MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON March 24, 2014 - 7 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 24th day of March, 2014. Mayor Conley called the meeting to order at 7:00 p.m. in the Committee Room of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 2, 2014. Ms. Baillie seconded the motion, which passed with the following roll call vote recorded: Yeas: Mr. Landrigan, Mrs. Vitale, Ms. Baillie, Mr. Wolkowitz, Mr. Rowe Nays: None Absent: Mr. Catalanello PAGE 2 OF 19 Regular Meeting Minutes – March 24, 2014 GREETINGS TO PUBLIC Mayor Conley presented the following proclamations: Proclamation of the B o r o u g h o f M a d i s on Proclaiming Colorectal Cancer Awareness Month March 2014 WHEREAS, colorectal cancer is the third most commonly diagnosed cancer and the second most common cause of cancer deaths for men and women in the United States and New Jersey; and WHEREAS, colorectal cancer affects men and women equally and every year there are over 150,000 new cases diagnosed with a death rate of over 50,000; and WHEREAS, colon cancer accounts for over 10.1% of all cancer cases and deaths in Morris County; and WHEREAS, only 39 percent of colorectal cancer patients have their cancers detected at an early stage; and WHEREAS, the survival rate of individuals who have early stage colorectal cancer is 90 percent which is why there are over one million colon cancer survivors in the United States; however, five percent of those diagnosed later will have cancer spread to other organs; and WHEREAS, if the majority of people in the United States age 50 or older were screened regularly for colorectal cancer, the death rate from this disease could plummet by up to 70 percent; and WHEREAS, colorectal cancer is preventable, treatable, and beatable in most cases; NOW, THEREFORE, I, Robert H. Conley, Mayor of the Borough of Madison, on behalf of the governing body, proclaim the month of March 2014 as Colorectal Cancer Awareness Month to provide a special opportunity to offer education on the importance of early detection and screening. ___________________________________ Robert H. Conley Mayor March 10, 2014 Mayor Conley presented a Proclamation to the Madison Young PlaywrightsTheatre for the month of March to Marketing Manager, Jennifer DeWitt and young Playwrights PAGE 3 OF 19 Regular Meeting Minutes – March 24, 2014 Proclamation of the B o r o u g h o f M a d i s on Proclaiming March 2014 as Madison Young Playwrights Month at Playwrights Theatre Madison, New Jersey Whereas, Playwrights Theatre, founded in 1986, has nurtured creative writing skills for all ages through the New Jersey Writers Project, a co-sponsored program of the New Jersey State Council on the Arts/Department of State; and Whereas, Playwrights Theatre has produced performances and offered new plays to local and statewide audiences as a result of its dedication to prospective playwrights; and Whereas, Playwrights Theatre, brings a unique program to the community through its local in-school playwriting initiative, the Madison Young Playwrights Program; and Whereas, Playwrights Theatre will present performances of student-written work during the Madison Young Playwrights Festival, to be presented in schools on March 19th, March 20th and March 28th; and Whereas, Playwrights Theatre has continually received a positive response from students, teachers, and parents for its effectiveness in working with all students, many of whom have realized the benefits of self-discovery and expression through playwriting; NOW, THEREFORE, I, Robert H. Conley, Mayor of the Borough of Madison, on behalf of the Governing Body, do hereby proclaim March 2014 as MADISON YOUNG PLAYWRIGHTS MONTH. In so doing, I extend very best wishes to Playwrights Theatre and to all young writers within our community for continued growth and success. Games to New Jersey WHEREAS, Special Olympics is an international organization that unleashes the human spirit through the transformative power and joy of sports every day around the world; and WHEREAS, through work in sports, health education and community building, Special Olympics is addressing inactivity, injustice, intolerance and social isolation by encouraging and empowering people with intellectual disabilities, which leads to a more welcoming and inclusive society; and WHEREAS, founded in 1968 by Eunice Kennedy Shriver, the Special Olympics movement has grown from a few hundred to nearly 4.2 million athletes in over 170 countries; and WHEREAS, with the support of more than one million coaches and volunteers, Special Olympics is able to deliver 32 Olympic-type sports and more than 70,000 competitions throughout the year, in national and international competitions; and WHEREAS, New Jersey has been selected to host the 2014 Special Olympics USA Games, which