, Catherine Flood, digitally submitted a request to continue to the June 10 meeting. Speaking in Favor: None Speaking in Opposition: None Discussion: V. Pech noted the applicant asked to continue to the 6/10 meeting. Motion: G. Procope motioned to continue to the 6/10 meeting, seconded by S. Callahan. The vote was unanimous (6-0). III. Other Business 45 Concord Road – Variance Extension Request The applicant is requesting a six (6) month variance extension for a variance issued by the Zoning Board of Appeals on May 22, 2023. On Behalf: John Geary, attorney for the applicant, spoke on behalf. The applicant is requesting a 6-month extension. They received a Variance for LA/DU to develop the land. J. Geary said the applicants are in the process of finalizing business plans and financing. Speaking in Opposition: None Speaking in Favor: None Discussion: D. McCarthy said he is glad they are asking for an extension because he thinks it is a good project. S. Callahan echoed this sentiment and has no objections. Motion: G. Procope motioned to approve the six (6) month Variance extension. M. Briere seconded. The vote was unanimous (6-0). Minutes for Approval: 4/22/2024 meeting minutes G. Procope motioned to approve the minutes. S. Callahan seconded. The vote was unanimous (6-0). IV. Adjournment G. Procope motioned to adjourn the meeting, seconded by S. Callahan. The meeting was adjourned at 6:37 PM.

New Business ZBA-2024-16 Petition Type: Variance Applicant: Samuel Borba Property Located at: 85 Seneca Street, 01852 Applicable Zoning Bylaws: Section 6.1 Petition: Samuel Borba has applied to the Zoning Board of Appeals seeking Variance approval to create a parking area at 85 Seneca Street. The subject property is located in the Traditional Two-Family (TTF) zoning district, and requires Variance approval per Section 6.1.10 for relief from the maximum curb cut requirements and minimum driveway setback requirements, and any other relief required under the Lowell Zoning Ordinance. ZBA-2024-17 Petition Type: Variance Applicant: Christopher T. Natale Property Located at: 43 Fletcher Street, 01854 Applicable Zoning Bylaws: Section 9.8 Petition: Christopher T. Natale has applied to the Zoning Board of Appeals seeking Variance approval to demolish the existing building and construct a mixed-use building comprised of 20 residential units and 3,442 square feet of commercial space. The subject property is located in the Urban Mixed-Use (UMU) zoning district, and the Multi-Family Overlay – Mid-Rise (MFOM) overlay district. The proposal requires Variance approval per Section 9.8.4 of the Lowell Zoning Ordinance for relief from the minimum lot area per dwelling unit requirement, and for any other relief required under the Lowell Zoning Ordinance. III. Other Business: 19-20 Academy Drive – Administrative Review The administrative review for the project located at 19-20 Academy Drive. The applicant was granted Variance approval to convert the existing building into twelve (12) residential units with the condition of an administrative review. The project was completed in January 2024.
