• TOWN OF LOXAHATCHEE GROVES TOWN COUNCIL MINUTES OF COUNCIL MEETING APRIL 2, 2019 CALL TO ORDER Mayor Pro tern DeMarios called the meeting to order at 7: IO p.m. PLEDGE OF ALLEGIANCE Mayor Pro tern DeMarios led the Pledge of Allegiance. MOMENT OF SILENCE ROLL CALL Mayor Pro Tern Dave DeMarios, Vice Mayor Pro tern Robert Shorr, Councilmembers Laura Danowski, Lisa El-Ramey and Phillis Maniglia, Town Manager James Titcomb, Town Attorney Michael D. Circullo, Jr. and Town Clerk Lakisha Burch. ADDITIONS/DELETIONS/REORGANIZATION OF AGENDA Town Attorney Circullo asked that 20 l 9-DD04 is changed from the District to the Town. COMMENTS FROM THE PUBLIC ON NON-AGENDA ITEMS There were public comments made from the following: Aileen Banky, Doreen Baxter, Nina Corning, Marge Herzog, Ken Johnson, Ron Jarriel, Casey Suchy and Karis Williams. Ms. Suchy gave Council a handout in which was received and filed. PRESENTATIONS AND PROCLAMATIONS I. Presentations to Dave Browning, Anita Kane and Todd McLendon for serving on the Town Council of the Town of Loxahatchee Groves. Mayor Pro tern DeMarios presented a Proclamation and plague to Mayor Dave Browning for his service in serving as Mayor for thirteen (13) years and Certificates of Appreciation to Anita Kane and Todd McLendon for their service in serving on the Town Council of the Town of Loxahatchee Groves. Mayor Pro tern DeMarios call for a recess to celebrate Mayor Browning and former Council Members Kane and McLendon. The meeting was called to order at 8:00 p.m. Town of Loxahatchee Groves April 2, 2019 Town Council Meeting Minutes Page No. 2 Mayor Dave Browning and wife gave a presentation to the Town of Loxahatchee Council and residents. There was public comment by Ron Jarriel. 2. Sheriffs (PBSO) Annual Update Report - Lt. Craig Turner Lt. Craig Turner of the Palm Beach County Sherriffs Office gave a PowerPoint presentation on the 2018 Annual Report. There was discussion among the Town Council and Lt. Turner regarding the annual report, expectations and priorities of the Sherriffs department regarding the Town of Loxahatchee Groves. The 2018 Palm Beach County Sheriffs Annual Report was received and filed. 3. Monthly Status Report - Municipal Technologies LLC - Steven Murray Steven Murray of Municipal Technologies gave status report to Town Council. There was continued discussion from the prior IT Workshop which was held at 5:00 p.m. Motion was made Council Member Maniglia second by Council Member Danowski to strip website to bear minimum and go to Civic Plus for new website design, upgrade website, ordering of equipment in the Town Manager's preview; it was voted as follows: Ayes: Councilmembers Danowski and Maniglia. Nyes: Mayor Pro tern DeMarois, Vice Mayor Pro tern Shorr and Councilmember El-Ramey. Motion failed 3-2. Motion was made El-Ramey seconded by Vice Mayor Pro tern Shorr to strip website starting in two (2) weeks, purchase new equipment and bring back a third bid for website design and ADA compliance at the May 7, 2019 Town Council meeting; it was voted as follows: Ayes: Mayor Pro tern DeMarois, Vice Mayor Pro tern Shorr, Councilmembers Danowski, El­ Ramey and Maniglia. Motion passed unanimonsly. 4. Monthly Status Report - Geoffrey B. Sluggett & Associates - Mary McNicholas Mary McNicholas from Geoffrey B. Sluggett & Associates gave an update about the two Bills, one in the House and one in the Senate. She also spoke about the two grant applications to the Palm Beach County Transportation Planning Agency (TPA) for the Transportation Alternatives (TA) Program Grant Funding to support the Town of Loxahatchee Groves Multi Use Trails Program and the Palm Beach County Transportation Planning Agency (TPA) for the Transportation Local Initiatives (LI) Program Grant Funding to suppott the Town of Loxahatchee Groves Okeechobee Boulevard Roundabouts Program. There was discussion among Town Council and Ms. McNichols. There was public comment Ron Jarriel. 