will take place June 14 – 21, 2014, with venues throughout Mercer County including Princeton University, Rider University, The College of New Jersey, the Lawrenceville School, the Hun School of Princeton, the Peddie School, the Sun National Bank Center and Mercer County Park, and Brunswick Zone- Carolier in Middlesex County, following the Opening Ceremony at Prudential Center in Newark; and WHEREAS, the 2014 USA Games will feature nearly 3,500 athletes competing in 16 Olympic-style sports, with the support of 1,000 coaches, 10,000 volunteers and an estimated 70,000 family, friends and spectators; and WHEREAS, the 2014 USA Games will showcase 270 Special Olympics athletes from New Jersey competing in this national event; NOW, THEREFORE, I, Robert H. Conley, Mayor of the Borough of Madison, on behalf of the governing body, whole-heartedly support the work of Special Olympics and we welcome to New Jersey all the athletes, families, coaches, officials and volunteers, who will make these 2014 USA Games a tremendous success and congratulate all who live by the motto of Special Olympics: “Let me win, but if I cannot win, let me be brave in the attempt.” __________________________________ Robert H. Conley Mayor March 10, 2014 PAGE 5 OF 19 Regular Meeting Minutes – March 24, 2014 Mayor Conley announced that, due to the Passover Holiday on Monday April 14, 2014, the next meeting of the Mayor and Council will be held on Thursday, April 10th noting that a hearing on the 2014 Municipal Budget is scheduled that evening. REPORTS OF COMMITTEES Health Mr. Landrigan of the Committee made the following comments: Mr. Landrigan noted the pneumonia vaccines are still available through the Madison Health Department. The Health Department recommends residents consult with their physicians. Mr. Landrigan noted that a report from the Passive Recreation Committees of the MRC will be presented at a future Council meeting, proposing a snow hill, dear fencing and restoration of the wetlands, as well as a play ground and trails improvement project. Public Works and Engineering Mr. Catalanello, Chair of the Committee, absent. Utilities Mrs. Vitale, Chair of the Committee, made the following comments: Mrs. Vitale, reporting for the Electric Utility Department, noted that the Department has completed new three phase service to 21 Central Ave. and removed transformers and completed demolition of primary voltage riser pole to the Green Village Rd. School property. The Electric Utility Department has also installed new poles, transformer, and cable for a Bardon Street housing development and completed pole transfers at Greenwood Ave. Reporting for the Engineering Department, Mrs. Vitale noted that a meeting was held with Kirby Center administration in anticipation of work on the parking lot this summer. Several meetings were attended with the County of Morris concerning Community Development Block grants. A Strategic Capital Planning meeting was held March 18th. A Complete Streets Committee meeting held on Wednesday March 19th, and an informal public hearing on road projects was held Thursday March 20th. The bid opening for the 2014 Road Improvement Program was held on Thursday March 13th. The bidders submitted costs to complete Academy, Belmont, part of North Street, Pine Tree, Durwood, Fletcher, part of Niles, Vinton and Wilson, a total of nine street segments. A contract award for the apparent low bidder is scheduled for this evening. The mill and overlay projects scheduled for this summer, include Division Avenue and Woodland Avenue near Union Hill Road. Construction plans and specifications for the East Street parking lot improvements are being complete by staff and the bid opening is scheduled for May 15th.The Sewer Main Lining bid documents are being produced in-house with an anticipated bid opening in May of this year. The Library is closed as work begins on asbestos remediation required by the HVAC replacement project. The HVAC design project is nearing completion and is expected to be bid in May . Public Safety Ms. Baillie, Chair of the Committee, made the following comments: The Complete Streets Committee met last week, continuing discussion of improvements to streets and sidewalks, as well as congestion of cars at area schools. With the warmer weather approaching, students are encouraged to walk to school. The Passive Recreation Committee of the MRC continues to clear and edge trails and the next date for continuing improvements is May15th. The Committee hopes to officially open the trails on June 7th, National Trails Day. PAGE 6 OF 19 Regular Meeting Minutes – March 24, 2014 Finance and Borough Clerk Mr. Wolkowitz, Chair of the Committee, made the following comments: In anticipation of the June 3rd Primary Election, the filing Deadline for nomination petitions for