MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON February 25, 2013 - 7 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 25th day of February, 2013. Mayor Conley called the meeting to order at 7 p.m. in the Committee Room of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 3, 2013. The Pledge of Allegiance was recited by all. Mayor Conley asked for a moment of silence for recently deceased Madison resident Wilfred Burkitt. APPROVAL OF MINUTES Ms. Baillie moved approval of the Executive Minutes of January 28, 2013. Mrs. Tsukamoto seconded the motion, which passed with the following roll call vote recorded: Yeas: Mrs. Tsukamoto, Mr. Catalanello, Mr. Landrigan. Mrs. Vitale, Ms. Baillie, Mr. Wolkowitz Nays: None GREETINGS TO PUBLIC Mayor Conley made the following comments: Mayor Conley reminded residents of the scheduled Capital budget hearing on Saturday March 2, 2013 at 9:00 a.m., and noted that he is working with members of the Madison Athletic Foundation regarding fund raising goals and will have more information, including an overview of the Open Space Tax, to report at the March 11th Council meeting. Proclaiming March 1, 2013 as Read Across America Day –Kings Road School teacher Susan Adamo and several students grades 2 through 5 were in attendance. WHEREAS, the citizens of the Borough of Madison stand firmly committed to promoting reading as the catalyst for our students’ future academic success, their preparation for America’s jobs of the future, and their ability to compete in a global economy; and WHEREAS, Madison has provided significant leadership in the area of community involvement in the education of our youth, grounded in the principle that educational investment is the key to the community’s well-being and long-term quality of life; and PAGE 2 OF 13 Regular Meeting Minutes – February 25, 2013 WHEREAS, NEA’s Read Across America, a national celebration of reading, will be conducted on March 1, 2013, the day before what would have been the 109th birthday of Theodor Seuss Geisel, better known as Dr. Seuss; and WHEREAS, Read Across America-NJ is being conducted statewide by the New Jersey Education Association, in partnership with the New Jersey State League of Municipalities, the New Jersey Library Association, and their local affiliates across the state to promote reading and adult involvement in the education of our community’s students; NOW, THEREFORE, I, Robert H. Conley, Mayor of the Borough of Madison, on behalf of the governing body, call on the citizens of Madison to assure that every child is in a safe place reading together with a caring adult on March 1, 2013. Further, we enthusiastically endorse NEA’s Read Across America and Read Across America-NJ and recommit our community to engage in programs and activities to make America’s children the best readers in the world. ___________________________________ Robert h. Conley, Mayor February 25, 2013 REPORTS OF COMMITTEES Health Mrs. Vitale of the Committee made the following comments: Mrs. Vitale reported that the Health Department completed food handlers’ classes with 51 participants and noted a 24% increase in learning. The next class will be held April 1st and early registration is recommended. Mrs. Vitale reminded residents that this is the last week for dog and cat license renewal, before late fines are imposed. The Health Department is looking for volunteers to do training for the ”Matter of Balance” program, a low impact exercise program for individuals at risk for osteoporosis. Mrs. Vitale announced that the Board of Health is working with the Board of Education on procuring donated hand sanitizers for all classrooms and is also working with school nurses on proper hand washing training to reduce colds and flu. Mrs. Vitale noted an article in a recent Daily Record regarding the Interfaith Pantry’s request that community gardeners plant additional crops for donation to local food pantries. Mrs. Vitale noted that on March 19th a wall-raising and ground breaking ceremony will take place at the site of three new homes on Strickland Place, with a luncheon to follow. Please contact the Madison Housing Authority for additional information. Utilities Mrs. Tsukamoto, Chair of the Committee, made the following comments: Mrs. Tsukamoto provided additional information regarding the wall-raising and ground breaking ceremony to take place at the site of three new homes on Strickland Place, with a luncheon to follow. Mrs. Tsukamoto stated that environmental clean up work at this site is completed and foundation work is done. More than 160 families participated in the selection process, twelve families were selected for the drawing and three Madison families were selected. Mrs. Tsukamoto will send an invitation to Council members for the ceremonies. The electric utility had a small transformer issue that was corrected quickly and Utility crews are continuing to make storm related repairs. The electric utility along with Mr. Burnet