CITY OF LYNDEN CITY COUNCIL MINUTES OF REGULAR MEETING November 4, 2024 1. CALL TO ORDER Mayor Korthuis called to order the November 4, 2024 regular session of the Lynden City Council at 7:00 p.m. in the city council chambers. PLEDGE OF ALLEGIENCE ROLL CALL Members present: Councilors Gary Bode, Lee Beld, Gary Vis, Brent Lenssen, and Nick Laninga. Members absent: Councilor Strengholt absent with notice. Councilor Wohlrab arrived after roll call. Staff present: Community Development Director Heidi Gudde, Finance Director Laura Scholi, Fire Chief Mike Noonan, HR Director Kari Heeringa, Police Chief Steve Taylor, Public Works Director Jon Hutchings, City Clerk Pam Brown, City Administrator John Williams, and City Attorney Bob Carmichael. OATH OF OFFICE - Fire Chief Mike Noonan. SUMMARY REPORTS AND PRESENTATIONS - None. APPROVAL OF MINUTES Councilor Vis moved, and Councilor Beld seconded, to approve the October 21, 2024 regular council minutes. Motion approved on 5-0 vote. CITIZEN COMMENT - None. 2. CONSENT Set Public Hearinci for the 2025 Property Tax Levy Councilor Bode moved, and Councilor Vis seconded, to approve the Consent Agenda. Motion approved on 5-0 vote. 3. PUBLIC HEARING Public Hearing for the 2025 Budget Mayor Korthuis opened the public hearing at 7:07 p.m. There were no comments. UNFINISHED BUSINESS-None. 5. NEW BUSINESS Extension of Preliminary Plat Approval - DeJong Long Plat 19-02 Lesa Starkenburg-Kroontje, on behalf of the DeJong family, is requesting an extension of preliminary plat approval for Phase 2 of the DeJong long plat. This long plat is located north of Aaron Drive near Line Road. The property is approximately 9.44 acres in size and is zoned as residential multi-family, RM-3. The two-phased long plat was granted preliminary approval February 18, 2020. Phase 1 infrastructure was completed, and then final plat was granted for that phase in July of 2021. Since then, most of the lots in this phase have been developed. Phase 2 will include lots 12- 23 and the completion of the internal street loop. Lynden Municipal Code 18.18.020 states that preliminary plat approvals must be submitted to the city for approval within 5 years of the date of preliminary plat approval. Although the DeJong Family intends to seek final plat approval for Phase 2, due to circumstances beyond their control, they do not anticipate meeting the 5-year deadline. They are asking Council to approve a one-year extension on the preliminary plat approval. LMC 18.18.020 states that the Council may extend the time limit for one year at a time and only two such extension shall be approved. If the final plat is not submitted or completed by the end of all approved extensions, then it shall be considered abandoned and an application for subdivision must be resubmitted. This is the first extension that is being requested for this preliminary plat approval. Councilor Lenssen moved, and Councilor Laninga seconded that City Council grant a one-year extension of the preliminary approval of the DeJong Long Plat, Phase 2, an extension which begins from the previously established 5-year deadline of the preliminary approval which occurred on February 18, 2020. Motion approved 6-0, with Councilor Wohlrab in attendance. 6. REPORTS Councilor Bode reviewed the Public Works Committee meeting minutes. Councilor Lenssen reviewed the Community Development Committee meeting minutes. 300 4"' Street, Lynden, WA 98264 www.lyndenwa.org Page 2 of 3 CITY OF LYNDEN CITY COUNCIL MINUTES OF REGULAR MEETING Councilor Beld asked the Council to consider the possibility of scheduling a work session/meeting with local contractors to discuss what associated costs may be for the Pepin Creek project. Mayor Korthuis encourage all Council members to attend a Special Finance Committee Meeting scheduled for 3 p.m. on Wednesday, November 6th to discuss the preliminary 2025 Budget. Councilor Lenssen thanked the downtown merchants, police and fire staff, and others for their participation in the Halloween Trick or Treat event. Mayor Korthuis informed Council that Canature's (Canature Processing Ltd) construction has stopped. The contractor has not been paid and the owner's currently do not have the cash flow required to finish the project. 7. EXECUTIVE SESSION Council did not hold an executive session. 8.