County Committee Member as well as for Municipal Office is March 31, 2014. Forms are available in the Clerk’s Office. Mr. Wolkowitz encouraged residents to attend the April 10th Council meeting as the Municipal Budget hearing is scheduled that evening. Mr. Wolkowitz also encouraged residents who are eligible to take advantage of the Senior Tax Freeze program and the New Jersey Energy Audit program. The Strategic Planning Committees are underway, and Mr. Wolkowitz thanks all the residents who volunteered to serve on c committee. Community Affairs Mr. Rowe, Chair of the Committee, made the following comments: Taste of Madison is scheduled for Monday, April 7, 2014. This event will be held at the Park Avenue Club and supports the Chamber of Commerce, the DDC and the Rotary Club. For tickets or more information, please visit the Taste of Madison website. The DDC is working on a pilot Wayfinding Signage Project. The plan is to start with Pilot Program that includes eight signs directing visitors from Florham Park, the MRC, Madison High School and Ridgedale Ave corridor to the Downtown area this spring and summer. The DDC is hoping to give a presentation to council and attain approval for the pilot program in April. The annual May Day clean up is scheduled for Saturday May 3rd . Those interested in donating or volunteering should contact Mara Johnson at 973.822.3900. The DDC and QUEST held a Bowling Fundraiser for the YMCA on March 19th at the Plaza Lanes. The next fundraiser is set for April 17th. Anyone interested in attending should contact Laura Cole of the DDC. The Madison Chamber of Commerce is preparing for a Spring Sidewalk Sale and Merchant Open House on April 26th . This is the same day as the Little League Parade and the Chamber is hoping to increase downtown shopping on that day. COMMUNICATIONS AND PETITIONS The Borough Clerk announced receipt of the following communications: Email received March 18, 2014 from Cheryl Munkel, Loantaka Way, regarding yard waste pick up. Mayor asked that, upon recognition by the Chair, the person shall proceed to the lectern and give his/her name and address in an audible tone of voice, and print the same on the sheet provided for the record. AGENDA DISCUSSIONS 03/24/2014-1 39 GREEN VILLAGE ROAD REDEVELOPMENT PLAN PAGE 7 OF 19 Regular Meeting Minutes – March 24, 2014 Ms. Baillie noted a proposed ordinance for approval of a redevelopment plan for property located at 39 Green Village Road. There was no objection to listing the proposed ordinance for introduction. Ordinance 6-2014 is listed for introduction. ADVERTISED HEARINGS The Clerk made the following statement: Ordinances scheduled for hearing tonight were submitted in writing at a Regular meeting of the Mayor and Council held on March 10, 2014, were introduced by title and passed on first reading, were published in the Madison Eagle and made available to members of the general public requesting same. Mayor Conley called up Ordinances for second reading and asked the Clerk to read said ordinances by title: ORDINANCE 4-2014 CALENDAR YEAR 2014 ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK (N.J.S.A. 40A: 4-45.14) WHEREAS, the Local Government Cap Law, N.J.S.A. 40A: 4-45.1 et seq., provides that in the preparation of its annual budget, a municipality shall limit any increase in said budget to 0.5% unless authorized by ordinance to increase it to 3.5% over the previous year’s final appropriations, subject to certain exceptions; and, WHEREAS, N.J.S.A. 40A: 4-45.15a provides that a municipality may, when authorized by ordinance, appropriate the difference between the amount of its actual final appropriation and the 3.5% percentage rate as an exception to its final appropriations in either of the next two succeeding years; and, WHEREAS, the Borough Council of the Borough of Madison in the County of Morris finds it advisable and necessary to increase its CY 2014 budget by up to 3.5% over the previous year’s final appropriations, in the interest of promoting the health, safety and welfare of the citizens; and, WHEREAS, the Borough Council hereby determines that a 3.0 % increase in the budget for said year, amounting to $ 527,255 in excess of the increase in final appropriations otherwise permitted by the Local Government Cap Law, is advisable and necessary; and, WHEREAS the Borough Council hereby determines that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years. NOW THEREFORE BE IT ORDAINED, by the Borough Council of the Borough of Madison, in the County of Morris, a majority of the full authorized membership of this governing body affirmatively concurring, that, in the CY 2014 budget year, the final appropriations of the Borough of Madison shall, in accordance with this ordinance and N.J.S.A. 40A: 4-45.14, be increased by 3.5%, amounting to $615,131 