continues working on expanding mutual aid agreements with neighboring communities during emergencies. Public Works and Engineering Mr. Catalanello, Chair of the Committee, made the following comments: Mr. Catalanello reported that the Construction Review Committee met this past week and was attended by Ms. Baillie as well as several committee members. Several roads projects were discussed. Mr. Catalanello noted that there was discussion regarding recreation fields. Mr. Catalanello stated that he supports all recreation activities including fundraising and the Community Gardens, but would like to proceed cautiously regarding the plans for improvements to the Bayley Ellard fields. Robert Vogel, Borough Engineer was asked to modify the estimate for the Bayley Ellard fields project and Mr. Catalanello urged that the decision to proceed be based on need. Mr. Catalanello raised concern regarding the loss of fields at the Green Village Road School property and suggested working with the Board of Education regarding use of school fields. Mr. Catalanello also suggested updating the recreation Master Plan, working with the Recreation Director and the Board of Education, and suggested that the Borough may not need the fields at Bayley Ellard. Mr. Catalanello noted that the Council must do their due diligence and insisted that no funding be allocated until the Recreation Master Plan is revised. Community Affairs Mr. Landrigan, Chair of the Committee, made the following comments: Mr. Landrigan reported that the Madison Senior Advisory Committee is working on a spring program, to be held April 13th entitled ‘Editing Your Life’. Mr. Landrigan will provide additional information at the next Council meeting. Mr. Landrigan thanked Mrs. Vitale for her efforts with the purchase a new senior van and noted that ridership has increase. Mr. Landrigan announced that Saturday, May 4th is the annual May Day in Madison. Mr. Landrigan reported on his work with FEMA regarding storm related reimbursement. Mr. Landrigan also noted that it is very important for the Borough to have its own resources during an emergency and noted that a shelter is one issue being explored. Mr. Landrigan noted that Madison Medical Group stepped forward during the recent storm, opening their practice to residents and thanked Dr. Romano and Dr. Lejewski for their services. Mr. Landrigan noted his attendance at a Recreation Advisory Committee meeting were the need for a field restoration program was discussed. Mr. Landrigan will continue to work with the Recreation Director on a program. Public Safety Ms. Baillie, Chair of the Committee, made the following comments: Ms. Baillie reported on several recent editorial articles regarding the value of land preservation and noted that Madison voters, in 2003, overwhelmingly agreed to an Open Space tax for the purchased and preservation of land. Ms Baillie noted that as land became available, the Open Space Committee made recommendations to the Council, and the Borough acquired lands for use as parks and recreation as well as for historic preservation. The acquisition of the Bayley Ellard fields was completed with little Borough tax dollars and more Morris County Green Acres funds. Ms. Baillie noted that the Bayley Ellard property is zoned as open space. Finance and Borough Clerk Mr. Wolkowitz, Chair of the Committee, made the following comments: PAGE 4 OF 13 Regular Meeting Minutes – February 25, 2013 Mr. Wolkowitz asked that residents contact him with any questions regarding the municipal budget and noted that the Capital budget hearing is scheduled for Saturday March 2nd at 9:00 a.m. Mr. Wolkowitz also noted that a discussion regarding the recently completed revaluation of real property will be on the agenda of the March 11th Council meeting. COMMUNICATIONS AND PETITIONS The Borough Clerk announced receipt of the following communications: E-mail received February 19, 2013 from Pat Rowe, Pine Avenue regarding the municipal budget. INVITATION FOR DISCUSSION (1 of 2) Mayor Conley opened the meeting to the public for their opportunity to ask questions and make comments on those items listed on the Agenda only. Mayor asked that, upon recognition by the Chair, the person shall proceed to the lectern and give his/her name and address in an audible tone of voice, and print the same on the sheet provided for the record. He/she shall limit his/her statement to three (3) minutes or less. Since no member of the public wished to be heard, the invitation for discussion was closed. AGENDA DISCUSSIONS 02/25/2013-1 LITTLE LEAGUE FIELD IMPROVEMENTS Mr. Ernie Ciccone, President of Madison Little League, requested that the Council approve a donation of field improvements at Rosedale and Dodge Fields, including relocating and installing batting/pitching cages. Following discussion there was agreement to list a resolution to accept the donated improvements. Resolution R 87-2013 is listed on the Consent Agenda. ADVERTISED HEARINGS The Clerk made