The Common Council of the City of Madison, Indiana, met in regular session at 5:30 P.M. at City Hall, 101 W. Main
Street, Madison, IN 47250.
Mayor Bob Courtney opened the meeting with the Lord’s Prayer followed by the Pledge of Allegiance.
Present: Krebs, Wilber, Schafer, Dattilo, Storm, and Bartlett were present. Thevenow was absent (6-1).
Minutes: Wilber moved to approve the minutes from the May 19, 2026, regular meeting, seconded by Krebs. All in
favor, motion carried (6-0).
Presentation of petitions, memorials, remonstrances, introduction of motion & guests: None.
Resolutions or Bills: Resolution 2026-4C: Resolution for Property Tax Abatement (Sponsor: Wilber) (Sets forth
the findings regarding a partial real property tax abatement for new hotel): Economic and Redevelopment Director Tony
Steinhardt provided the Council and the public with an overview of the proposed new hotel project. The
presentation included summaries of projected property tax revenue, innkeeper’s tax revenue, first-year wage
projections, local income tax revenue, and overall anticipated new tax revenue. The full presentation is available for
viewing on the City of Madison YouTube channel. Motion: Bartlett moved to approve Resolution 2026-4C, seconded
by Krebs. Roll Call Vote: Krebs – Y, Dattilo – Y, Schafer – Y, Storm – Y, Bartlett – Y, Wilber – Y. All in favor, resolution
passes (6-0).
Ordinance 2026-11C: Establishing the TIF Grant Fund for the Madison Redevelopment Commission (Sponsor:
Krebs) (Creates non-reverting fund for grants accepted by the redevelopment commission) Motion: Bartlett moved to
suspend the rules and move to second reading, seconded by Schafer. All in favor, motion carried (6-0).
Ordinance 2026-12C: Establishing the TIF Donation Fund for the Madison Redevelopment Commission
(Sponsor: Krebs) (Creates non-reverting fund for donations accepted by the redevelopment commission) Motion:
Bartlett moved to suspend the rules and move to second reading, seconded by Schafer. All in favor, motion carried

Public comment (per sign-up sheet): Paula Weatherbee, 2685 W Pike Road, voiced concerns regarding flooding
for her area caused by the battery factory and possible flooding from proposed solar installations at the county jail.
Claude Rote, 820 Fillmore, asked the Council if he would be able to utilize Johnson Lake and Vaughn Drive for trailer
parking in the late Fall to collect old pumpkins for farmers.
Mayor’s comments: Thank you to all involved in the organization of the groundbreaking of Welch Park. The date
for the ribbon cutting of the Madison-Hanover Connector Trail will be announced in the next few weeks. The Mayor
attended an American Flood Coalition Summit for leadership across the country in Washington, D.C. for ideas and
policies regarding flood mitigation. Crystal Beach is now open.
The next regular meeting will be held on Tuesday, June 16, 2026, at 5:30 pm.

WHEREAS, the governing body understands and agrees that the current contribution rate is 23.3

WHEREAS, and at intervals directed by the Board of Trustees of the INPRS, its actuary will review the status of the employees
covered and shall adjust the contribution rate accordingly so that the 1977 Fund will remain on an actuarially sound basis; and
WHEREAS, if a town establishes a board of Metropolitan Board of Police Commissioners, or if a town becomes a city, the
municipality shall participate in the 1977 Fund and shall enroll all full-time police officers and firefighters in the 1977 Fund per
IC 36-8-8-3. Indiana Code regarding joining and participation in the 1977 Fund by Police, Fire, Airport, and School Resource Officer
units can be found at IC 36-8-8 and 35 IAC 2.
WHEREAS, IC 36-8-8-8(a) authorizes the employer to pay all or part of the mandatory employee contributions for employees
participating in the 1977 Fund. Check the box identifying the applicable unit employee type to be enrolled: (Select one):
Firefighters: For the employer to currently be in the Public Employees’ Retirement Fund (PERF) and join the 1977 Police
Officers’ & Firefighters’ Pension & Disability Fund (1977 Fund) the employer must not have established a 1937 Firefighters’
Pension Fund, and the employer is voluntarily joining the 1977 Fund.
Police: Per IC 36-8-8-3, for an employer to join the 1977 Fund or transfer from PERF to the 1977 Fund, the employer must have
created a Metropolitan Board of Police Commissioners, or similar Board.
School Resource Officer (SRO): An SRO hired or rehired by a school corporation or charter school that participates in the
1977 Fund, after June 30, 2024, and is a member of the 1977 Fund, will remain a member of the fund per IC 36-8-8-3(g).

3A. New Money Pick-Up - That the above contributions, even though designated as employee contributions for state law
purposes, are being paid by the employer in addition to regular compensation as a supplemental contribution that is separate
and distinct from the employees current or future compensation, and in lieu of contributions by the employees. Such
contributions will not be included in the gross income of the employees for any tax reporting purposes, such as for federal,
state or local income tax withholding, or FICA taxes, until distributed either through a pension benefit or a lump sum payment.
These contributions are made on a pre-tax basis and are paid by the employer on behalf of the employee.
3B. Salary Reduction Pick-Up - That said contributions, even though designated as employee contributions for state law
purposes, are being paid by the employer via a reduction in salary. Such contributions will not be included in the gross income of
the employees for certain tax reporting purposes, that is, for federal, state, or local income tax withholding, until distributed either
though a pension benefit or a lump sum payment. Such contributions will be included in the gross income of the employees for
FICA taxes when they are made. These contributions are made on a pre-tax basis but are paid by the employee through a
payroll deduction.

RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF MADISON,
INDIANA, CONFIRMING THE DESIGNATION OF AN ECONOMIC REVITALIZATION
AREA AND APPROVING THE DEDUCTION FROM ASSESSED VALUE OF NEW REAL
PROPERTY IMPROVEMENTS
(CLIFTY MADISON LLC)
WHEREAS, the City of Madison, Indiana (the “City”) has been requested by Clifty Madison LLC (the
“Company”), to find, pursuant to IC 6-1.1-12.1-2, as amended (the “Act”), that an area (the “Area”) in the City is an
Economic Revitalization Area, which Area will contain the Project (as hereinafter defined); and
WHEREAS, the Common Council of the City (the “Council”) has prepared a map of the Area, attached as
Exhibit A; and
WHEREAS, the Area is located within the jurisdiction of the City for the purposes set forth in the Act; and
WHEREAS, the Company intends to construct a redevelopment project consisting of the construction
and equipping of a new hotel project (the “Project”) on property (the “Real Property”) located in the Area, all as
described in the Statement of Benefits (the “Statement of Benefits”) submitted by the Company to the Council (the
“Project”); and
WHEREAS, the Council has reviewed the Statement of Benefits; and
WHEREAS, on June 2, 2026, the Council adopted a Resolution (the “Declaratory Resolution”), which
designated the Area as an “economic revitalization area” pursuant the Act and approved real property tax deductions
under the Act for redevelopment or rehabilitation the Area for up to six (6) years; and
WHEREAS, the Council published notice (the “Notice”) describing the adoption and substance of the
Declaratory Resolution and stating that, on the date hereof, the Council would hold a public hearing (the “Public
Hearing”) at which it will receive and hear all remonstrances and objections from interested persons with respect to
the Declaratory Resolution; and
WHEREAS, the Council filed, with each taxing unit that has authority to levy property taxes in the Area, a
copy of the Notice and the Statement of Benefits; and
WHEREAS, on the date hereof, the Council held the Public Hearing, at which it received, heard and
considered evidence concerning the Declaratory Resolution and any remonstrances or objections with respect to the
Declaratory Resolution; and
WHEREAS, the Council desires to take final action confirming the Declaratory Resolution;
NOW, THEREFORE, IT IS FOUND, DETERMINED AND RESOLVED by the Council:
Section 1. The Council hereby finds that (i) the Area is within the City and (ii) the Area has become
undesirable for, or impossible of, normal development and occupancy because of a lack of development, cessation
of growth, deterioration of improvements or character of occupancy, age, obsolescence, substandard buildings, or
other factors which have impaired values and prevented a normal development of property and use of property.
Section 2. The Area is hereby declared to be an “economic revitalization area” pursuant to the Act. The
maximum period for property tax deductions for redevelopment or rehabilitation in the Area shall be six (6) years.
Section 3. Based on the information in the Statement of Benefits describing the Project, the Council makes
the following findings:
(a) That the estimate of the value of the redevelopment or rehabilitation of the Real Property is reasonable
for projects of that nature.
(b) That the estimate of the number of individuals who will be employed or whose employment will be
retained as a result of the proposed redevelopment or rehabilitation of the Real Property can reasonably be expected
to result from the proposed redevelopment or rehabilitation of the Real Property.
(c) That the estimate of annual salaries of those individuals who will be employed or whose employment
will be retained can reasonably be expected to result from the proposed redevelopment or rehabilitation of the Real
Property.
(d) That the number of individual opportunities for employment, both temporary and permanent, and the
compensation to be paid to employees, along with the value of the acquisition and construction of improvements as
a result of the Project, create benefits of the type and quality anticipated by the Council within the Area and can
reasonably be expected to result from the proposed redevelopment or rehabilitation of the Real Property.
(e) That the benefits described in the Statement of Benefits can reasonably be expected to result from the
proposed redevelopment or rehabilitation of the Real Property.
(f) That the totality of benefits from the proposed redevelopment or rehabilitation of the Real Property is
sufficient to justify a 6-year real property tax deduction period.
Section 4. Based on the information in the Statement of Benefits and the foregoing findings, the Council, pursuant
to the Act, hereby approves and allows the Company real property tax deductions for six (6) years as set for in
Section 2 for the redevelopment located in the Area.
Section 5. With respect to the Real Property, the percentage of deductions for each of said six (6) years
shall be as follows:
Year 1 100%
Year 2 50%
Year 3 50%
Year 4 50%
Year 5 50%
Year 6 50%
Section 6. The Council hereby confirms the Declaratory Resolution, and the actions set forth in this
Resolution are final, except for the limited rights of appeal provided under the Act.
Section 7. The City Clerk-Treasurer is hereby authorized to make all filings necessary or desirable and to
take all other necessary actions to carry out the purposes and intent of this Resolution and the deductions approved
hereunder.
Section 8. This Resolution shall be in full force and effect from and after its passage by the Common
Council and its approval by the Mayor of the City of Madison, Indiana.