and that the CY 2014 municipal budget for the PAGE 8 OF 19 Regular Meeting Minutes – March 24, 2014 Borough of Madison be approved and adopted in accordance with this ordinance; and, BE IT FURTHER ORDAINED, that any that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years; and, BE IT FURTHER ORDAINED, that a certified copy of this ordinance as introduced be filed with the Director of the Division of Local Government Services within 5 days of introduction; and, BE IT FURTHER ORDAINED, that a certified copy of this ordinance upon adoption, with the recorded vote included thereon, be filed with said Director within 5 days after such adoption. Mayor Conley opened up the public hearing on Ordinance 4-2014. Since no member of the public wished to be heard, the public hearing was closed. Mr. Wolkowitz moved that Ordinance 4-2014, which was read by title, be finally adopted. Mr. Landrigan seconded the motion. ORDINANCE 5-2014 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $16,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR REPLACEMENT OF THE DEPARTMENT OF PUBLIC WORKS BOILER WHEREAS, the Superintendent of Public Works has recommended that the Borough appropriate $16,000.00 from the General Capital Improvement Fund for replacement of the Department of Public Works Boiler; and WHEREAS, the Chief Financial Officer has attested to the availability of funds in the General Capital Improvement Fund in an amount not to exceed $16,000.00 for this purpose; and WHEREAS, the Borough Council has determined that the Borough should appropriate $16,000.00 from the General Capital Improvement Fund for replacement of the Boiler. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: PAGE 9 OF 19 Regular Meeting Minutes – March 24, 2014 SECTION 1: The amount of $16,000.00 is hereby appropriated from the General Capital Improvement Fund for the replacement of the Boiler. SECTION 2: The budget of the Borough is hereby amended to conform with the provisions of this Ordinance. SECTION 3: This Ordinance shall take effect as provided by law. Mayor Conley opened up the public hearing on Ordinance 5-2014. Since no member of the public wished to be heard, the public hearing was closed. Mr. Landrigan moved that Ordinance 5-2014, which was read by title, be finally adopted. Mrs. Vitale seconded the motion. He/she shall limit his/her statement to three (3) minutes or less. Sam Cerciello, Park Avenue, raise concern regarding snow removal from residential sidewalks. INTRODUCTION OF ORDINANCES The Clerk made the following statement: Ordinances scheduled for introduction and first reading tonight will have a hearing during the meeting of April 10, 2014 in the 2nd Floor Council Chamber of the Hartley Dodge Memorial Building, Kings Road, in the Borough of Madison at 8 p.m., or as soon thereafter as practical, for further consideration and final adoption. Said ordinances will be published in the Madison Eagle, be posted at the main entrance to the Borough offices and be made available to members of the public requesting same, as required by law. Mayor Conley called up Ordinance 6-2014 for first reading and asked the Clerk to read said ordinance by title: ORDINANCE 6-2014 ORDINANCE OF THE BOROUGH OF MADISON ADOPTING A REDEVELOPMENT PLAN IN ACCORDANCE WITH N.J.S.A. 40A:12A-7 FOR 39 GREEN VILLAGE ROAD WHEREAS, on December 9, 2013, the Council adopted Resolution No. 328- 2013 which determined a certain delineated area, commonly known as 39 Green PAGE 10 OF 19 Regular Meeting Minutes – March 24, 2014 Village Road, and designated as Block 3001, Lot 23 on the Borough tax maps, to be an area “in need of rehabilitation” as defined in N.J.S.A. 40A:12A-14; and WHEREAS, on January 27, 2014, the Council adopted Resolution No. 50- 2014 which authorized and directed the Planning Board to prepare a redevelopment plan for the delineated area in accordance with N.J.S.A. 40A:12A-7; and WHEREAS, the Planning Board has prepared a proposed redevelopment plan for the delineated area in need of rehabilitation and by motion at the Planning Board’s March 4, 2014 meeting, has transmitted it to the Council with a recommendation that it be adopted. The proposed redevelopment plan meets all of the requirements of N.J.S.A. 40A:12A-7 and the area governed by the Plan is the same area as defined in Resolution No. 328-2013. NOW THEREFORE BE IT ORDAINED by the governing body of the Borough of Madison that the Redevelopment Plan for 39 Green Village Road is hereby approved. BE IT FURTHER ORDAINED, that the Borough Clerk forward a true copy of the adopted ordinance to the Morris County Planning Board pursuant to NJSA 40:55D- 16, and publish said notice in accordance with NJSA 40:49-2.d. Ms. Baillie moved that Ordinance 6-2014, which the Borough Clerk read by title, be adopted. Mr. Landrigan seconded the motion.