the following statement: The ordinance scheduled for hearing tonight was submitted in writing at a Regular meeting of the Mayor and Council held on January 28, 2013, was introduced by title and passed on first reading, was published in the Madison Eagle and made available to members of the general public requesting same. Mayor Conley called up Ordinances for second reading and asked the Clerk to read said ordinances by title: ORDINANCE 2-2013 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATION $165,000.00 FROM THE ELECTRIC CAPITAL IMPROVEMENT FUND FOR THE PURCHASE OF A NEW DIGGER/DERRICK TRUCK PAGE 5 OF 13 Regular Meeting Minutes – February 25, 2013 WHEREAS, the Electric Utility Superintendent has recommended that the Borough appropriate $165,000.00 from the Electric Capital Improvement Fund for the purchase of a new digger/derrick truck and related equipment; and WHEREAS, the Chief Financial Officer has attested to the availability of the funds in the Electric Capital Improvement Fund in an amount not to exceed $165,000.00 for this purpose; and WHEREAS, the Borough Council has determined that the Borough should appropriate $165,000.00 from the Electric Capital Improvement Fund for the purchase of a new digger/derrick truck and related equipment. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $165,000.00 is hereby appropriated from the Electric Capital Improvement Fund for the purchase of a new digger/derrick truck and related equipment. SECTION 2: The budget of the Borough is hereby amended to conform with the provisions of this Ordinance. SECTION 3: This Ordinance shall take effect as provided by law. Mayor Conley opened up the public hearing on Ordinance 5-2012. Since no member of the public wished to be heard, the invitation for discussion was closed. Mrs. Tsukamoto moved that Ordinance 2-2013, which was read by title, be finally adopted. Mrs. Vitale seconded the motion. Mrs. Vitale, Ms. Baillie, Mr. Wolkowitz Nays: None R 85-2013 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING DONATION OF BULLET PROOF VESTS TO THE MORRIS COUNTY POLICE ACADEMY WHEREAS, Police Chief Darren Dachisen has advised the Council that the Borough has ten (10 ) surplus bullet proof vests, which are no longer utilized by Madison Police Officers; and WHEREAS, the Police Chief has recommended that the bullet proof vests be donated, as is, to the Morris County Police Academy for use by their recruits; and WHEREAS, the Borough Council has concluded that it would be appropriate to donate such surplus equipment as recommended; NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris, in the State of New Jersey, that ten (10) surplus bullet proof vests be donated to the Morris County Police Academy. R 86-2013 RESOLUTION OF THE BOROUGH OF MADISON APPROVING TEMPORARY SIGNS FOR THE ARTS COUNCIL OF THE MORRIS AREA WHEREAS, the Arts Council of the Morris Area has requested permission to put up temporary signs advertising the 29th Annual Giralda Farms Concert featuring the New Jersey Symphony Orchestra on June 23, 2013, at the Giralda Corporate Park; and WHEREAS, the signs would be located on Woodland Road and on Route 124 outside the gates of the Giralda entrances, commencing on May 28, 2013 and be removed by June 26, 2013; and WHEREAS, the Assistant Borough Administrator has recommended that a temporary sign permit be issued. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that the request of the Arts Council of the Morris Area to put up temporary signs as described herein from May 28, 2013 to June 26, 2013, is approved. PAGE 7 OF 13 Regular Meeting Minutes – February 25, 2013 R 87-2013 RESOLUTION OF THE BOROUGH OF MADISON ACCEPTING MADISON LITTLE LEAGUE DONATION OF BATTING/PITCHING CAGES FOR ROSEDALE AND DODGE FIELDS WHEREAS, the Madison Little League, Inc., of Madison, New Jersey has organized generous donations to the Borough of Madison for relocating and installing batting/pitching cages at Rosedale and Dodge Fields; and WHEREAS, the Borough Council has concluded that it would be in the best interest of the Borough to accept the donated materials and labor to relocate and install pitching/batting cages at Rosedale and Dodge Fields under the direction of the Superintendent of Public Works; and WHEREAS, Madison Little League, Inc. will continue to maintain adequate insurance coverage with names the Borough of Madison as an additional named insured. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison in the County of Morris in the State of New Jersey that the Borough accepts the donations of materials and labor to relocate and install pitching/batting cages at Rosedale and Dodge Fields as described herein and permission is granted for such installation to be done under the direction of the Superintendent of Public Works. BE IT FURTHER RESOLVED that the Borough of Madison expresses its gratitude to the donors for this project. R 88-2013 RESOLUTION OF THE BOROUGH OF MADISON RATIFYING APPOINTMENT OF LUIS ALICEA TO THE POSITION OF TRUCK DRIVER I IN THE PUBLIC WORKS ROADS DEPARTMENT WHEREAS, Luis Alicea, Truck Diver II, in the Public Works Roads Department has satisfactory completed testing for the position of Truck Driver I; and WHEREAS, the Superintendent of Public Works has recommended the promotion of Luis Alicea to the position of Truck Driver I in the Public Works Roads Department PURSUANT TO Article XVII, Section 7 of the Teamsters Local 469 Collective Bargaining Agreement dated January 1, 2006. No. 1269 – Off premise June 25, 2013 R 94-2013 RESOLUTION OF THE BOROUGH OF MADISON RATIFYING A SHARED SERVICE AGREEMENT FOR LEAD HAZARD ASSESSEMENT WITH THE MORRIS COUNTY OFFICE OF HEALTH MANAGEMENT AND THE MADISON BOARD OF HEALTH PAGE 10 OF 13 Regular Meeting Minutes – February 25, 2013 WHEREAS, the Morris County Office of Health Management and the Madison Board of Health have agreed to enter into a Shared Services agreement for Lead Hazard Assessment Services for cases of elevated blood lead levels; and WHEREAS, the Morris County Office of Health Management lead hazard assessment shall be limited to x-ray fluorescence testing of surfaces and collection of dust wipe samples in accordance with N.J.A.C. 5:17-1.1, et seq.; and WHEREAS, the Madison Health Department shall be responsible for payment of all cost associated with the purchasing, processing and analysis of dust wipe samples, and; WHEREAS, the Chief Financial Officer has certified that adequate funding for this purpose is included in the 2013 Board of Health budget account #330, subaccount #215; and WHEREAS, the Madison Borough Council has reviewed the proposed agreement and is agreeable to contracting for such services. NOW, THEREFORE, BE IT RESOLVED that the Council of the Borough of Madison, in the County of Morris and State of New Jersey, ratifies the Shared Services agreement between the Madison Board of Health and the Morris County Office of Health Management for Lead Hazard Assessment Services as described herein. R 96-2013 RESOLUTION OF THE BOROUGH OF MADISON ACCEPTING A DONATION OF $44,954.80 FROM THE TRUSTEES OF THE HARTELY DODGE FOUNDATION FOR THE PURCHASE OF A 1921 AHRENS FOX FIRE TRUCK PAGE 11 OF 13 Regular Meeting Minutes – February 25, 2013 WHEREAS, the Trustees of the Hartley Dodge Foundation have generously offered to donate $44,954.80 from the funds pledged for the rehabilitation of the Hartley Dodge Memorial towards the purchase of the historic 1921 Ahrens Fox Fire Truck ‘Geraldine’; and WHEREAS, the Borough Council wishes to accept the generous donation and reallocate the funds donated by the Trustees of the Hartley Dodge Foundation to the Friends of Geraldine, a New Jersey Non Profit Organization, towards the purchase of the 1921 Ahrens Fox Fire Truck ‘Geraldine’ with the consent of the Trustees of the Hartley Dodge Foundation. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that the generous donation of $44,954.80 is hereby accepted and reallocated to the Friends of Geraldine. BE IT FURTHER RESOLVED that the Borough of Madison expresses its gratitude to the Trustees of the Hartley Dodge Foundation. INVITATION FOR DISCUSSION (2 of 2) Mayor opened the meeting to the public for their opportunity to ask questions and make comments on any subject. Mayor asked that, upon recognition by the Chair, the person shall proceed to the lectern and give his/her name and address in an audible tone of voice, and print the same on the sheet provided for the record. He/she shall limit his/her statement to three (3) minutes or less. Vincent Borge, Local 32 BJ Services International Service Union, addressed the Mayor and Council regarding the proposed redevelopment of the Green Village Road School property noting that Avalon Bay, a prospective developer, has failed to ensure the safety and fair wages of employees. Mr. Borge sited several incidents where workers were injured and paid low wages. Don Brunner, Redmond Drive, asked if Mayor and Council had a chance to discuss the Open Space tax. Mayor Conley noted that the discussion will be listed on the agenda for March 11th Council meeting. UNFINISHED BUSINESS - None APPROVAL OF VOUCHERS On motion by Mrs. Vitale seconded by Mrs. Tsukamoto and carried, the following vouchers of the Borough of Madison were approved for payment, and the supporting documentation of said vouchers was made part of the Supplemental Minute Book. Mrs. Vitale, Ms. Baillie, Mr. Wolkowitz Nays: None NEW BUSINESS Mayor Conley announced the following appointments: Sustainable Madison Advisory Committee Ellen Kranefuss, 49 Longview Avenue, for an unexpired three year term through December 31, 2014 Board of Health Marianne McConnell, 142 Ridgedale Avenue, for an unexpired four year term through December 31, 2015. Mrs. Vitale moved the appointments as listed. Ms. Baillie seconded the motion. There was no Council discussion and the motion passed with the following roll call vote recorded: Yeas: Mrs. Tsukamoto, Mr. Catalanello, Mr. Landrigan.