5. Monthly Status Report - Land Research Management, Inc. - James Fleishmann James Fleishmann from Land Research Management, Inc. gave an update and status report on the following projects: Seth Byers, Southern Crossing, Revision ofArticle 87, Lighting and Sign Code Town of Loxahatchee Groves April 2, 2019 Town Council Meeting Minutes Page No. 3 and Community Hope Church. There was discussion among Town Council and Mr. Fleishmann. There was public comment by the following: Lisa Cruz, Ron Jarriel, Dennis Lipp and Karis Williams. 6. Monthly Status Report - Keshavarz & Associates, Inc- Randy Wertepny Randy Wetepny from Keshavarz & Associates, Inc. gave an update and status report. There was discussion among Town Council and Mr. Wertepny. 7. Status Report for OGEM (Open Grade Emulsion Mix) Loan Audit - Rick Hartley Rick Hartley, Financial Consultant addressed the Council regarding the Open Grade Emulsion Mix Loan Audit and stated that a final report would be given at the next Town Council meeting that will be held on May 7, 2019. There was discussion among the Council and Mr. Hattley. There was public comment by Ron Jarriel. CONSENT AGENDA 8. Minutes from March 19, 2019 meeting. 9. Resolution No.2019-21 supporting of an application to the Palm Beach County Transportation Planning Agency (TPA) from the Town of Loxahatchee Groves for the Transportation Alternative (TPA) Program Grant Funding to support the Town of Loxahatchee Groves Multi Use Trails Program. There was public comment by Ron Jarriel. I 0. Resolution No. 2019-22 supporting of an application to the Palm Beach County Transportation Planning Agency (TPA) from the Town of Loxahatchee Groves for the TPA Local Initiatives (LI) Program Grant Funding to support the Town of Loxahatchee Groves Okeechobee Boulevard Roundabouts Program. There was public comment by Ron Jarriel. 11. GOREN, CHEROF, DOODY & EZROL, P.A. Invoices for March 2019. 12. Resolution No. 2019-DD04 authorizing the purchase of a John Deere through the Florida Sheriffs Association 2018-2019 Contract FSA 18-VEH 16.0. Motion was made by Councilmember Maniglia seconded by Councilmember Danowski to approve the Consent Agenda; it was voted as follows: Ayes: Mayor Pro tern DeMarois, Vice Mayor Pro tern Shorr, Councilmembers Danowski, El-Ramey and Maniglia. Resolution No. 2019-19 selection of Mayor of the Town of Loxahatchee Groves. Town Attorney Circullo explained the process of selecting a Mayor and asked were there any nominations. Councilmember Maniglia nominated Councilmember Lisa El-Ramey, Vice Mayor Pro tern Shorr nominated himself and Mayor Pro tern DeMarios nominated himself. A vote was called, and the results were as follows: Councilmember Maniglia and Councilmember El-Ramey voted for Councilmember El-Ramey, Vice Mayor Pro tern and Councilmember Danowski voted for Vice Mayor Pro tern Shorr and Mayor Pro tern DeMarois voted for himself. The results were 2-2-1. The Town Attorney asked for the nomination to be re-done ending in the same results. There was public comment made by the following Dennis Lipp and John Ryan. There was further discussion among the Town Council. Motion was made by Councilmember Maniglia seconded by Vice Mayor Pro tern Shorr to select Robert Shorr as Mayor for the ensuing year 2019-2020; it was voted as follows: Ayes: Mayor Pro tern DeMarois, Vice Mayor Pro tern Shorr, Councilmembers Danowski, El­ Ramey and Maniglia. Motion passed unanimously. 14. Resolution No. 2019-20 selection of Vice Mayor of the Town of Loxahatchee Groves. Town Attorney Circullo explained the process of selecting a Vice Mayor and asked were there any nominations. Councilmember Maniglia nominated Councilmember Lisa El-Ramey, Vice Mayor Pro tern nominated Mayor Pro tern Dave DeMarios. A vote was called, and the results were as follows: Councilmember Maniglia and Councilmember El-Ramey voted for Councilmember El-Ramey, Vice Mayor Pro tern Shorr, Councilmember Danowski and Mayor Pro tern DeMarios voted for Mayor Pro tern DeMarios. The results were 2-3. There was discussion among the Town Council. Motion was made by Councilmember Danowski seconded by Vice Mayor Pro tern Shorr to select Dave DeMarois as Vice Mayor for the ensuing year 2019-2020; it was voted as follows: Ayes: Mayor Pro tern DeMarois, Vice Mayor Pro tern Shorr, Councilmembers Danowski, El-Ramey and Maniglia. Motion passed unanimously. 15. Resolution No. 2019-23 appointing voting members of the Finance Advisory and Audit Committee. Item was presented to Town Council asking for the appointment of the voting members to the Finance Advisory and Audit Committee (FAAC), the appointments were as follow: Town of Loxahatchee Groves April 2, 2019 Town Council Meeting Minutes Page No. 5 Mayor Pro tern DeMarois Bruce Cuningham Vice Mavor Pro tern Shorr Janet Eick Councilmember Danowski Peter Savino Councilmember EI-Ramev Vacant Councilmember Maniglia Anita Kane Laura Cacionno (Alt.) Motion was made by Councilmember Danowski seconded by Councilmember Maniglia to appoint the above named as voting members of the Finance Advisory and Audit Committee to serve a term that will expire on March 10, 2020; it was voted as follows: Ayes: Mayor Pro tern DeMarois, Vice Mayor Pro tern Shorr, Councilmembers Danowski, EI-Ramey and Maniglia. Motion passed unanimously. 16. Resolution No. 2019-24 appointing regular members of the Planning and Zoning Board Committee. Item was presented to Town Council asking for the appointment of the voting members of the Planning and Zoning Board (P&Z), the appointments were as follow: Mavor Pro tern DeMarois William Bell Vice Mavor Pro tern Shorr Neil O'Neal Councilmember Danowski Mark McCov, Jr. Councilmember El-Ramey Vacant Councilmember Mani!:!lia William Ford Motion was made by Vice Mayor Pro tern Shorr seconded by Couucilmember El-Ramey to appoint the above named as voting member of the Planning and Zoning Board to serve a term that will expire on March 10, 2020; it was voted as follows: Ayes: Mayor Pro tern DeMarois, Vice Mayor Pro tern Shorr, Councilmembers Danowski, El-Ramey and Maniglia. Motion passed unanimously. 17. Resolution No. 2019-25 appointing regular members of the Roadway, Equestrian, Trails and Greenway Advisory Committee. Final Reading of Ordinance No. 2019-01 Codifying Water Control District Special Action There was a consensus by Town Council to move this item to the May 7, 2019 Town Council meeting. Town Attorney presented the item. There was discussion among the Town Council. There was public comment was made by Ron Jarriel. Motion was made by Supervisor El-Ramey seconded by Supervisor Danowski to designate Robert Shorr as District President of the Loxahatchee Groves Water Control District a dependent District of the Town of Loxahatchee Groves; it was voted as follows: Ayes: District President Pro tern DeMarios, Supervisors Danowski, El-Ramey, Maniglia and Shorr. Motion passed unanimously. 21. Resolution No. 20 l 9-DD07 selecting of the Water Control District Treasurer Item was presented to Town Council. There was discussion among Town Council. Motion was made by Supervisor Maniglia seconded by Supervisor Shorr to designate Laura Danowski as District Treasure of the Loxahatchee Groves Water Control District a dependent District of the Town of Loxahatchee Groves; it was voted as follows: Ayes: District President Pro tern DeMarios, Supervisors Danowski, El-Ramey, Maniglia and Shorr. Motion passed unanimonsly. DISTRICT CONSENT AGENDA 22. Approval of Warrant No. 2019-02 authorizing reimbursement to Town for Water Control District expenditures. There was public comment made by Ron Jarriel. Motion was made by Vice Mayor Pro tern Shorr seconded by Councilmember Maniglia to approve Resolution No. 2019-DD0l; it was voted as follows: Ayes: Mayor Pro tern DeMarois, Vice Mayor Pro tern Shorr, Councilmembers Danowski, El-Ramey and Maniglia. Motion passed nnanimously. TOWN STAFF REPORTS 23. Manager's Repmt Town Manager Titcomb presented the following topics to the Town Council for discussion: • April 24, 2019 Palm Beach County League of Cities Luncheon and workshop for newly elected officials. • Goal setting & Vision for the Town • Presentation for the May 7th Town Council Meeting regarding budget snap shot and 60 day over lay/future workforce Town of Loxahatchee Groves April 2, 2019 Town Council Meeting Minutes Page No. 8 • Meeting limits- Workshops/Meeting (2 a month) There was public comment made by Ron Jarriel. 24. Town Attorney's Report No repo1t. 25. Public Works Report (Town & District combined) Larry Peters, Director of Public Works presented the item. There was discussion among Town Council and Mr. Peters regarding approval of negotiated contract Palm Beach Aggregates, Water truck rental with Sunbelt Rentals and grading schedule Copy of the Proposal for Palm Beach Aggregates and quote for Sunbelt Rentals was received and filed by Town Council. There was public comment made by Ron Jarriel. Motion was made by Vice Mayor Pro tern Shorr seconded by Councilmember Maniglia to approve rental of 2000 gallon Water truck monthly proposal with Sunbelt Rentals; it was voted as follows: Ayes: Mayor Pro tern DeMarois, Vice Mayor Pro tern Shorr, Councilmembers Danowski, El-Ramey and Maniglia. Motion passed unanimously. Motion was made by Vice Mayor Pro tern Shorr seconded by Councilmember Maniglia to approve negotiated contract with Palm Beach Aggregates; it was voted as follows: Ayes: Mayor Pro tern DeMarios, Vice Mayor Pro tern Shorr, Councilmembers Danowski, El­ Ramey and Maniglia. Motion passed unanimously. TOWN COUNCILMEMBER REPORTS 26. Councilmember Danowski requested discussion items: • "Miami Dolphin" Sod Farm Q&A, schedule workshop? Councilmember Danowski presented the above-mentioned item and there was discussion among Town Council. She thanked Mayor Pro tern DeMarois for his vote and stated she would like a group to take a tour. There was public comment made by Ron Jarriel. 27. Councilmember Demarais requested discussion items: No report. 28. Councilmember El Ramey requested discussion items: Councilmember El-Ramey spoke on workshops. 29. Councilmember Maniglia requested discussion items: Town of Loxahatchee Groves April 2, 2019 Town Council Meeting Minutes Page No. 9 • Garbage changes/considerations for inclusion in RFP process. • Town Code for roadside vendors (i.e. farms stand, food trucks, merchandise) Councilmember Maniglia presented the above-mentioned items and there was discussion among Town Council. She spoke about what she would like to see regarding the ULDC going forward on overlay, 5-year vision plan, moving forward with Code Enforcement and going out for bids for garbage. There was public comment made by Ron Jarriel. 30. Councilmember Shorr requested discussion items: • Town Scholarship Fund & Committee moving forward. • Water Truck needs (rental, purchase, lease, FY I 9/FY20) • F Road repairs (prioritize) Vice Mayor Pro tem Shorr presented the above-mentioned items and there was discussion among the Town Council. Motion was made by Vice Mayor Pro tem Shorr seconded by Councilmember Maniglia to move forward with the Town's Scholarship Fund & Committee; it was voted as follows: Ayes: Mayor Pro tem DeMarois, Vice Mayor Pro tem Shorr, Councilmembers Danowski, El-Ramey and Maniglia. Burch Civility: Being "civil" is not a restraint on the First Amendment right to speak out, but it is more than just being polite. Civility is stating your opinions and beliefs, without degrading someone else in the process. Civility requires a person to respect other people's opinions and beliefs even if he or she strongly disagrees. It is finding a common ground for dialogue with others. It is being patient, graceful, and having a strong character. That's why we say "Character Counts" in Town of Loxahatchee. Civility is practiced at all Town meetings. All witnesses testifying will be "sworn" prior to their testimony. However, the public is permitted to comment, without being sworn. Unsworn comment will be given its appropriate weight by the Town Council. Appeal of Decision: If a person decides to appeal any decision made by the Town Council with respect to any matter considered at this meeting, he or she will need a record of the proceeding, and for that purpose, may need to ensure that a verbatim record of the proceeding is made, which record includes any testimony and evidence upon which the appeal will be based.
